CHANNEL TEN – THE CIRCLE PROMOTION
“TODAY’S THE DAY TO WIN $1000! GET HEALTHY WITH BLACKMORES”1. Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of Australia who are aged 18 years or over at the time of entry. Employees and their immediate families of Network TEN, Salmat IDR Pty ltd, Blackmores and their associated agencies and companies are not eligible to enter.
3. The competition commences on Monday, 3rd October 2011 at 00:01 (AEDT) and concludes on Friday 21st October 2011 at 23:59 (AEDT) (“Promotional Period”). Instant win prizes will be available from Monday 00:01 (AEDT) to Friday 23:59 (AEDT).
4. The competition will be advertised on / at Network TEN and
www.ten.com.au5. Participants are required to purchase one (1) Blackmores Product (“Product”) at participating retailers. Every product purchased will entitle the participant to one entry into the promotion.
6. Entrants must retain a copy of their original purchase receipt(s) for all entries as proof of purchase. Purchases must be made during the Promotional Period and the date of purchase should be prior to the participant’s entry registration. The Promoter reserves the right to request a proof of purchase for each entry made to verify all entries before awarding the prize. Failure to provide proof of all purchases, in the absolute discretion of the Promoter, will result in the invalidation of all of an entrant’s entries and forfeiture of any right to a prize and a re-draw will occur at the discretion of the Promoter on any chosen date.
7. Participants may enter the promotion by logging onto ten.com.au/blackmores and completing the online entry form with the requested details including (but not limited to) full name, full address, phone number, email address the last 5 digits of their product barcodes. Entrants are required to be a TEN member to enter online. Entrants may register to become a member via the website. It is free to become a member. These Terms and Conditions apply in conjunction with the website Membership rules.
8. Inaudible, illegible, incomprehensible and incomplete entries will be deemed invalid.
9. The total prize pool contains 15 x instant win prizes (“Instant Win Prizes”). Full prize details are outlined in Clause 10.
10. Instant Win Prizes: There are 15 x instant win prizes of $1000 to be paid each winner in the form of an EFTPOS debit card. Total Instant Win Prize value is $15,000 (including GST)
11. Total prize pool is valued at up to $15,000 (including GST)
12. Instant Win Prizes will be available to random valid entrants Monday to Friday each week, (Instant Win prizes will not be awarded on Saturdays and Sundays). All participants will be notified by email.
13. Instant Win Prize winners will be issued a 6 digit unique prize claim number as determined by the Salmat IDR Instant Win system (“Prize Claim Number”). The Prize Claim Number will need to be recorded by the participant for prize verification purposes. In the event of any dispute with the Promoter, or at the Prompter’s request, Instant Win Prize Winners will be required
to correctly quote their Prize Claim Number to be awarded their prize. The Promoter reserves the right to withhold the awarding of an Instant Win Prize to a participant who cannot provide a valid Prize Claim Number. Any unclaimed or un-verified Instant Win Prizes will be awarded during the unwon prize draw. Entrants who are not Instant Win Prize winners will be notified that they have been automatically entered into the unclaimed prize draw.
14. If a prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
15. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
16. By accepting a prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
17. Entrants may enter the promotion once a day and entry must have a unique proof of purchase. Only one Instant Win Prize per household will be awarded (SA residents are entitled to win more than one prize). In the event that an entrant wins more than one Instant Win Prize, the first Instant Win Prize won will be awarded and the remaining prizes will be drawn.
18. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
19. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
20. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
21. Entries must be received by 23:59 (AEDT) on Friday 21st October 2011. The time of entry will be the time the online entry is received by the Salmat IDR database or the Promoter’s. The Promoter accepts no responsibility for any late, lost or misdirected entries.
22. Any entry that is made on behalf of an Entrant by a third party will be invalid.
23. To be eligible to enter online, participants will be required to be a registered member of the Network TEN website. Fraudulent memberships/entries will be deemed invalid. Viewers may
register to become a member of TEN via the website. It is free to become a member.
24. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Network TEN or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
25. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
26. Prize values are in Australian Dollars.
27. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
28. Programming and other quality control errors will not invalidate an otherwise valid prize claim.
29. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.
30. Prizes will be awarded to person named in the entry however, in the event of a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).
31. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
32. At the conclusion of the competition all entrants excluding Instant Winning entries will be entered into a draw to win any un-won instant prizes. The draw will take place at Salmat IDR Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 on Monday 24 October 2011 at 11:00 (AEDT)
33. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
34. Programming and other quality control errors will not invalidate an otherwise valid prize claim.
35. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.
36. Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.
37. The Instant Win Prize winners will be notified within 2 business days of the unwon prize draw date. All winners will be notified of their prize in writing. Winners of prizes valued over $250 will be published in the Public Notices section of The Australian newspaper on Monday 31 October 2011.
38. If any of the instant win prizes remain unclaimed then subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat IDR Pty Ltd on Monday 30 January 2012 at 11:00 (AEDT). The winner will be notified of their prize in writing
and the winner of prizes valued over $250 will have their details published in the Australian on Monday 6 February 2012.
39. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the promotion result.
40. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements and they may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
41. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
42. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
43. The Promoter, Salmat IDR and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
44. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
45. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
46. Salmat IDR Pty ltd, on behalf of Network TEN, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat IDR Pty ltd for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
47. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
