Terms & Conditions

1 Information regarding prizes and how to enter forms part of these conditions. Byentering, entrants accept these conditions.

2 Entry is open only to Australian residents aged 18 or over except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, of participating outlets or of the agencies or companies associated with this competition.

3 The competition begins at 12.01am (local time) on 10/10/11 and closes at 11:59pm (local time) on 13/11/11 (Competition Period).

4 During the Competition Period, the minor prize component of this competition will only be conducted at participating Thirsty Camel outlets in New South Wales, Victoria, Australian Capital Territory and Tasmania (Outlets).

5 During the Competition Period, entrants must:
(a) to enter the minor prize draw:
(i) spend $10 or more on any products (Eligible Purchase) in a participating Outlet for off premise consumption, to receive a scratch card (Scratch Card) (subject to Scratch Cards stocks remaining in that Outlet);
(ii) locate the unique 6 character code on the scratch panel of the Scratch Card (Unique Code); and
(iii) visit www.thirstycamel.com.au and fully complete and submit the online form by entering their Unique Code (as stated on the Game Card) their full name, address, email address, mobile telephone number and date of birth, (errors or omissions excepted in the Promoter’s discretion) or (b) to enter the major prize draw, visit www.thirstycamel.com.au or the Thirsty Camel pages on Facebook (Thirsty Camel Victoria, Thirsty Camel Tasmania and Thirsty Camel New South Wales) and fully complete and submit the online form, including by providing their full name, address, email address, mobile telephone number and date of birth, to enter the major prize draw. Consumers are responsible for their own costs associated with accessing the internet.

6 There will be up to 260 minor prize draws conducted at random times and on random days during the Competition Period. For each draw, the first valid entry randomly drawn from all valid minor prize draw entries received (excluding previous winning entries) will win a minor prize (to be selected at the Promoter’s discretion). Minor prize winners will be notified in writing (by email) within 2 days of each of the minor prize draws.

7 The major prize draw will be conducted at 12 midday (AEDT) on 16/11/11 at Prime Focus, 403/62 Beach Street, Port Melbourne 3207. The first valid entry randomly drawn from all valid major prize draw entries received will win the major prize. The major prize winner will be notified by phone and in writing within two days of the draw and their name and state/territory of residence will be published in The Australian on 23/11/11. By entering this competition, each entrant requests that his or her full address not be published.

8 All entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Maximum 1 entry per person for the major prize draw. Entrants may enter the minor prize draw as many times as they wish, provided that each entry is based on a separate Eligible Purchase and Unique Code. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems 6106751/4 page 2 associated with them due to traffic congestion, technical malfunction or otherwise including failure of any event to forward entry forms to the draw location. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses and/or aliases may be disqualified.

9 The minor prizes available to be won are:
(a) 10 x EFTPOS vouchers valued at $50 (inc GST) each;
(b) 50 x EFTPOS vouchers valued at $20 (inc GST) each;
(c) 200 x EFTPOS vouchers valued at $10 (inc GST) each.

10 The major prize is an EFTPOS Voucher, valued at $10,000 (inc GST).

11 The total prize pool is valued at up to $13,500 (inc GST). There are in total up to 175 participating Outlets, the geographical breakdown of the participating Outlets being as follows:
• New South Wales: up to 19 participating Outlets;
• Australian Capital Territory: 1 participating Outlet;
• Victoria: up to 135 participating Outlets; and
• Tasmania: up to 20 participating Outlets.

12 The prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

13 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

14 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.

15 This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

16 The EFTPOS cards can be used for purchases anywhere in Australia where EFTPOS is accepted. The EFTPOS cards are subject to conditions of use as imposed by the prize supplier, including periods of validity.

17 The Promoter and/or Outlet may require winners to provide proof of age, proof of residency and proof of identity. Identification considered suitable for verification is at the Promoter’s/Outlet’s discretion.

18 If a winning entry is deemed not to comply with these conditions of entry the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 6 or 7.

19 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

20 The judges’ decision is final and no correspondence will be entered into.

21 Prizes are not transferable or exchangeable. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason the Promoter may substitute for that prize another item of equal or higher value as determined by the 6106751/4 page 3 Promoter, subject to the approval of the gaming authorities in each state and territory, if required.

22 If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required.

23 There will be a total of 200,000 Scratch Cards printed with approximately 1142 Scratch Cards being distributed to each Outlet.

24 Scratch Cards from any other competition are not valid for this competition.

25 Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim. Every prize claim in excess of the advertised prize pool will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions. Scratch Cards are void if stolen, forged, mutilated or tampered with in any way.

26 If a prize has not been accepted or claimed within 3 months of a draw, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws at 12 midday (AEDT) on 20/02/12 at the same location as the original draw as are necessary to distribute the prize, subject to any requirements of any gaming authority. Any winner(s) in this draw will be notified in writing and if applicable, the major prize winner will have their name(s) and state/territory of residence published in The Australian on 27/02/12. By entering this competition, each entrant requests that his or her full address not be published.

27 The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. A full version of these Guidelines is available at http://www.nhmrc.gov.au/_files_nhmrc/file/publications/synopses/ds10-alcohol.pdf. Entry and continued participation in this competition is subject to the Outlet’s liquor serving policy.

28 The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

29 All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this promotion, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
