1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to residents of Australia. Entrants under 18 years old must have parental/guardian approval to enter. This approval will be captured in the prize claim form for successful participants of the promotion. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. If the winner of the major prize is under 18 years old, the major prize will be awarded to the winner's parent/guardian and the "prize-winner" for the purpose of these terms and conditions shall be deemed to be such parent/legal guardian.
3. Directors, management and employees (and their immediate families) of the Promoter, agencies associated with this promotion, Qantas Airways, Qantas Holidays and each of their related bodies corporate, and registered travel companions of employees of Qantas Airways Limited are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promotion commences on 12.00pm AEST 28/09/2011 and closes at 10:00pm AEDST on 13/10/2011 (Promotional Period). The Promotional Period will contain ten (10) races (Races), with each Race beginning at 12:00pm AEST and ending at 10:00pm AEST/AEDST each day from 04/10/2011 until 13/10/2011 (Race Periods). 5. To be eligible to enter, entrants must, during the Promotional Period:
1. visit the Optus Australia Facebook Page (
www.facebook.com/optus) (Page) and "Like" the Page when promoted;
2. agree to accept the 'Project Twirl Optus Elephant Air Race' application (Application) by clicking "Allow" when prompted;
3. using the tools on the Application, create, name, decorate and save an animated elephant (Elephant) once only; and
4. submit their entry.
6. Once an entry is validly submitted, a message will automatically be posted onto the entrant's Facebook Wall and Newsfeed announcing their Elephant.
7. Each entrant is permitted to create and race only one (1) Elephant. The entrant must use the same Elephant in all Races.
8. Elephants that have been validly saved will automatically be entered into the forthcoming Race. Elephants can be validly saved by clicking "ALL DONE? LET'S PLAY" once the Elephant has been customised in the Application. Entrants can also enter a Race after it has begun, by creating an Elephant and submitting their entry in the manner required during a Race Period. An Elephant participating in a Race cannot be personalised further after it has been validly saved.
9. Once a Race has begun, entrants should, during the Race Period, access the Application and assist their Elephant's progress in the Race. To increase the speed of their Elephant in a Race, entrants must, during the Race Period, complete any of the following:
1. collect votes on their Elephant from other Facebook users
2. enter code words which may feature on the Optus Facebook Wall, on the Optus Twitter page, in any Optus Facebook engagement adverts, on the Hot Hits Radio Station on 09/10/11 between 2pm and 6pm (AEST/AEDST), on the Nova Radio Drive Show during the period of 04/10/11 to 13/10/11 between 4pm and 7pm (AEST/AEDST) and within the Optus Elephant Air Race Facebook game
3. complete online social tasks, such as "checking-in" to a specified place, the directory of these check-in locations is found in the Optus Elephant Air Race Game
4. access any other content via the Application, or complete any other social tasks listed on the Application
Dynamic content will be uploaded on to the Application during the Race Period to instruct entrants on how to "race" their Elephant and boost its speed. Boosts are defined as a user entering code words into the Application, "checking-in" to defined locations and getting friends to vote on their Elephant. Completing the online social tasks will award Elephants points which will increase their Elephant's speed in a Race. The more points an Elephant accrues during a Race Period, the "faster" the Elephant will become in the Race. The Elephant's points will automatically be calculated through the Application during a Race Period. Points can only be accrued during a Race Period.
10. Maximum of five (5) check-ins and five (5) code words permitted per entrant per Race.
11. For each daily Race, each participating Elephant will begin at zero kilometres per hour. The Elephant's kilometres per hour travelled over the set distance for all Races will accrue to arrive at their overall score, which will be used to determine the major prize winner.
12. Any Facebook user can vote for an Elephant by clicking on the vote link displayed on their Newsfeed or by accessing the Application. To vote, Facebook users must during a Race Period:
1. access the Application;
2. agree to accept the Application by clicking "Allow" when prompted; and
3. using the tools on the Application, submit a vote for an Elephant; and
4. will not be required to like the Optus Facebook page to vote
13. An Elephant can receive a maximum of one (1) vote per Facebook user per Race. Entrants are ineligible to vote for their own Elephants.
14. Incomplete, indecipherable or illegible entries or votes will be deemed invalid. If an entrant names their elephant an obscene name, their entry will, in the Promoter's sole discretion, be deemed invalid and removed from the promotion.
15. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter or vote repeatedly is prohibited and will render all votes or entries submitted by that individual invalid.
16. The Promoter reserves the right, at any time, to verify the validity of entries, votes and entrants (including an entrant's identity and place of residence), to disqualify any individual who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry/voting process or Race process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
17. This is a game of skill and chance plays no part in determining any winner. The Promoter's decision is final and no correspondence will be entered into. Each entry will be individually judged based on the 'fastest' Elephant recorded, based on the entrant validly completing online social tasks during a Race Period. Winners will be notified in writing and will be required to accept their prize by completing and submitting the claim form provided by the Promoter (in the manner and timeframe required by the Promoter).
18. The Application will feature a leader board for entrants to view. The leader board will depict the ten (10) leading Elephants in a Race, and the ten (10) overall leading Elephants in the promotion. All scores and Elephants featured on a leader board are subject to verification by the Promoter.
19. The Elephant who wins a Race will, after verification by the Promoter, be judged the winner for that Race, and the entrant will be awarded the prize. The 'fastest' Elephant for each Race will win the entrant one (1) of the following two (2) prizes below (to be determined by the Promoter in its sole discretion):
1. one (1) Pre-Paid Blackberry 9300 handset (RRP $199) with one (1) $30 Optus Recharge card; OR
2. one (1) Pre-Paid Huawei Ideos X1 handset (RRP $79) with one (1) $30 Optus Recharge card.
The Blackberry 9300 and Huawei handset prizes will be locked to the Optus network. Unlocking fees apply.
20. Pre-Paid Blackberry 9300 handset and Pre-Paid Huawei X1 handset daily prizes: Prize is handset only and they are locked to the Optus network. The unlocking fee for the Huawei Ideos X1 handset is $80 and $120 for the Blackberry 9300 handset. Winners will be responsible for making all arrangements for connection with a service provider and payment of all associated connection, access and call charges. Winners will be responsible for the purchase of additional Recharge cards. Prize will be sent to the prize winner within ten (10) working days of notification. Prize is subject to Optus standard terms and conditions.
21. The Elephant judged the 'fastest' overall Elephant at the end of the Promotional Period, will, after verification by the Promoter, be deemed the major winner for the promotion, and the entrant will be awarded the major prize. The major prize is a 'Qantas Holiday Voucher' valued at AU$10,000 (the Voucher).
22. Any ancillary costs associated with redeeming the Qantas Holiday Voucher are not included. Any unused balance of the Qantas Holiday Voucher will not be awarded as cash. Redemption of the Qantas Holiday Voucher is subject to any terms and conditions of the issuer including those specified on the Qantas Holiday Voucher:
1. The Voucher is valid for travel until 30 September 2012. All packages must be booked and started prior to this date. No extensions will be given.
2. Compliance with any health or other government requirements is the responsibility of the prize-winner and, if applicable, their travel companion(s). It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter and Qantas Holidays make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
3. The prize-winner is responsible for arranging their own travel insurance, passports and visas.
4. The prize-winner should contact the Prize-winner Department, Qantas Holidays, to redeem their Voucher by calling 1300 139 747 or emailing
qhprizewinner@qantas.com.au. Booking must only be made with Qantas Holidays not travel agents.
5. The Voucher must be used for Qantas Holidays domestic or international packages or Viva! Holidays international packages for flight and land bookings or land only booking but cannot be used for flight only bookings. The value of the Voucher must be wholly redeemed in one transaction.
6. All bookings and travel are subject to the Qantas Holidays General Booking Conditions, which can be viewed at

7. The Voucher is only valid for travel from Australia.
8. Prize travel is subject to availability at the time of the booking and bookings must be made no later than 4 weeks prior to departure. The prize-winner and, if applicable, their companion(s) will not accrue Qantas Frequent Flyer points or other loyalty program benefit of any nature on the prize travel or accommodation.
9. The Voucher must be taken as stated and no compensation will be payable if the prize-winner is unable to use the Voucher as stated. The Voucher is not exchangeable or redeemable for cash or other goods or services. The Voucher cannot be transferred to any other person. There can be no changes made to travel arrangements once tickets are issued. If the Voucher is not taken with a departure date prior to 30 September 2012, it will be forfeited. Any unused portion will be forfeited.
10. The Promoter and Qantas Holidays and each of their related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this competition, the promotion of this competition or the use of any prize, except for any liability which cannot be excluded by law.
11. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter or Qantas Holidays and which prevents the Promoter or Qantas Holidays from complying with these terms and conditions, the Promoter and Qantas Holidays will not be liable for any failure to perform or delay in performing its obligations.
12. Entry details remain the property of the Promoter. The name and photograph of the prize-winner may be used for promotional purposes by the Promoter and Qantas Holidays, unless the prize-winner otherwise notifies the Promoter at the time of accepting the prize. Entrants and, if applicable, their travel companion(s) consent to the Promoter and Qantas Holidays using personal information provided in connection with this promotion and awarding any prizes. 23. Prizes are subject to the standard terms and conditions of individual prize and service providers.
24. In the event of a tie for first place between two Elephants in one of the daily Races, or overall for the promotion, the Promoter will individually judge each tied Elephant and determine the winning Elephant in its absolute discretion. The tied Elephant which received the highest total number of valid votes at the end of the current Race, will, after verification by the Promoter, be deemed the winner and the entrant will be awarded the relevant prize. In the event of a further tie between tied Elephants, the tied Elephants will be entered into a further judging round. All tied Elephants in a second judging round will be judged based on the Elephant that was created with the most creative name and design, as determined by the Promoter in its sole discretion. The tied Elephant judged as the winner will, after verification by the Promoter, be deemed the winner and the entrant will be awarded the relevant prize.
25. If any prizes (or part of any prizes) are unavailable, the Promoter, in its discretion, reserves the right to substitute the prizes (or that part of the prizes) with prizes to the equal value and/or specification.
26. If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
27. Prizes, or any unused portion of prizes, are not transferable or exchangeable and cannot be taken as cash. If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner's behalf.
28. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, as appropriate.
30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
31. Any cost associated with accessing the promotional Page or Application, or any other online promotional page, is the entrant's responsibility and is dependent on the Internet service provider used.
32. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry, vote or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
34. As a condition of accepting a prize, a winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
35. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
36. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at

Entrants understand that they are providing their information to the Promoter and not to Facebook. 38. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
