Terms and Conditions
By entering Sunrise Katy Perry – The One That Got Away’ Promotion (“the Promotion”), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia over the age of 18 years where the Channel Seven signal is received.
2.2 Employees and their immediate families of Seven Network (Operations) Limited, EMI Music Australia and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on Monday 24 October 2011 at 06.00 (AEDT) and concludes on Friday 28 October 2011 at 12.00 (AEDT) (“the Competition Period”).
3.2 In order to enter the Competition, viewers must watch Sunrise (“the Program”) on the Seven Network during the Competition Period where there will be a Competition segment aired during the Program (or any replacement program broadcast in the Sunrise timeslot).
3.3 Viewers must log into the Sunrise website (
www.yahoo7.com.au/sunrise) between Monday 24 October 2011 at 06.00 (AEDT) and Friday 28 October 2011 at 12.00 (AEDT) and register their entry details (name, address, telephone number) online to enter.
3.4 Only one entry per person per day will be accepted from entrants online. No scripting is allowed for online entries (which will be deemed invalid).
3.5 The time of entry for online entrants will be the time at which the completed online entry form is received by the Competition online database.
3.6 Entries remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
4. PRIZES
4.1 There will be one (1) winner of the Competition. The prize winner will receive:
Return economy airfares from winners nearest capital city to Las Vegas, USA – value $4,000
4 nights accommodation at Aria Resort in Las Vegas (standard room) – value $720
Return transfers (Airport/Hotel transfers in Las Vegas and Hotel/Concert Venue in Las Vegas) – value $700

Katy Perry ‘meet and greet’ experience for winner and their companion in Las Vegas - $2,000
(All associated taxes, flight and airline charges are included)
TOTAL VALUE PRIZE $7,620
Total Combined Prize Value is: AU$7,620 (including GST). Prize value is correct as of 9 September 2011. The winner is not entitled to receive any money from any party if there is a difference between the maximum prize value and the actual prize value at the time of the draw.
4.2 Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3 The winner and their travelling companion are responsible for all other expenses including flights (if necessary), spending money, vaccinations, in-room charges, taxes, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, gratuities, services charges, items of a personal nature, passports, visas, and all other ancillary costs. Travel insurance is not included in the prize and will be the responsibility of the winner. Travel insurance is highly recommended.
4.4 If the prize winner and their companion are from a regional area, travel arrangements to and from the nearest capital city airport do not form part of the prize and are the responsibility of the winner.
4.5 The winner and their companion must depart Australia by 18 November 2011 to coincide with Katy Perry’s concert in Las Vegas on 19 November 2010.
4.6 Flights and accommodation are subject to availability at the time of booking and embargo periods. The prize is non-transferable and cannot be exchanged for other destinations. There will be no credit given if the full value of prize is not utilised.
4.7 Flights cannot be taken during peak travel periods and travel is on confirmed space but is still subject to seat availability at the time of booking.
The prize winner and their travelling companions must travel on the same flight as each other to their destination and must travel together.
It is the responsibility of the winner to enquire about local issues and conditions at destinations before travel. The Promoter and sponsors make no representation as to the safety, conditions or other issues that may exist at any destination. International advice can be obtained from various sources, including local government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade. Compliance with any health or other government requirements is the responsibility of the prize winner.
4.10 The prize is not transferable and cannot be redeemed for cash or other goods or services and cannot be taken in parts.
4.11 The duration of the meet and greet with Katy Perry will be determined by a representative of program producers and/or EMI Music Australia in their absolute discretion.
4.12 Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.
4.13 The prize cannot be altered in any way and is non refundable and cannot be redeemed for cash.
4.14 A prize cannot be transferred to any other person, unless the winner agreed to by the Promoter and Sponsor.
4.15 If for any reason a winner is not able to take any element of the prize at the time stipulated by the Promoter or Sponsor (with the exception of SA residents), the entire prize will be forfeited.
4.16 The prize cannot be altered in any way, is non refundable, cannot be redeemed for cash and cannot be taken in parts.
4.17 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners grant the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.18 The winners agree that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation.
4.19 If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
4.20 The Winner should seek independent financial advice about any tax implications that may arise from the prize winnings.

HOW TO WIN
5.1 There will be one (1) winner of the Competition. Each entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 (“Qualifying Entrant”) will be entered into the prize draw.
5.2 The draw will take place at MNET Group Ltd, Level 1, 16 Anster Street, Adelaide SA 5000 on Monday 31 October 2011 at 10.30 (AEDT).
5.3 The winners may be announced in the Programs following the prize draw (subject to programming and Executive Producer’s decision). Winner will be notified in writing and by phone call within 2 days of the draw, their name published in the Public Notes section of The Australian Newspaper on Friday 4 November 2011.
If the initial major winner has not been able to be contacted by the Promoter prior to 10.00 (AEDT) Monday 7 November 2011 and has not contacted the Promoter to claim their prize, the initial winner’s prize will be forfeited, and the initial winner will have no further claim. An unclaimed prize draw will take place at MNET Group Ltd, Level 1, 16 Anster Street, Adelaide SA 5000 on Monday 7 November at 10.30 (AEDT) and winners will be published in the Public Notices section of The Australian newspaper on Thursday 10 November 2011.
5.6 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.7 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the promoters in its absolute discretion.
NO LIABILITY
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to State Legislation.

Seven Network (Operations) Limited & affiliates, MNET Group Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
during the draw;
whilst undertaking any travel won on or connected with their entry into the draw; or
in the participation in any prize;
as a consequence of late, lost or misdirected mail;
due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
in relation to failure of an entry to be received by the promoter on account of technical problems or traffic congestion;
arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this Promotion;
if any flight is cancelled or rescheduled for any reason beyond the reasonable control of the Promoter; or
due to circumstances outside the Promoter’s reasonable control.
6.4 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements, subject to State legislation.
6.5 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
6.6 Seven Network (Operations) Limited and the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available subject to State government legislation.
6.7 If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to State legislation.
