TAYLORS WINES - WIN A $30,000 GOURMET TOUR OF FRANCE PROMOTION

TERMS AND CONDITIONS OF ENTRY

   1. Information on how to enter and prizes form part of these Conditions Of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.

   2. Entry is only open to residents of Australia and New Zealand aged 18 years and over. Employees and their immediate families of the Promoter and its agencies (including retailers) associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

   3. Incomplete or indecipherable entries will be deemed invalid.

   4. The Promoter reserves the right at any time to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these terms and conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

   5. Promotion commences at 9am AEST on 16/09/11. Entries close at 11.59pm AEDST on 31/01/12. The draw will take place at 11am AEDST on 01/02/12 at AdMail ASP Pty Ltd 603/815 Pacific Highway, Chatswood, NSW 2067. Winner will be notified by phone and in writing via email within two (2) business days and the winner's name will be published in The Australian and the New Zealand Herald on 07/02/12. Promoters' decision is final and no correspondence will be entered into.

   6. Entrants must retain their purchase receipt/s for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize.

   7. If drawn as the winner, the winner will be requested to forward a copy of the purchase receipt bearing the unique receipt number (verifying that the purchase was made during the promotional period) by mail to "Taylors Gourmet Tour of France Promotion, PO Box 5248, Chatswood, NSW 2067, Australia".

   8. No responsibility accepted for late, lost or misdirected entries.

   9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with the entry requirements; (c) the same unique receipt number cannot be used more than once.

  10. The first valid entry drawn from all entries received will win a ten (10) day trip to France for two (2) people valued at up to AUD$30,000. The prize includes return premium economy airfares to Paris for two (2) people from the winner's nearest Australian capital city or the nearest of Auckland, Wellington or Christchurch airport in the case of a NZ winner, valued at up to AUD$12,700 depending on date and point of departure, a seven (7) day/six (6) night gourmet wine tour through Champagne, Burgundy and the Loire Valley valued at up to AUD$12,300 which includes collection from Paris hotel or airport in a private car, provision of a driver/wine guide fluent in English for each day of the tour, three (3) gourmet dinners, six 6 nights twin-share accommodation and breakfast for two (2) in 4-star hotels, one (1) wine appreciation lunch, escorted visits to and from wine-tasting at various vineyards, transfers from Loire Valley hotel to TGV station and 2 x TGV first class tickets back to Paris. Prize also includes four (4) nights twin share accommodation and breakfast for two (2) in a four-star hotel in Paris, France valued at up to AUD$2,000 plus AUD$3,000 spending money to be used towards gourmet meals at the restaurants of the winner's choice. Taxes (excluding airline and airport taxes), additional spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges, passports, visas, vaccinations, gratuities and all other ancillary costs are not included. Prize must be taken by 31/12/12, is subject to booking and flight availability and must be booked at least sixty (60) days prior to departure date. The accommodation of the prize is twin-share and the winner acknowledges that they will be required to share a room with their travel companion.

  11. The winner (and their companion) must depart from and return to the same departure point and travel together.

  12. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement can not be reached, the Promoter reserves the right to determine the itinerary.

  13. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.

  14. Winner may be required to present credit card at time of accommodation check in.

  15. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.

  16. Prize or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash unless otherwise stipulated.

  17. Total prize pool is valued at up to AUD$30,000.00.

  18. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  19. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.

  20. If the prize remains unclaimed as at 01/05/12, the Promoter will conduct a further draw on that date at the same place and time as the original draw in order to award the prize subject to any written directions from a regulatory authority. In the event of a winner in the unclaimed prize draw, the winner will be notified by phone and in writing via email within two (2) business days and their name will be published in The Australian and the New Zealand Herald on 08/05/12.

  21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  22. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  23. By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity, research, and profiling purposes, including sending electronic messages or telephoning the entrant, without any further reference or payment or other compensation to the entrant. The entrant also consents to the Promoter disclosing their information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. All personal details of the entrants will be stored at the office of the Promoter and/or its agency. As per the relevant Privacy Legislation, a request to access, update or correct any information should be directed to that office.

  24. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

  25. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  27. Except for any liability that cannot be excluded by law including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize/participation in the prize event(s).
