Eligibility Requirements & Promotional Period
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Promotion commences on Monday 22 August 2011 and ends at close of business on Sunday 18 September 2011 or when stocks of game cards run out, whichever is first to occur (“Promotional Period”).
3. Entry is only open to Australian residents.
4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
5. Employees (and their immediate families) of the Promoter, participating Donut King stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
How to Enter
6. To receive one (1) game card eligible individuals must, during the Promotional Period, spend AU$5 or more in a single transaction at any Donut King store within Australia.
7. Entrants must then scratch their game card to reveal whether or not they have won an instant prize. If they have won an instant prize, the prize won will be listed on the game card.
8. Non-winners can enter the 2nd Chance Draw for any unclaimed prizes by visiting

Instant Win Prizes
10. Instant win prizes available to be won are as follows:

11. Instant winners will be notified in writing via the message on the game card.
12. To claim the AU$500 Coles Group & Myer Gift Card, eligible instant winners must send an email to
30thbirthday@donutking.com.au with the subject line “Donut King 30th Birthday Promotion – Instant Winner” and in the body of the email their full name, valid email address, address and phone number and attach a scanned PDF version of both their game card (with unique code clearly showing) and their purchase receipt. Winners have until 5.00pm AEDST on 30th November 2011 to claim their prize. Once validated the Promoter will send the Gift Card to the winner via registered mail to the address provided by the winner on entry. Winners of the $500 Coles Group & Myer Gift Card prize will not be entered into the 2nd Chance Draw.
13. Winners’ names for the AU$500 Coles Group & Myer Gift Card prizes will be published in The Australian on Friday 16th December 2011.
14. Any ancillary costs associated with redeeming the Gift Card are not included. Any unused balance of the Gift Card will not be awarded as cash. Redemption of the Gift Card is subject to any terms and conditions of the issuer including those specified on the Gift Card.
15. To claim the two (2) Classic Cinnamon donuts instant prize, eligible instant winners must surrender their winning game card to a staff member at any Donut King store within Australia . Game cards revealing the donut prize must be redeemed in store by close of business on 30th November 2011.
16. If a winner of the AU$500 Coles Group & Myer Gift Card prize is under 18 years of age, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.

Proof of Purchase
17. Entrants must retain their original purchase receipt(s) for all prize claims/entries as proof of purchase. Failure to produce the proof of purchase for all prize claims/entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s prize claims/entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify Donut King as the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
18. Winners of the AU$500 Coles Group & Myer Gift Card prizes must retain original promotional game card(s) clearly showing the unique code for all entries as proof of purchase. In addition, non-winners who choose to enter the 2nd Chance Draw must send through the original game card(s) clearly showing the unique code with their entry form as proof of purchase. Failure to produce the original game card(s) for all prize claim(s) when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s prize claim(s)/entries and forfeiture of any right to a prize.
2nd Chance Draw
19. The 2nd Chance Draw for any unclaimed AU$500 Coles Group & Myer Gift Card prizes may take place on 1 March 2012 at 11.00am AEST at RFGA Management, PTY LTD, 1 Olympic Circuit, Southport QLD 4215, subject to any directions from a regulatory authority. Winners, if any, will be notified by mail and winners’ names will be published in The Australian newspaper on 9 March 2012.
General
20. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
21. The Promoter’s decision is final and no correspondence will be entered into.
22. The Promoter reserves the right, at any time, to verify the validity of prize claims/entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits a prize claim that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
23. Multiple games cards permitted per person, however, only one (1) game card permitted per $5 or more spent at any Donut King store in Australia, in a single transaction during the Promotional Period. For the sake of clarity, entrants will only receive one (1) game card, even if they spend more than $5 in a single transaction.

24. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.
25. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
26. Total prize pool value is AU$159,000.
27. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
30. Printing and other quality control errors will not invalidate an otherwise valid prize claim.
31. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured.
32. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
33. There will be a total of 800,000 instant win game cards printed for this promotion.
34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or

any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
36. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Claiming a prize is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All prize claims/entries become the property of the Promoter.
