WIN 50 PIZZAS!

Carlton Dry Pizza Delivery Promotion

TERMS AND CONDITIONS

1.Information on how to enter and prize(s) form part of these Terms and Conditions. By entering, entrants accept these Terms and Conditions.

2.The Promoter is Foster’s Australia Limited (ABN: 76 004 056 106) of 77 Southbank Boulevard, Southbank Victoria 3006.

3.Entry is only open to Australian residents who:
(a)are aged 18 or over;
(b)are available to answer their phone at all times between 2pm (AEDT/AEST, as applicable in Melbourne) and 4pm (AEDT/AEST, as applicable in Melbourne) on any Draw Date when contacted by the Promoter; and

(c)are able to take a prize on the dates specified by the Promoter (including, if applicable, being able to make their own way to and from their departure airport in their nearest Australian capital city by the time and date specified by the Promoter).

Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this promotion are ineligible to enter.

4.The competition commences at 4.00pm AEST/AEDT (as applicable, in Melbourne) on 28th September and closes at 1.59pm AEST/AEDT (as applicable, in Melbourne) on 29th September (Competition Period).

5.To enter, entrants must, during the Competition Period, visit www.carltondry100.com.au (Website) (which can also be accessed via the Carlton Dry 100 Facebook page or the Carlton Dry 100 iPhone app) and fully complete the online entry form.

6.Limit of 1 entry per person. All entries must be received during the Competition Period. Entries are deemed to be received at the time of receipt into the Promoter’s database, not at the time of transmission by the entrant.

7.The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple addresses or aliases may be disqualified. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

8.This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

9.This competition is in no way sponsored, endorsed or administered by, or associated with, Apple Inc. Entrants are providing their information to the Promoter and not to Apple Inc. Each entrant completely releases Apple Inc. from any and all liability.

10.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

11.The manual draw will take place at The Sound Alliance of Suite 5, 113 Reservoir Street, Surry Hills NSW 2010 on 29th at 3pm AEST/AEDT, as applicable in Melbourne (Draw Date). The first valid entry randomly drawn from all entries received during the Competition Period will win the prize.

12.The prize is a Pizza delivery worth $726 (inc GST) consisting of: 50 pizza’s delivered on 1st October 2011 and soft drinks worth $60.

13.The winner will be notified by phone between 2pm and 4pm (AEST/AEDT, as applicable in Melbourne) on the Draw Date. In order to be a valid entrant, the winner must answer their phone when contacted by the Promoter during this period, accept the prize and otherwise comply with these Terms and Conditions of entry. If a winner does not answer their phone when called between 2pm and 4pm (AEST/AEDT, as applicable in Melbourne) on the Draw Date, their entry will be deemed not to comply with these Terms and Conditions of entry and will be discarded. In this case, the Promoter will immediately thereafter conduct a further draw and attempt to contact the new winner between 4pm and 6pm (AEST/AEDT, as applicable in Melbourne) on the Draw Date.

14.Once the winner has claimed their prize, they will be required to take the prize within 72 hours of the Draw Date (or within the time as specified by the Promoter). If a winning entry is deemed not to comply with these Terms and Conditions of entry that entry will be discarded. The judges’ decision is final and no correspondence will be entered into.

15.If the prize includes tickets (e.g. to a movie, concert, sports game or event) or a voucher, the tickets/voucher are subject to any terms and conditions imposed by the prize supplier, including periods of validity.

16.If a prize includes subscription to a service, the subscription is subject to any terms and conditions imposed by the subscription supplier. Any costs incurred by the winner in using any additional services that are not covered by the subscription amount (as specified by the Promoter) will be the responsibility of the winner.

17.Where a prize includes travel, participating in an activity or attending an event:
(a)the prize must be taken on the dates as specified by the Promoter and/or prize supplier to coincide with the event date/s;

(b)entrants acknowledge that there are inherent risks in some aspects of the prize and that using the prize may involve participating in dangerous activities. By entering this competition and accepting the prize, entrants accept that risk;

(c)in order to participate in the activity/ies awarded as part of the prize, the winner and their companion/s (if applicable) must be aged 18 or over and comply with applicable height, weight, health, fitness and any other requirements normally associated with a particular activity. It is the winner’s responsibility to ensure that they and their companion/s (if applicable) are sufficiently healthy and fit so as to safely undertake the activities awarded as part of the prize. The Promoter reserves the right to deem that the winner and their companion/s (if applicable) are not sufficiently healthy or fit. The winner must comply with all requirements and directions of the people responsible for the conduct of the relevant activity and must ensure that their companion/s (if applicable) also comply;

(d)where the prize involves participating in an activity to win further prizes by way of skill, the winner (and their companion/s, if applicable) must follow the rules and directions of the Promoter and/or Promoter’s representative at all times;

(e)where a prize involves the winner (and companion/s, if applicable) meeting or attending a function/activity with a celebrity or other public figure, the Promoter will not be liable for the failure of the winner (and their companion/s, if applicable) to meet that person or failure of that person to attend the function/activity, for whatever reason;

(f)if any part of the event/activity is abandoned, called off, varied or postponed for any reason, then at the Promoter’s discretion, the winner (and their companion/s, if applicable) forfeits all rights to attend the relevant event/activity and no cash or alternative tickets will be substituted for that part of the prize;

(g)the winner (and their companion/s, if applicable) must, at the request of the Promoter and/or prize supplier, sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking any specified activity/ies forming part of the competition or prize. If the winner and/or their nominated companion/s (if applicable) do not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the relevant winner’s entry or claim will be deemed invalid. Where a winner’s entry is deemed invalid, the Promoter reserves the right to determine a new winner in accordance with paragraph 11;

(h)the Promoter may in its absolute discretion prohibit an entrant’s participation in this competition, cancel a prize or otherwise cease to provide any benefit of a prize to a winner and their companion/s if the entrant or the winner (or their companion/s), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate (or of the business of the Promoter or any of its related bodies corporate), is contrary to law or is otherwise inappropriate; and

(i)where the prize involves domestic travel, the travel prize cannot be taken during peak periods or Australian public holidays and must be booked and completed as specified by the Promoter and/or the supplier or organiser of the prize. Any accommodation or flights constituting part of the travel prize (if any) are subject to booking and availability. All costs associated with the travel prize which are not specified to be included in the prize, including but not limited to any transfer costs, additional taxes, meals, insurance and other ancillary costs, are the responsibility of the winner and their companion/s, as incurred. If the winner chooses to extend the dates of their travel prize, they do so at their own cost and the Promoter will not be responsible for any such associated costs. It is a condition of accepting the travel prize that all persons taking the prize must depart and return at the same time.

18.If the prize involves participating in an activity in order to claim the prize, the winner must provide evidence, to the Promoter’s satisfaction, that they have successfully completed the activity in order to win the prize.

19.The winner’s name and state/territory of residence will be published on the Website as soon as the winner is drawn and in the case of any Victorian winner, in The Australian on 1st August.

20.The winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning or rejecting of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

21.If the prize (excluding an event based prize for instance, but not limited to, a sporting match or concert) remains unclaimed 3 months after the Draw Date, the Promoter will conduct an unclaimed prize draw at the same time and place as the original draw to award any such unclaimed prize on 31st December. In the event of a winner in such a draw, they will be notified by e-mail and phone within 2 days of the draw and will have their name and state/territory of residence published on the Website within 2 weeks of the draw date. In the case of any Victorian winner, their name and state of residence will be published in The Australian on 15th January.

22.Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the prize.

23.The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.

24.The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

25.If this promotion is interfered with in any way or for any reason is not capable of being conducted as planned including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may, in its sole discretion, modify, suspend, terminate or cancel the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required.

26.The Promoter and its associated agencies and companies will not be responsible for any loss (including without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

27.The prize is not transferable or exchangeable and (except where cash is specified) cannot be redeemed for cash. If for any reason the winner does not take an element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. If the prize or any element of the prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory, if required.

28.The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

29.The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. 30.All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
