TERMS AND CONDITIONS
SPOTLIGHT’S “WIN A SONY ENTERTAINMENT PACK” COMPETITION The competition is open to all current Australian residents who have been issued with a Spotlight VIP Club card and those Australian residents who register as VIP Club members after the commencement of the competition (Member). An Australian resident may become a Member by registering in a store, by phone 1300 305 405 or online at
www.spotlight.com.au at no charge. Members are provided with a VIP Club card and membership number.
The competition commences at 9.00am AEST on Wednesday 5th October 2011
and closes at 5.00pm Western Australian time on Sunday 13th November 2011 (the “Promotion Period”). During the Promotion Period, upon a purchase in any Spotlight store located in Australia or via the Spotlight Shop at Home Service, and presentation of the Member’s VIP Club card/membership number, the value of every purchase of Ben 10 branded products made by a Member will be recorded. Based on the accumulated total spent by the Member during the Promotion Period (nett of refunds/returns), each Member will receive one entry into the competition for every AUD$25.00 spent on Ben 10 branded products.
Entries and purchases will be recorded via the Point of Sale (P.O.S) system.
All entries will become the property of the Promoter and no information as to the quantity of entries will be provided to any Member. Entry details may be used for future promotional, marketing and publicity purposes unless otherwise advised by the entrant.
The Promoter, its associated agencies and companies, and employees of the Promoter and its associated agencies and companies and the immediate families of such employees are ineligible to win the prize.
The electronic prize draw will take place at Anisimoff Legal at Level 4, 448 St Kilda Rd Melbourne, Victoria 3004 Australia at 1.00pm AEST on Friday 18th November 2011. The drawn result is final and no correspondence will be entered into.
The winner will be notified where possible by telephone on the day of the draw, and in writing as far as practicable within two business days and no more than five business days after the date of the draw. The name of the winner will be published in “The Australian” newspaper on Friday 25th November 2011 and on the internet at
www.spotlight.com.au.
The winner consents to their name, town/suburb of residence and a photo being published by the Promoter including, but not limited to, being published on its internet site and Facebook page, as a condition of acceptance of the prize. Further information will be published only with the permission of the winner.
If the prize is not claimed within 3 months of the draw date, an unclaimed prize draw will be conducted at the Promoter’s head office at Anisimoff Legal at Level 4, 448 St Kilda Rd Melbourne, Victoria 3004 Australia at 1.00pm AEST on Monday 20th February 2012 in accordance with any State or Territory Regulations. The drawn result is final and no correspondence will be entered into. The winner will be notified where possible by telephone on the day of the unclaimed prize draw, and in writing as far as practicable within two business days and no more than five business days after the date of the unclaimed prize draw. The name of the winner will be published in “The Australian” newspaper on Monday 27th February 2012 and on the internet at
www.spotlight.com.au.
The first eligible entry drawn will win a Sony Entertainment Pack valued at $3,898. The pack will consist of a 46” LCD 3D TV and 5.1ch Blu-ray Disc™ Home Theatre System.
The next 10 eligible entries drawn will win a Ben 10 Prize Pack valued at $300 each.
The prize cannot be exchanged for cash or any other prize.
If for any reason this competition is not capable of running as planned, subject to the approval of those authorities which have issued permits for the conduct of this competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, including to disqualify any individual who tampers with the entry process.
The Promoter assumes no responsibility for any error, omission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries. The Promoter is not responsible for any problems or technical malfunction of any equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation or downloading any materials in this competition.
The Promoter will take all necessary steps to ensure that entries are properly recorded and stored, but will accept no liability if an entry is not recorded or is lost. If a VIP card/number is not produced at the time of purchase, then that purchase will not be credited against the Member’s accumulated total for the purposes of entering the competition. If the P.O.S System fails or if the VIP number is recorded incorrectly, every effort will be made to record the data not captured at the time of the purchase, where practical.
The Promoter will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or personal injury suffered or sustained arising from or in connection with the competition, any omission to enter a person into the draw, acceptance of the prize or the prize itself, except for liability which cannot be excluded by law.

Spotlight Pty Ltd (Spotlight) respects the privacy of individuals by treating all personal information as confidential and by handling it in accordance with the Privacy Act 1988 and the National Privacy Principles.
During the course of its activities, Spotlight will collect, use and disclose personal information from:
Customers who visit Spotlight Stores;
Members of the Spotlight VIP Club;
Customers of the Shop-At-Home Service;
Visitors to and users of our website, including the Spotlight Inspiration Room section of our website;
Members of The Kids Club;
Customers who enter trade promotions conducted by Spotlight; and
Customers who register gift card details
Use and disclosure of information collected by Spotlight:
The information collected may include:
Details you provide us with when you visit our stores or enter our trade promotions;
Your name, postal address, telephone number and email address from members of the VIP Club, trade promotion entrants and gift card registrants;
Your name, mailing address, phone number and credit card information from Customers of the Shop-At-Home Service;
Details of website usage from visitors to our website; and
Details you provide us with for Kids Club membership/s.
Spotlight collects this information in the following ways:
when you submit your VIP Club registration form;
when you place an order via the Shop-At-Home Service;
when you submit The Kids Club application form;
when you provide us with information at one of our stores;
when you enter a trade promotion;
when you register a gift card;
and on an on-going basis, whenever you visit or use Spotlight's website, including the Inspiration Room section.
Spotlight shares the information collected from Customers, VIP Club members and visitors to the website within the Spotlight Group.
For the purposes of this Privacy Policy, the Spotlight Group includes Spotlight Pty Ltd and Anaconda Group Pty Ltd.
Companies within the Spotlight Group comply with this Privacy Policy. Spotlight may also pass on certain information such as your name and address to companies that perform services on our behalf, such as delivery companies or to data entry service providers or to trade promotion or gift card administration &/or account management providers, but Spotlight will not authorise those companies to use your personal information for any other purpose other than the primary purpose of providing the required services.
Spotlight may use your information to process your transaction; administer your account; conduct credit and other checks; for Spotlight's own internal purposes (such as risk management, staff training and billing); to help Spotlight develop its website to be more specific to Customers' needs and user friendly; to advise you about upcoming sales, specials, events, trade promotions and VIP Club information; to manage your gift card balance; and for any other use which you authorise.
In addition, Spotlight may also use your information to promote and market its products and services, or the products and services of others. However, Spotlight will not do this by email or SMS (except as part of an email which facilitates, completes or confirms a transaction with you) unless we have your consent to do so.
