The prize draw will take place on 27/1/12 at 11:00am AEDT.

Winners will be notified in writing and their names will be published in The Australian on 3/2/12.

The first seventy-one (71) valid entries drawn will win a prize. Prizes will be awarded in descending order of value, with the first valid entry drawn receiving the prize with the highest value, the next valid entry drawn receiving the prize with the second highest value and so on, until all prizes are awarded. The nature of the prizes and the prize allocation is specified in the table below.

The Jeep Patriot awarded is a 2011 Jeep Patriot Sport CVT model with automatic transmission The value of the car includes registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion, accommodate the winner's colour preference (excluding metallic options), subject to availability. The winner of the Jeep Patriot must collect the prize from their nearest authorised Jeep dealership.

If the winner of the Jeep Patriot is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.

The Ultimate Fishing Kit includes:

•1 x Sport-fishing outfit (Shimano TLD 25 matched with a Nitro Coffin 2 piece graphite game rod with 300 yards of 30lb Braided line plus a Braid Gimbal belt);
•1 x Flyfishing outfit (Water works ULA reel matched with a velocity 6 weight fly rod loaded with a Scientific Anglers shark skin line, fly line and backing and a reel);
•1 x General purpose snapper boat outfit (Uglystik 7' 2 piece rod matched with a Penn line liner baitrunner reel with 300 yards of 20lb braid and a Plano tackle box);
•1 x Surf Outfit (Shogun 3 piece graphite surf rod matched with a Daiwa Emcast reel; 300 yards braid, a surf spike, a surf bag and a headlamp); and

Who can enter


1.Entry is only open to all Australian residents aged 18 years or over.
2.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4.To be eligible for entry into the prize draw, an individual must make a passenger booking to travel on Spirit of Tasmania (specifying themselves as the contact name on the booking). Bookings must be made between 14/8/11 and 11:59pm AEST on 30/9/11 with a minimum of one journey (MEL-DPO or DPO-MEL) per booking having completed travel by 16/12/11. In the event of a group booking, only the individual whose name appears as the contact name on the booking (not the individual ticket holders) will be eligible to enter. In the event that a travel agent is booking their own travel as a passenger, the travel agent must pay the full price of the travel fare to be eligible to enter (i.e. no discounted bookings from travel agents will be accepted).
5.To enter, eligible individuals must visit spiritoftasmania.com.au/competition, follow the prompts to the promotional entry page and register the requested details (including the full contact name as specified on the booking, residential address, contact telephone number, email address and booking number), read and accept these Terms and Conditions, and submit the fully completed online entry form by 11:59pm AEDT on 31/12/11.
6.Upon completion of the above, eligible individuals will be entered into the prize draw.
7.Incomplete or indecipherable entries will be deemed invalid. If a booking is cancelled or the travel dates are amended where the minimum of one journey is not completed within the eligible travel period, then entry for that booking will also be deemed invalid. In addition, bookings made on discounted fares will also be deemed invalid.
 

General


1.Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Multiple entries permitted, subject to the following: (a) only one (1) entry into the prize draw is permitted per person (if their name appears as the contact name for the booking) per booking number; and (c) each entry must be submitted separately and in accordance with entry requirements.
3.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
4.All draws will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004.
5.Any ancillary costs associated with redeeming the Spirit of Tasmania gift vouchers are not included. Any unused balance of the Spirit of Tasmania gift vouchers will not be awarded as cash. Redemption of the Spirit of Tasmania gift vouchers is subject to any terms and conditions of the issuer including those specified on the Spirit of Tasmania gift vouchers. Winners should see their Spirit of Tasmania gift vouchers for date of expiry.
6.The Promoter's decision is final and no correspondence will be entered into.
7.Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited.
8.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
9.Total prize pool value is up to AU$62,817.
10.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
11.A draw for any unclaimed prizes may take place on 27/4/12 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified by telephone and in writing and their names (for prizes over $250) will be published in The Australian on 4/5/12.
12.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
13.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
14.Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
15.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
16.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
17.As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
18.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
