Hotels.com 20th anniversary Prize Draw TERMS & CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. By entering the Hotels.com 20th Anniversary Prize Draw ("the Prize Draw") you agree to be bound by these terms and conditions ("Terms and Conditions").
The Prize Draw is open to residents of Australia, New Zealand, Japan, Republic of Korea, Singapore, China and Taiwan who are 18 years of age or over ("Participants").
By registering to receive Hotels.com email newsletters within the Promotion Period and agreeing to these Terms and Conditions, Participants will be automatically entered into the Prize Draw. The Prize Draw will include entrants from Australia, New Zealand, Japan, Republic of Korea, Singapore, China and Taiwan. Participants will be entered only once. No purchase is necessary to participate. Entry can be made by signing up to Hotels.com email newsletter emails and agreeing to these Terms and Conditions on the Hotels.com 20th Anniversary promotion landing page before 23:59pm (Australian Eastern Standard Time "AEST") on 20th August 2011. Participants who unsubscribe or opt-out from Hotels.com email newsletters before the end of the Promotion Period will not be entered into the Prize Draw. Participants may only win one Prize each.
The entry period is from 00:01am (AEST), 1st August 2011 to 23:59pm (AEST), 20th August 2011 ("Promotion Period").
The Prize Draw is not open to employees or agents of the Promoter or its group companies, their immediate families and members of their household and any other persons professionally connected with the Prize Draw. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and Participants (including a Participant's identity, age and place of residence) and to disqualify any Participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. No automated, third party, bulk or multiple entries will be permitted. Where any Participant attempts to make automated, third party, bulk or multiple entries, the Promoter reserves the right to remove all such entries from the Prize Draw. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of a Participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Participant.
No responsibility is accepted by the Promoter for any incomplete or inaccurate entries or for matters beyond its control during the conduct of the Prize Draw.
If this Prize Draw is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Prize Draw, as appropriate.
There are forty (40) prizes in total to be won which are split into three separate groups ("Prizes").
The first twenty (20) valid entries drawn will win a Group A Prize ("Group A Prize"): each Group A Prize consists of a voucher for three (3) nights double or twin share accommodation for two (2) people (can be redeemed any day of the week – Monday to Sunday) including breakfast daily in a Hilton hotel. The voucher will take the form of a voucher code redeemable on
www.hotels.com. In the case of any Australian winners, the voucher will have a value of AU$943.45. The voucher may only be redeemed against stays at participating Hilton hotels in Australia, China, Hong Kong, India, Indonesia, Japan, Malaysia, New Zealand, Pacific Islands, Singapore, Thailand, Vietnam and South Korea, a list of which will be made available to Prize Winners by the Promoter.
The next eight (
valid entries drawn will win a Group B Prize ("Group B Prizes"). Each Group B Prize consists of a voucher for two (2) nights double or twin share acccommodation for two (2) people (can be redeemed any day of the week – Monday to Sunday) including breakfast daily in a Sofitel hotel in Asia Pacific. Group B Prizes are valid for redemption directly at each of the following participating Sofitel hotels: Sofitel Melbourne, Sofitel Sydney Wentworth, Sofitel Brisbane Central, Sofitel Gold Coast Broadbeach, Sofitel Queenstown, Sofitel Fiji, Sofitel Bora Bora and Sofitel Legend Metropole Hanoi. In the case of any Australian winners, the voucher will have a value of AU$565.94.
The next twelve (12) valid entries drawn will win a Group C Prize ("Group C Prizes"). Each Group C Prize consists of a voucher for three (3) nights' accommodation for two (2) people (can be redeemed any day of the week – Monday to Sunday) including breakfast daily valid for redemption directly at each of the following participating Sofitel hotels: Sofitel Bangkok Silom, Sofitel Centara Grand Resort, Sofitel Krabi Phokeethra, Sofitel Angkor Phokeethra, Sofitel Phnom Pehn Phokeethra, Sofitel Philippine Plaza, Sofitel Plaza Hanoi, Sofitel Saigon Plaza, Sofitel Macau at Ponte, Sofitel Wanda Beijing, Sofitel Shanghai Hyland and Sofitel Shanghai Sheshan. In the case of any Australian winners, the voucher will have a value of AU$565.94.
In the event that all prizes are won by Australian residents, the total Prize pool value will be AU$30,187.80. The Prizes are non-transferable, non-refundable and non-changeable. Cash or credit alternatives will not be offered. The Promoter will not substitute a Prize of a similar value under any circumstances unless stipulated otherwise by the Promoter.
The Prize Draw will occur on 26th August 2011 at 12:00 noon (AEST) at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004. The winners ("Prize Winners") will be drawn at random by a judge from all complete, eligible, properly submitted entries throughout the countries in which the Prize Draw is being promoted and which are received during the Promotion Period. The judge's decision is final and no correspondence will be entered into.
The Prize Winners will be notified by email via the email address provided and will receive their Prize no later than 7 working days after they acknowledge receipt of the notifying email. In the case of Australian Prize Winners, their names will be published in "The Australian" on 31st August 2011. Prize Winners may be required to submit valid identification before receiving their Prize. The Promoter reserves the right to conduct a further random draw to award any Prize that is claimed by an ineligible Participant (including a Participant that fails the Promoter's verification procedures).
If any Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
In the case any prizes won by Australian residents, an unclaimed prize draw may take place on 30th November 2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Any winner(s) will be notified by email and published in "The Australian" on 6th December 2011.
The Prize must be redeemed by 1st March 2012. If for any reason a Prize Winner does not redeem the Prize by 1st March 2012, then the Prize will be forfeited. The Prize may be redeemed only once and must not be used in conjunction with other offers or promotions. All bookings are subject to hotel availability. Usual booking terms and conditions apply. Validity of the Prize Voucher cannot be extended.

The Prize Winners and their companions will be responsible for obtaining valid passports and visas and, where necessary, appropriate vaccinations and inoculations. It is strongly recommended that travellers take out adequate travel insurance.
The Prize Winners will be responsible for paying all associated costs that are not specifically stated in these Terms and Conditions, including (where applicable) flights, transport, meal costs (apart from breakfast), other travel expenses, items of a personal nature, in-room charges, ancillary costs, spending money, insurance and all other incidentals. Prize Winners will also be personally responsible for any Value Added Tax ("VAT"), national and/or local tax liabilities incurred in claiming or using the Prize.
Any cost associated with accessing the promotional website is the Participant's responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (or any other country, as applicable) ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Prize Winner or Participant; or (e) use of a Prize.
Participants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Prize Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Prize Winners (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The laws of Australia apply to this promotion to the exclusion of any other law. Participants submit to the exclusive jurisdiction of the courts of Australia.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the participant. Participants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
