To enter and automatically receive one (1) entry into the prize draw, individuals must visit
www.Traveldealer.com.au, follow the prompts to the competition entry page, complete the registration form, agreeing to receive marketing communications from Travel Dealer Pty Ltd, submit the fully completed entry form and confirm their email address, during the Promotional Period (1/09/2011 - 11.59pm AEST on 31/10/2011).
Eligible Entrants that complete the registration form will be deemed Active Subscribers. Eligible Entrants must continue to be Active Subscribers and must not Unsubscribe during the Promotion Period in order remain as an Eligible Entrant. Eligible Entrants agree to receive further marketing communications from Travel Dealer Pty Ltd upon entering. Cookies are required to login to the related User Section, if available.
COMPETITION TERMS AND CONDITIONS
1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over who have an Internet connection capable of accepting cookies or other devices used by the Promoter to track entries, and who have a valid email address.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, automated, indecipherable or illegible registrations/entries will be deemed invalid.
6. Only one registration and entry permitted per person throughout the Promotional Period. An extra entry may be granted where the Eligible Entrant refers a friend who then confirms their registration to Traveldealer.com.au. There are no limits to extra entries through the refer a friend mechanism.
7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
8. Promotion commences 1/09/2011 and entries close 11.59pm AEST on 31/10/2011. The draw will take place at Level 3, 8 Windmill St, Walsh Bay, NSW 2000 on 04/11/2011 at 3pm AEST. Winner will be notified by email and their name published on the Traveldealer.com.au website.
9. At the time and date specified, the judge will choose 1 winner with the most creative and original response to the question. Chance plays no part in determining the winners. The Promoter's decision is final and no correspondence will be entered into.
10. The prize is 7 nights stay at the Outrigger Resort valued at $4,200.
11. Accommodation is valid from 5th November 2011 to 15 December 2011.
12. All requests are subject to room availability and accommodation on specific dates cannot be guaranteed (availability during school public holiday periods will be restricted).
13. Entrants may receive email communications from Travel Dealer Pty Ltd. These messages will always appear to come from Travel Dealer Pty Ltd and are considered to include the following:
1. Promotional Emails
2. Emails sent for research purposes
3. Emails sent as part of a survey
4. Any other email based communications sent from Travel Dealer Pty Ltd.
14. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
15. Prizes are non-transferable, non-refundable and have no cash value.
16. The booking can only be made by the competition winner.
17. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
19. Any cost associated with accessing the promotional websites is the entrant's responsibility and is dependent on the Internet service provider used.
20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of the prize.
21. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
22. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter via the related websites. All entries become the property of the Promoter.
23. Travel Dealer Pty Ltd is not responsible for the terms and conditions of any of the affiliated websites or partner offers on our website. We make an effort to screen our offers to ensure the best possible experience for our users. However, we are not responsible for any ensuing charges or contracts incurred between a user and an offer provider.
