1. General
(a) STYLETREAD.com.au, Unit 3, 35 Carter Street, Homebush, NSW 2127. The prize valued at $1000 which is five $200 vouchers will be provided by STYLETREAD Shoes.
(b)The Promoter for this lottery under the NSW PERMIT NO: LTPS-11-07061 is STYLETREAD Pty Ltd.
(c) Information on how to enter forms are a part of these Terms and Conditions.
(d) By entering any competition promoted by STYLETREAD you agree to these Terms and Conditions and any other applicable terms as advised by STYLETREAD.
(e) For the purposes of these Terms and Conditions, STYLETREAD includes its parents, related and subsidiary companies, past present and future officers, agents, representatives, employees, and assigns.
2. Entry requirements
(a) Entry is open to all Australians who are over the age of 18 years as at 15/08/2011.
(b) If you are an existing customer/subscriber you can enter in the competition with an alternate email address.
(c) The employees, agents and contractors of STYLETREAD, any of its affiliate, parent or subsidiary companies are not eligible to enter the Competition.
(d) Direct family members of any person included in 2(b) are not eligible to enter.
(e) To enter, eligible entrants leave email address and go on the STYLETREAD.com.au/1000-giveaway webpage between 15/08/2011 to 15/01/2012 and get a chance to win one out of five $200 shoe vouchers and thereby agree to the terms and conditions.
(f) There is a limit of one entry per person.
(g) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any competition prize.
(h) Any information, photographs, audio-visual or other material provided to STYLETREAD by an entrant as part on an entry to this competition will not be returned to entrants. Entrants are advised to not send original material.
(i) Entries to this competition open on Tuesday, August 15, 2011 at 9:01am (AEST) and close on January 15, 2012 at 11:59pm (AEST). Entries received after closing dates will not be eligible.
(j) STYLETREAD accepts no responsibility for lost entries.
(k) By entering the competition and checking the opt-in box on the entry form, entrants agree that their full name and email address will be provided to STYLETREAD for the purposes of marketing and they agree that STYLETREAD may send them marketing/promotional material. All communications from STYLETREAD will be subject to all laws and regulations in respect of commercial electronic messages.
(l) Unless otherwise agreed, any personal or confidential information submitted to STYLETREAD by any person in the course of entering or being otherwise involved in this competition such as name, address, telephone number will be treated in accordance with STYLETREAD’s Privacy Policy.
3. Judging
(a) Entries will be drawn and judged at STYLETREAD’s office at Unit 3, 35 Carter Street, Homebush, NSW 2127 on January 25, 2012 at 2:00pm (AEDST).
(b) This Competition is a game of skill. A judge appointed by STYLETREAD will randomly select the winner based on those entrants who answered the game of skill question correctly.
(c) The winners will be announced on the 25/01/2012 on the styletread.com.au website on the terms and conditions page of this competition.
(d) The winners will be notified online via email and the vouchers shall be given away after we get their full contact details.
(e) If STYLETREAD is unable to contact the prize winners after reasonable efforts, STYLETREAD may assign the prize to the entry judged the next best entry in the competition.
(f) The decision of the judges is final and STYLETREAD will not enter into correspondence or communication regarding the judges’ decisions even where STYLETREAD may not have acted reasonably or where STYLETREAD is shown to have made a decision in error.
4. Prize
(a) Randomly the appointed judges will select the winner of the $500 STYLETREAD Shoe voucher based on those entrants who entered their email address and subscribed to Styletread Newsletter.
(b) There will be five major prizes for this competition. The major prize draw will take place at 2pm AEST at STYLETREAD Pty Ltd, Unit 3, 35 Carter Street, Homebush, NSW on the 25/01/2012. The first to fifth valid entry drawn will be awarded a voucher for one free pair of shoes worth a maximum of $200 AUD.
(c) The prize cannot be used in conjunction with any other discounts or special offers.
(d) The prize is not transferable for any other brands.
(e) The prize can only be used one time only.
(f) STYLETREAD may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before STYLETREAD gives the prize over.
(g) STYLETREAD may require any person collecting a prize to sign a copy of these Terms and Conditions.
(h) Once a prize has been collected STYLETREAD is not responsible for the use or distribution of any prize.
(i) STYLETREAD will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.
(j) If a prize referred to in this competition becomes unavailable for any reason STYLETREAD reserves the right to substitute that prize for a similar item of similar value.
(k) Prizes are not transferable or redeemable for cash. STYLETREAD accepts no responsibility for any variation in the value of the prizes.
(l) Prize winners agree to participate in any promotional activity promoting STYLETREAD, prize sponsors and/or the competition at the reasonable request of STYLETREAD.
5. Intellectual Property
(a) STYLETREAD may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.
(b) Any material, including without limitation competition entries and images and/or audio-visual material included in competition entries, submitted or provided by a competition entrant, and/or prize winner in association with any competition will become the property of STYLETREAD and STYLETREAD may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.
(c) STYLETREAD may require an entrant or prize winner to execute any document necessary to give effect to 5(a) and/or (b).
6. Warranties
(a) Entrants warrant and represent to STYLETREAD that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.
(b) Entrants indemnify STYLETREAD against any claim, loss or damager suffered by STYLETREAD as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.
(c) If STYLETREAD becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to STYLETREAD , STYLETREAD may deem that prize winner ineligible.
7. Governing Law
These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
