Smiggle Dictionary Competition - Terms and Conditions

By entering this competition, entrants are deemed to agree to these terms and conditions.
1) Conditions of entry

Entry to the Smiggle Dictionary Competition is open to current members of Smiggle Colour Crews only. Smiggle employees and contractors are not eligible to enter.
2) Start and finish dates

Entry to the Smiggle Dictionary Competition commences at 9:00am (Melbourne time) on Monday 15th August 2011 and closes at 11.59pm on Sunday 11th September 2011 (Melbourne time) ('Entry Period').
3) How to enter

Entrants must combine two existing words to create a new word in accordance with these terms and conditions, fill in the entry form, follow the prompts, and submit their entry to the website www.smiggle.com. Entries must be received by Smiggle during the Entry Period to be valid.
4) Prizes

1. The entry with the most votes will win the major prize of a Sony Ebook Reader in black valued at AUD$229.95 ('Major Prize').

2. A runner up prize will be awarded to the most creative entry for each letter of the alphabet as judged by Smiggle and will consist of a prize pack valued at $34.90, made up of the following items:

    1 x Large Smiggle Planter Box valued at AU $9.95ea
    1 x 30 Pack of Pens valued at AU $24.95ea

Colours of each item are as per stock availability and winners are unable to select their preference.

3. The 26 runners up will also be awarded the 'Smiggle Choice Award'.

Prizes are not transferable and cannot be exchanged for cash. Prizes will be mailed to the winners at the address supplied on their Smiggle registration form.

Entries submitted by all prize winners may also be published on the Smiggle website along with the display name and colour crew of the winner.
5) Awards

Entrants to the Smiggle Dictionary Competition are eligible to receive the awards described on the competition page and awards page of the Smiggle Colour Crews website. There are awards for individuals and for crews. Winners of awards will have an icon added to their profile page at the end of the competition.
6) Selection of prize winners and award winners

The winner of the Major Prize will be determined by the number of votes submitted by Colour Crew members during the Entry Period.

If two or more entries receive the same number of votes, a judging panel appointed by Smiggle will select the winner from the tied entries in its sole judgement based on the creative merit of the entries.

Smiggle will also select 26 'Smiggle Choice Award' winners as runners up. There will be one Smiggle Choice Award selected by Smiggle for each letter of the alphabet. The awards will be selected by Smiggle in Smiggle's absolute discretion based on the creative merit of all the valid entries and will take into consideration the number of votes received by each entry from other Colour Crew members.

Smiggle will determine the prize winners on Monday 12th September 2011. Smiggle's decision regarding the prize winners is final, and Smiggle will not enter into correspondence regarding the outcome.
7) Voting

Voting is permitted between 9:00am (Melbourne time) Monday 15th August 2011 and 11.59pm on Sunday 11th September 2011 (Melbourne time) on Smiggle's website only. All Colour Crew members are entitled to vote on every submission once only.
Cool Rights in entries

Entrants warrant and represent that they own all rights (including without limitation copyright) in the entry submitted to the Smiggle Dictionary Competition and that the entry is free of any claims that it infringes any third party rights.

By submitting the entry, entrants grant to Smiggle a perpetual, royalty-free, non-exclusive licence to publish the entry on the Smiggle website and social networking sites, on its in store plasma TVs and in any other Smiggle promotional material whatsoever throughout the world.

Entrants acknowledge that Smiggle in its sole discretion may modify or adapt the submitted entries for promotional use online and in store, and may or may not attribute the entries to the entrants.
9) Notification of prize winners

Prize winners will be notified by telephone (if they have provided their telephone number when registering), otherwise by email. Prize winners' display name will also be published on the Smiggle website.

If any prize winner selected by Smiggle is ineligible to receive a prize, or forfeits the prize, or cannot be contacted by Smiggle within a reasonable period of time, Smiggle may select a new winner in Smiggle's discretion.
10) Unsuitable entries

Without limiting anything else in these terms and conditions, entries must:

1. not contain anything unlawful, misleading, discriminatory or defamatory;

2. not contain content that is otherwise inappropriate;

3.not bully intimidate or harass.

Smiggle reserves the right to disqualify from the competition or remove from the web and it's in store plasmas, any entry which in the sole opinion of Smiggle includes content which is not suitable for publication concerning Smiggle or does not comply with these terms and conditions.
11) Liability

Smiggle assumes no responsibility for any technical error, omission, interruption, deletion, defect, delay, loss or damage in the operation of the Smiggle website and/or participation in the Smiggle Dictionary Competition. If for any reason the competition is not capable of being run as planned, due to causes beyond the reasonable control of Smiggle, Smiggle may modify, suspend or terminate the competition.
12) Privacy

By submitting an entry, you consent to the use of your personal information as set out in this privacy statement. Smiggle may collect and use personal information submitted with each entry for the purpose of running the competition, contacting winners, and sending prizes. Personal information may be provided to third party organisations who assist in maintaining the Smiggle website and/or running the competition. Smiggle uses a USA company to facilitate monitoring services and what you provide will pass through their system. This company may also email you information about your entry on behalf of Smiggle. If entrants do not provide the required personal information they will not be eligible to participate in the competition. To update your personal information, you can login to your profile and do it yourself or contact the Smiggle Privacy Officer on 1800 333 232 or email privacyofficer@jjh.com.au
13) Applicable law

These terms and conditions are governed by the laws of Victoria, Australia and entrants submit to the exclusive jurisdiction of the Victorian courts in relation to any disputes arising under these terms and conditions.
14)Promoter

The promoter of the competition is Smiggle Pty Ltd (ABN 53 100 379 226) of 658 Church St, Richmond, Victoria 3121.
