Conditions of Entry
1 Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2 Entry is open only to Australian residents, excluding directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies or companies associated with this competition.

The competition begin at 12.01am (AEST) on 05/08/11 and closes at 11.59pm (AEST) on 05/09/11 (Competition Period).4 To enter, consumers must, during the Competition Period:
(a) receive an email from the Promoter inviting them to participate in this competition;
(b) click on the link contained in the promotional email which will take them to an online referral form at www.herbertadams.com.au; and
(c) fully complete and submit the referral form including by providing 3 different friends’ names and email addresses and the entrant’s personal details as set out on the form.5 Each friend whose details are contained in the entrant’s referral form will then receive an email from the entrant inviting them to join the Herbert Adams database. Entrants must only provide the email addresses of friends who have given their implied or express consent to receive an email from the entrant in relation to this competition. Referred friends must not currently be registered on the Herbert Adams database. The entrant will receive one entry into the draw for each friend (who is not a current member of the Herbert Adams database) who is referred to and then joins the Herbert Adams database. Each friend must sign up to the Herbert Adams database and validate their email address during the Competition Period in order for the entrant to receive an entry with respect to that friend.
6 If an entrant refers 3 friends to join the Herbert Adams database but none of the friends join the database during the Competition Period, the entrant will still receive one entry into the draw.
7 All entries must be received during the Competition Period. Consumers may enter as many times as they wish provided that each entry is based on the referral of 3 different friends. Each friend may only be referred to the database once by any entrant. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them, due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses and/or aliases may be disqualified.
8 For any referred friend who signs up and joins the Herbert Adams database within the Competition Period, that friend will also receive one entry into the draw.
9 A draw will take place at 12noon (AEST) on 06/09/11 at Prime Focus, 403/62 Beach Street, Port Melbourne, VIC 3207. The first valid entry randomly drawn from all valid entries received will win the prize.
10 The prize is a $1,500 (inc GST) EFTPOS card to be used by the winner for the purpose of a garden makeover.
11 The EFTPOS card can be used for purchases anywhere in Australia where EFTPOS is accepted. The EFTPOS card is subject to conditions of use as imposed by the prize supplier, including period of validity.
12 The total prize pool is valued at $1,500 (inc GST).
13 The winner will be notified by phone and in writing immediately after the draw and will have their name and state/territory of residence published on the Herbert Adams website and in The Australian on 20/09/11. By entering this competition, each entrant requests that his or her full address not be published.
14 The prize winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
15 If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry in accordance with paragraph 9. The judges’ decision is final and no correspondence will be entered into.
16 If the prize has not been accepted or claimed within 3 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws at 2pm (AEDT) on 07/12/11, at the same location as the original draw as are necessary to distribute the prize, subject to any requirements of any gaming authority. Any winner in this draw will be notified by phone and in writing immediately after the draw and will have their name and state/territory of residence published on the Herbert Adams website and in The Australian on 21/12/11.
17 Prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize or any element of a prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory if required.
18 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
19 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
20 The Promoter may require winners to provide proof of identity and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
21 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.
22 If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, if required.
23 The Promoter is not liable for any tax implications arising from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
24 All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. Entrants personal information will also be used by the Promoter in accordance with the Herbert Adams database privacy policy. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
