The Promoter is BP Australia Ltd (ABN 53 004 085 616) of 717 Bourke St, Docklands VIC 3008 (Promoter).
The outlets participating in the Promotion are listed at

PROMOTION PERIOD
The Promotion will be open from 00:01 (AEDT) on 06/10/2011 until the earlier of:
(a)23:59AEDT on 02/11/2011;
and
(b)the time and date all Promotion Cards (as defined in paragraph 6 of these Terms) have been distributed by the Participating Outlet(s) (Promotion Period).
Entry in the Promotion is only open to Australian residents aged 18 years and over, excluding:
(a)management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of prizes);
(b)a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph (a) of these Terms;
(c)persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;
(d)persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
(e)persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
(Eligible Entrants). The persons referred to in paragraph (b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
HOW TO ENTER
To enter and be eligible to win, Eligible Entrants must, during the Promotion Period :
(a)Purchase any two of the following eligible ‘Coca-Cola’ products (Eligible Products) from a Participating Outlet:

(b)Collect a Promotion Entry Card and receive the entry details required; and
(c)Complete their entry in accordance with these Terms (Eligible Entry).
Eligible Entrants can complete their Eligible Entry during the Promotion Period by sending an SMS to 1995 5225, containing:
i.Their 6 character unique code from their promotion entry card (Valid unique code);
ii.their first name;
iii.their last name; and
iv.postcode;

and which complies with paragraph 8 of these Terms (SMS Entry).
For an SMS Entry to be valid:
i.it must be sent from an SMS enabled mobile handset (SMS entries sent via the internet are ineligible) that is connected to a service provider and service plan (if applicable) that permits the Eligible Entrant to send SMS to premium SMS numbers (some handsets are incompatible and some service providers and / or some service plans do not permit premium SMS);
ii.it must be identifiable by a MSISDN (unique mobile SIM number);
iii.the Eligible Entrant submitting the SMS Entry must have the bill payer's permission to enter the Promotion prior to submitting their SMS Entry; and
iv.it must be in the following format (Required Format):

If an Eligible Entrant submits a valid SMS Entry which complies with the Required Format and contains a valid unique code, they will receive an SMS response confirming that their SMS Entry is valid and has been received (SMS Response).
If an Eligible Entrant submits an SMS Entry which does not comply with the Required Format and / or does not contain a valid unique code and / or otherwise does not comply with these Terms, they will receive an SMS response informing them of the error in their SMS Entry (Error SMS Response).
SMS Response and / or Error SMS Response (as applicable) receipt times may vary and are subject to network coverage and availability, the number of entries received by the Promoter, the available memory on the entrant's mobile SIM card and other technical factors.
If the Eligible Entrant receives an Error SMS and chooses to submit a new SMS Entry in the Required Format and containing a valid unique code which has not previously been successfully submitted, and otherwise complies with these Terms, they will be charged an additional 55 cents (including GST).
Eligible Entrants can complete their Eligible Entry during the Promotion Period by:
(a)visiting

(b)fully completing and submitting the online Promotion entry on the Online Entry Site (Online Entry Form), including:
i.all details required on the Online Entry Form, including their unique code, their First Name + Surname + Street Address + Suburb + State + Postcode + Mobile Phone + email + DOB;
ii.your CCA Clubhouse or BP Member bonus code (Bonus Code) (if applicable);
iii.indicating their acceptance of these Terms, (Web Entry).
If an Eligible Entrant submits a Web Entry:
i.which complies with these Terms, they will receive an on-screen notification confirming that their Web Entry is valid and has been received; or
ii.which does not comply with these Terms, they will receive an on-screen notification that their Web Entry is invalid,
whichever is applicable in the circumstances.
There is a limit to the number of invalid unique codes that may be submitted by entrants in attempting to enter the Promotion. The Promoter may, at its absolute discretion, block and / or disqualify Entrants from submitting further entries into the Promotion where they have reached that limit. Entrants will be sent an SMS or web mail (email) message confirming that they have been blocked and / or disqualified from submitting further entries into the Promotion if they are blocked and / or disqualified.
The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that any entry mechanism will be available at all times.
Entrants acknowledge that SMS is not a guaranteed delivery communication tool.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means invalid.
Incomplete, illegible or incorrect entries, or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
SMS entries which are not in the Required Form or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
VERIFICATION
Entrants must retain their Promotion Entry Card and a photocopy of their purchase receipt from the Eligible Products they purchased as part of their Qualifying Purchase (Proof of Purchase) which corresponds to all entries they submit in the Promotion in order to claim the Prize (if won).
If requested by the Promoter, Eligible Entrants must produce, within the time requested by the Promoter at its absolute discretion:
(a)appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a prize (if drawn) and compliance with these Conditions of Entry; and
(b)their Proof of Purchase that corresponds to all entries they have submitted in the Promotion.
If the items required by the Promoter are not received or an entrant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the entry(s) submitted by the entrant will be deemed as invalid.
Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction
All costs associated or arising in connection with the prizes are the responsibility of the respective prize winner.
Entrants can only enter the Promotion in their own name.
DRAW AND PRIZE INFORMATION
All random electronic prize draws will be conducted at Prime Focus 403/62 Beach St Port Melbourne VIC 3207 (Draw Location).
There will be one (1) Instant Prize drawn hourly throughout the Promotion Period (Instant Prize Draws). One time per hour will be randomly selected throughout the Promotion Period. The first valid entry received on or after each time will win an Instant Prize. If an entry is not received on or after the final Instant Prize Draw(s) prizes allocated to this winning time(s) will form part of the Re-Draw.
The following will be awarded as Instant Prizes – an BP Gift Card valued at $100 (RRP) (including GST) (Prize). There is a total of 672 Prizes to be awarded throughout the Promotion.

NOTIFICATION OF WINNERS
The Instant Prize Draw winners will be notified by phone and in writing.
UNCLAIMED PRIZE DRAW
If a Prize is won by:
(a)an Eligible Entrant who is not a resident of Western Australia and they do not claim their Prize by 28/02/2012, a random electronic re-draw will be conducted at 12 noon on that date at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, subject to any directions from State and Territory Gaming Departments; or
(b)an Eligible Entrant who is a resident of Western Australia and their Prize remains unclaimed, the Promoter will retain their until 28/11/2012, before seeking directions from the Department of Gaming, Racing and Liquor, Western Australia (Re-Draw).
NOTIFICATIONS OF RE-DRAW WINNERS
The Re-Draw winners, if any, will be notified by phone and in writing.
Prizes will be delivered to the residential address as advised by the respective winners.
Acceptance and use of the prizes is subject to terms and conditions imposed by those involved in providing good and / or services as part of or in connection with the Prizes.
If more than one person attempts to claim a Prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning entrant(s). GENERAL
Each Qualifying Purchase counts towards one (1) entry only.
Eligible Entrants may enter the Promotion as many times as they wish subject to a maximum of 3 Eligible Entry(s) on any given day throughout the Promotion Period :
(a)per mobile phone number in the case of SMS Entries ; or
(b)per household in the case of Web Entries.
Eligible Entrants who are not residents of South Australia may win a maximum of 1 prize in the Promotion only.
Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied.
The Promoter shall not be liable for the prizes being lost, stolen, damaged or tampered with in any way before they reach the winners or after it has been released to the winners.
The Promoter accepts no responsibility for any variation in the value of the prizes.
If the Promoter is unable to provide a winner(s) with a nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to any directions given by State and / or Territory Gaming Departments.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available, or the Participating Outlets will be open, at all times during the Promotion Period.
If, for any reason, the Promotion is not capable of being run as planned, including due to infection by infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to States and Territories regulations, including cancelling, terminating, modifying or suspending the Promotion.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or Draw in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.
The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
The:
(a)Promoter, the Promoter's related entities, the Participating Outlets and all agencies associated with the Promotion; and
(b)the employees, agents, directors and contractors, of all entities referred to in paragraph (a), shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the Prizes, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a prize.
PERSONAL INFORMATION
The Promoter collects (and the Participating Outlets collects on the Promoter's behalf) personal information about entrants to include entrants in the Promotion and where appropriate award the Prizes. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each entrant consents to the Participating Outlets disclosing their personal information to the Promoter and the Promoter and the Participating Outlets using, and disclosing their personal information to the Promoter's related entities, the Promoter's or the Participating Outlets agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of Prizes) for use for, the following purposes:
(a)contacting the entrant in relation to the Promotion;
(b)improving the Promoter's, the Promoter's related entities' or Participating Outlets goods and services;
(c)in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy policy (available by writing to the Promoter at the address set out in paragraph 2 of these Terms).
The entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Entrants can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter at the address set out in paragraph 2 of these Terms. Entrants can also gain access to, update or correct any personal information held by the Participating Outlets by contacting the Participating Outlets. All personal information will be stored at the office of the Promoter and / or the Participating Outlets as the case may be.
By entering the Promotion, entrants agree and acknowledge:
(a)that the Promoter (or an agent of the Promoter) and / or, with the Promoter's consent (including consent subject to any conditions), the Participating Outlets and / or agent of the Participating Outlets, may:
i.obtain comments from them about the Promotion and take photos or recordings of them (and contacting them for those purposes);
ii.use any of the comments, photos or recordings obtained from them, their name, and - or likeness (the Materials) for the Promoter's and / or, with the Promoter's consent (including consent subject to any conditions), the Participating Outlets' future promotional and marketing purposes without further reference or compensation to them;
iii.may duplicate, alter, adapt and utilise the Materials in any manner at any time, anywhere, and by any means (including communicating them to the public in any media); and
iv.may license, authorise or otherwise transfer the rights in the Materials to others to do the things outlined in paragraph (a)(iii) of these Terms;
(b)on creation of the Materials, they:
i.grant to the Promoter a royalty free, perpetual, non-exclusive and irrevocable licence to use the Materials for whatever purpose the Promoter determines; and
ii.where the Promoter consents, they grant to the Participating Outlets a royalty free, perpetual, non-exclusive and irrevocable licence to use the Materials for whatever purpose the Promoter consents to;
(c)they unconditionally and irrevocably:
i.consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights); and
ii.waive all Moral Rights in the Materials that arise outside Australia; and
(d)they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
