Samsung is giving one deserving Australian the opportunity to travel to the UK to carry the torch in the Olympic Torch Relay. Nominate your Local Hero who has gone the extra mile for your community and why he/she deserves the honour of carrying the Olympic Flame.

London 2012 Olympic Torch Relay - Nominator Terms and Conditions

You (the"Nominator") wish to nominate someone to participate in the London 2012 Olympic Torch Relay. By providing the details of the person you wish to nominate (the"Nominee"), you will allow them to enter into the Promoter's nomination process (the"Nomination Process") for the opportunity to participate in the London 2012 Olympic Torch Relay.
IF YOU ARE UNDER THE AGE OF 18, you may nominate someone but you must have your parent or guardian's consent to do so.
Nominators must have obtained the permission of the Nominee to (a) nominate them; and (b) supply their personal details to the Promoter. Nominators must explain the Nomination Process and these Terms and Conditions (defined below) to Nominees (including the use of Nominee details and the fact that the Promoter will use their contact details to contact them directly). Each Nominee will be informed of the identity of their Nominator and will be asked to confirm the accuracy of the information provided by the Nominator.
Information provided about Nominees may be validated through different sources. The information must be accurate. Inaccurate information provided about Nominees will result in the Nomination (defined below) being removed from the Nomination Process and/or the Prize (defined below) being withdrawn.
By providing the Nominee's details, you agree to be bound by the following Terms and Conditions. Any information or instructions published by the Promoter about the Nomination Process on the Samsung website www.samsung.com.au and the Channel 7 Sunrise program website www.yahoo7.com.au/sunrise also form part of these terms and conditions (“Terms and Conditions”).
The Promoter
1. The promoter is Samsung Electronics Australia Pty Ltd ABN 63 002 915 648 of Quad Samsung, 8 Parkview Drive, Homebush Bay, NSW 2127, phone number 02 9763 9700 (the "Promoter").
Eligibility
2. In order to enter the Nomination Process:
a. both the Nominator and Nominee must be aged 12 or over;
b. the Nominator must have obtained Nominee approval and explained the Nomination Process and use of Nominee details by the Promoter under these Terms and Conditions;
c. where the Nominator is under 18 years of age, the Nominator must have obtained parental or guardian approval to Nominate the Nominee;
d. the Nominee must be an Australian resident and have an address in Australia; and
e. if the Nominee is under 18 years of age, the Nominee must have sought parental or guardian approval to agree to be nominated by the Nominator.
3. Employees or agents of the Promoter or any of its group companies or their families or households or anyone professionally connected to this promotion or any Nomination Process are not eligible to enter.
4. No purchase is necessary to nominate a Nominee.
The Prize
5. If the Nominee is a Successful Nominee (defined below), they will have the opportunity to carry the Olympic Torch for between 200 and 300 metres at a location in the United Kingdom and on either 23 or 24 June 2012, as determined by the Promoter and/or the London Organising Committee for the Olympic and Paralympic Games (“LOCOG”) in their sole discretion (the "Torchbearer Slot").
6. Each Successful Nominee will receive the following prizes:
a. Two (2) paid economy airfares (including taxes and insurance) from the Successful Nominee's nearest Australian capital city to the United Kingdom (final destination to be confirmed);
b. Three (3) nights twin share accommodation in the Manchester/Leeds, United Kingdom, including transfers from Torchbearer location United Kingdom, airport;
c. spending money to the value of AUS$1,000 and

d. the opportunity to participate in the Torchbearer Slot.

(collectively, the "Prize").
7. In order to receive the Prize, each Successful Nominee must:
a. confirm and agree in writing to the Promoter's conditions of accepting the Prize. If the Successful Nominee is under the age of 18 at the time of selection, submit a signed hard copy of the Promoter's conditions of accepting the Prize that is signed by their parent or guardian. If a signed copy of the Promoter's conditions of accepting the Prize is not received, the Nominee will forfeit their Prize and an alternative Successful Nominee will be selected in accordance with these terms;
b. provide LOCOG with all information requested by LOCOG at the times requested by LOCOG (including to allow LOCOG to carry out identity checks);
c. confirm and agree to the LOCOG participation agreement (a copy is available at the following website: www.samsung.com.au ;
d. if the Successful Nominee is under the age of 18 at the time of selection, submit a hard copy of the LOCOG participation agreement that is signed by their parent or guardian. If a signed copy of the LOCOG participation agreement is not received, the Nominee will forfeit their Prize and an alternative Successful Nominee will be selected in accordance with these terms;
e. comply with all reasonable instructions issued by the Promoter and LOCOG; and
f. when carrying the Olympic Torch, wear the official uniform provided by LOCOG.
8. The Prize carries no cash value, is non-transferable and may not be substituted by the Successful Nominee.
Nomination Period
9. The Nomination Process is open from 06:00 (AEST) on 5 September 2011, and closes at 23:59 (AEST) on 16 September 2011 ("the Nomination Period").
10. Nominators must nominate a Nominee during the Nomination Period in order for them to be entered into the Nomination Process.
Nomination
11. In order for a Nominee to be entered into the Nomination Process:
a. during the Nomination Period a Nominator must visit the www.yahoo7.com.au/sunrise website and enter all required information, including the Nomination Criteria (defined below) ; and
b. if the Nominee is under the age of 18 at the time of Nomination, the Nominator must also provide contact details for a parent or guardian of the Nominee. The Nominee's parent or guardian must provide their written consent to the Nominee being entered into the Nomination Process otherwise the Nominee will be removed from the Nomination Process without further notification to the Nominator (the "Nomination").
12. Any text or other content which is submitted by the Nominator and/or the Nominee as part of the Nomination or otherwise (the "Content") must adhere strictly to the following content guidelines (the "Content Guidelines") for the Nomination Process:
a. the Content must be the Nominator's or the Nominee's own original creation;
b. the Content must not infringe any third party intellectual property;
c. the Content must not infringe the rights of, or be defamatory or libellous about, any person;
d. the Content must not provide personal information about any person unless the Nominee has obtained that person's permission;
e. the Content must be suitable for a person of any age to view and must fully comply with the law and all regulations;
f. the Content must not contain or display any words, images or sounds which are considered, at the Promoter's sole discretion, to be offensive, sexually explicit, rude, disparaging or otherwise inappropriate; and
g. the Content must comply with any further content guidelines published by the Promoter.
13. Nominations containing any Content that does not comply with the Content Guidelines will not be entered into the Nomination Process.
14. Nominations that are incomplete or damaged will be deemed invalid. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of data.
15. The Promoter reserves the right at its absolute discretion to disqualify Nominations which it considers do not comply with these Terms and Conditions or any Nominator or Nominee whom it reasonably believes has interfered with the fair running of the Nomination Process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
16. Only one Nomination will be considered for each Nominee. Nominators may nominate more than one Nominee.
17. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of a Nominator or Nominee.
Successful Nominee Selection
18. This competition is a game of skill and the criteria for determining each Successful Nominee is based on the information provided by the Nominator, being 200 words or less, with regard to the question why the Nominee is “an ordinary person doing extraordinary things” (the “Nomination Criteria”). The successful nominee will be the Nominee who best conforms to the above description (“Successful Nominee”).
19. The Successful Nominees shall be decided as follows:
a. The Nominations will be reviewed and judged by a panel of judges comprised of employees or agents of the Promoter (the "Judging Panel").
b. The Judging Panel shall review the Nominations to determine the Nominations which, in the Judging Panel’s view, best meet the Nomination Criteria, and shall award the Prize available.
20. The decision of the Judging Panel is final. No correspondence or negotiation will be entered into by the Promoter concerning their decision.
21. Details of the Successful Nominees will be announced on or about 26 September 2011 on the Channel 7 Sunrise program and published on both the Samsung website at www.samsung.com.au and the Channel 7 Sunrise program website at www.yahoo7.com.au/sunrise.
22. In the event that a Successful Nominee or Substitute Successful Nominee (defined below) is unreachable following four (4) weeks of the announcement of the Successful Nominee or Substitute Successful Nominee, ineligible, or fails to claim parts of their Prize following four (4) weeks of the date agreed between the Promoter and the Successful Nominee or Substitute Successful Nominee, the Successful Nominee or Substitute Successful Nominee shall forfeit their Prize and it will be awarded to a substitute successful nominee, which shall be the next placed Nominee chosen by the Judging Panel (“Substitute Successful Nominee”)..
23. The Successful Nominee will be notified by LOCOG using the email address provided at the time of Nomination. LOCOG intends to notify all Successful Nominees between December 2011 and February 2012. The Successful Nominee’s details will also be published on LOCOG's website at http://www.london2012.com/olympic-torch-relay.
24. Nominators are responsible for providing and updating the correct contact details of the Nominees. If the Prize needs to be delivered to the Successful Nominee, it is the responsibility of the Successful Nominee to be available to receive the Prize and for the Nominee and or Nominator to update the Promoter of any changes to the Nominee's address and contact details provided by the Nominator at the time of Nomination.
Use of the Nominations / Content by the Promoter
25. The Nominator hereby provides a non-exclusive, royalty-free, irrevocable, perpetual, transferable licence (including the right to sub-license) to the Promoter and LOCOG to use the Content submitted for any purpose, including without limitation for advertising the Promoter's products. The Nominator hereby waives all moral rights they have in the Content submitted to the fullest extent permitted by law.
26. Each Nominator warrants that they are the person who created the Content they submit and that all such Content adheres to the Content Guidelines. The Nominator shall indemnify the Promoter and hold it harmless from and against any losses, damages, liabilities, obligations, claims, actions and demands, including without limitation reasonable legal fees, arising directly or indirectly from any breach of warranty set out in this clause.
Privacy and Data Protection
27. The Promoter may use any personal information submitted on the Nomination form or in the Content to advise Nominators of future promotions and to provide information about products of the Promoter or its associated companies that may be of interest. The Nominator hereby consents to such personal information being used for this purpose and confirms that it agrees with the Promoter's privacy policy available at http://www.samsung.com/au/info/privacy.html. The Nominator may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter's privacy policy.
28. Subject to the Nominator providing consent during the application process or afterwards, the Promoter, any of its affiliates and LOCOG may use the personal data contained in the "story" / "explanation of why the Nominee should be chosen to receive the Prize" and the Nominator's name and town of residence, together with any images of the Nominator, for promotional purposes, including without limitation to publish such personal data online and in promotional materials.
29. The Nominator consents to the Promoter supplying the Nominator's personal details to LOCOG, which may contact the Nominator for organisational purposes.
30. Other than as set out in these Terms and Conditions or for the purposes of operating the Promotion, the details and information provided by the Nominator when entering the Promotion will not be used for any promotional purpose, nor shall they be passed to any third party.
Special terms for a Nominator that has nominated a Successful Nominee
31. If the Nominator nominates a Successful Nominee, the Nominator agrees:
a. to take part in media interviews including but not limited to magazine, television and radio interviews;
b. to be photographed by the Promoter for the purposes of promoting the Nomination Process and the Promoter's products;
c. to participate in the Promoter's other marketing and promotional activities;
d. assigns to the Promoter free of charge, and waives all moral rights in, all intellectual property (including without limitation the copyright) owned by the Nominator in the Nomination, the Content, and any other information, data, or document(s) provided by the Nominator to the Promoter in the course of the Nomination Process, or that is otherwise provided to the Promoter. The Nominator agrees to take any further action (including, without limitation, the execution of documents) reasonably requested by the Promoter to give effect to, perfect or confirm the Promoter's ownership of such intellectual property; and
e. to be filmed, televised, photographed and/or otherwise recorded in connection with the Prize, and agrees that the Promoter, its affiliates, LOCOG and the International Olympic Committee (“IOC”) shall be permitted to use such films, photographs and recordings and the Nominator's image and likeness for any purpose, including to promote the Promoter's brand, products and services.
General
32. The Promoter shall not be liable for any interruption to any Nomination Process whether due to force majeure or other factors beyond the Promoter's control.
33. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary these Terms and Conditions.
34. Subject to clause 36, the Promoter (including its officers, employees and agents) excludes all liability, including negligence, for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any failure to receive Nominations due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions of Nominations (whether or not after their receipt by the Promoter), due to any reason beyond the reasonable control or the Promoter; (c) any computer or communications related malfunctions or failures (whether or not under the Promoter's control); (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; (e) any printing or typographical errors in any materials associated with any Nomination Process; (f) any variation to the Prize, including any cancellation of the Prize caused by events beyond the control of the Promoter (g) any costs incurred by the Nominees or Nominators in entering the Nomination Process or (f) any personal injury, loss or damage arising from the use of the Prize.
35. Subject to clause 36, the Nominator agrees to release the Promoter from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with any Nomination Process, use of the Prize or attendance at participation in any Torchbearer Slot.
36. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights of the Nominator or Nominee under the Competition and Consumer Act 2010 (Cth) ("CCA") or any other legislation which may not be excluded, restricted or modified by agreement. If the CCA or any other legislation implies a condition, warranty or term into the Terms and Conditions or provides statutory guarantees in connection with these Terms and Conditions, in respect of goods and services supplied (if any), the Promoter's liability for breach of such a condition, warranty, other term or guarantee is limited to (at the Promoter's election) to the extent it is able to do so: (1) in the case of supply of goods, the Promoter doing any one or more of the following: (a) replacing the goods or supplying equivalent goods (b) repairing the goods (c) paying the cost of replacing the goods or of acquiring equivalent goods; and/or (d) paying the cost of having the goods repaired; or (2) in the case of supply of services, the Promoter doing either or both of the following; (a) supply the services again; and/or (b) paying the cost of having the services supplied again.
