Terms and conditions for participating in ABC Local Radio's Endeavour competition.
This document sets out the terms of participation in ABC Local Radio WA's "Endeavour Competition" (the "Competition").
1. The promoter of this competition is the Australian Broadcasting Corporation (ABN 524 292 78345), 700 Harris Street, Ultimo, New South Wales, Australia.
2. By entering the competition, you agree to be bound by these Terms and Conditions. Any instructions relating to the competition on the promoter's website form part of these Terms and Conditions.
3. The promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.
4. Entry into the competition is free.
ELIGIBILITY
5. Entry to the competition is open residents of Western Australia.
6. An entrant's residential postcode will determine whether the entrant resides in Western Australia for the purpose of this competition.
7. An entrant must be an individual and not a company or organisation. Employees of the promoter and any person associated with the competition, or with the provision of the prize(s), are not eligible to enter.
8. Entrants must be 18 years or over.
COMPETITION PERIOD
9. The competition opens at 12:00am AWST on Monday 10 October 2011 and closes at 5:00pm AWST on Monday 17 October 2011.
10. Any entry received after the expiry of the competition period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
HOW TO ENTER
11. To enter the competition, you must:
a. Listen to ABC Local Radio WA between Monday 10 October and Saturday 16 October and identify three (3) of the five (5) explorers that will be referred to in the broadcasted promotional vignettes. These explorers will also be featured online at ABC websites across Western Australia during the same time period.
b. Submit your entry including the three (3) identified explorers and your name, email address and telephone number via the entry form on the website at
www.abc.net.au/perth.
12. You must not enter the competition more than once.
PRIZES
13. All entries in the competition go into a random draw. The draw will be held at ABC Perth, 30 Fielder Street East Perth on Tuesday 18 October 2011 at 9:00am AWST. The promoter will randomly select one (1) winner from the draw. The first entry drawn at random that correctly identifies three (3) explorers will be deemed the prize winner.
14. The prize winner will receive:
a. the opportunity for the prize winner and one (1) person (who is 18 years of age or older), nominated by the prize winner, to be crew members on the HMB Endeavour replica during its voyage from Bunbury to Fremantle scheduled for 6-11 November 2011, subject to approval of the Australian National Maritime Museum.
b. return economy airfares for two (2) people from the prize winner's place of residence (nearest airport) to Bunbury, returning from Perth.
15. The prize is valued at approximately $10,000 (dependent on the residential location of the prize winner).
16. The promoter accepts no responsibility for any variation in the prize value.
17. You acknowledge that winning the prize does not guarantee you or the person nominated to accompany you, positions in the crew of the Endeavour vessel. Placement on the vessel is conditional on application to the Australian National Maritime Museum being completed and approved by the Museum. The promoter is not involved in the assessment of applications by the Museum. In the event that the prize winner's application is not approved, the promoter will not be responsible.
18. If the prize winner's application to crew the vessel is unsuccessful he/she may transfer the prize to another person of 18 years of age or older, who will also be required to apply to the Australian National Maritime Museum for a place on the Endeavour.
19. If the prize winner resides in Bunbury, he/she will not be eligible to receive any applicable airfares, but will be eligible for an airfare from Perth returning to Bunbury at the conclusion of the voyage.
20. The prize winner must comply with any third party terms and conditions relevant to the prize and any terms and conditions imposed by the Australian Maritime Museum in respect of the prize.
21. The promoter shall not be responsible for any additional costs associated with use of the prize, including the cost of any products or services (such as clothing or medicine) required by the Australian National Maritime Museum for people to take part in the Endeavour voyage. The prize winner is responsible for all costs associated with using the prize including (if applicable) travel and/or transfer costs, expenses with respect to food and beverages, travel and medical insurance costs and spending money.
22. The prize winner must be available to redeem the prize on the dates stipulated by the promoter. If the prize winner is not able to redeem the prize on that date, the promoter may determine another prize winner in its discretion.
23. No component of the prize can be redeemed for cash.
24. In the event that any of the prizes become unavailable due to circumstances beyond the promoter's control, the promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
WINNER NOTIFICATION
25. The prize draw will occur within 30 days of the competition closing date. The prize winner will be notified within 2 days of the prize draw by mail, telephone or email, announced on ABC Local Radio and published on the promoter's website. Please allow at 28 days from the date of notification for the delivery of the prize.
26. In the event that the prize winner is unable to be contacted by 5:00pm on Thursday 20 October 2011, the Promoter will redraw another winner for the unclaimed prize. The re-draw will take place on Friday 21 October 2011 at ABC Perth, 30 Fielder Street East Perth. Re-draw prize winners will be notified as set out in above.
GENERAL
27. You warrant that all details provided with your entry are true and accurate and you will indemnify the promoter against any loss or damage resulting from any breach of this warranty.
28. You agree that the promoter may use your personal details provided to the promoter for the purpose of conducting the competition. The promoter may disclose your personal information to its contractors, agents, any co-promoter and to State and Territory gaming departments, to assist in conducting this competition. The prize winner's name may be published as set out in these Terms and Conditions. The promoter may also use your personal information for any promotional, marketing and publicity purposes of the promoter, subject to the ABC's Privacy Policy available at
http://www.abc.net.au/privacy.htm.
29. If there is any event that prevents or hinders the promoter's conduct of the competition or the promoter's ability to deliver the prize to the prize winner, the promoter may, in its discretion, cancel the competition and recommence it at another time under the same conditions or select another winner.
30. The promoter is not responsible for any incorrect or inaccurate information, or for any failure of the equipment or programming associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of this competition. The promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
31. Given the nature of the prize there are inherent risks involved. Travelling and crewing on the Endeavour could result in injury, illness (e.g. sea-sickness), damage to personal property (e.g. clothing) or even death. The prize-winner will be undertaking physical work and there is the possibility of hazardous sailing conditions. You acknowledge these risks.
32. To the full extent permitted by the law, the promoter will not be liable for any death, injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit and the prize winner's failure to comply with the terms and conditions (if any) specified by any third party.
