BMW AUSTRALIA LTD "The all new 1 series - My One Thing" PROMOTION

HOW TO ENTER:

1.


To enter, eligible entrants must during the promotional period visit the Official BMW Australia Facebook site or the Official BMW Australia YouTube channel, or the Official BMW all new 1 series site (www.bmw.com.au/one) fully complete the online entry form as prompted, including providing an email address and daytime telephone number and describe in 140 characters or less the one thing that made you successful.

All entries must be received within the promotional period of 01/09/11 – 5:00pm AEST on 01/12/11.

 

CONDITIONS OF ENTRY:

1.


Information on how to enter and prizes forms part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.

2.


Entry is open to all residents of Australia who are aged 18 years or older ("Eligible Entrants"). Employees and their immediate families of the Promoter, co-operating companies and their agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3.


The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.


Incomplete, indecipherable or inaudible entries will be deemed invalid.

5.


If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

6.


Promotion commences 01/09/11.  Entries close 5.00pm AEST on 01/12/11.

7.


Limit one entry per Eligible Entrant.

8.


This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on creative merit. Judges' decision and the Promoter’s decision is final and no correspondence will be entered into.

9.


The judging will take place at 12.pm AEST on 02/12/11 at BMW Group Australia, 783 Springvale Road, Mulgrave, Victoria, 3170. The winner will be notified by email and telephone and their details will be published at the Official BMW all new 1 series site (www.bmw.com.au/one) on 05/12/11.  The judges reserve the right to select additional reserve entries, which they determine are the next best entries, after the entry judged to be the best, and record them in that order, in case of a invalid entry or entrant.

10.


The best entry as determined by the judges in their absolute discretion, will win two Advanced I BMW Driver Training course gift certificates valid until 31 December 2012.   The Advanced I BMW Driver Training course is only conducted in Victoria, Western Australia, Queensland and New South, Wales and redemption of the gift certificates is subject to availability of places in the Advanced I BMW Driver Training course.  All costs associated with redeeming the prize, including but not limited to travelling costs to and from the venue, accommodation, spending money and additional meals are the responsibility of the winner.

The prize is valued at $1,500.

12.


To attend the Advanced I BMW Driver Training course additional terms and conditions apply to all participants, including the requirement for all participants to hold valid driver's licence (which upon request can be inspected) entitling the participant to legally drive the particular vehicles used in the Advanced I BMW Driver Training course. If for any reason the winner does not take an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and is not redeemable for cash.

14.


In the event that the prize or any element of the prize is not available, the Promoter reserves the right to substitute prize(s) in its discretion to the same and equal recommended retail value and/or specification.

15.


The Promoter shall have the right to disqualify the winner if they manipulate or attempt to manipulate the running of the promotion and/or the awarding of the prize and/or the content of the prize and/or otherwise breach the rules and conditions of participation. Further grounds for disqualification shall be unallowed or inappropriate acts or utterances, the giving of incorrect data when registering or the attempt unfairly to influence the promotion, especially through the disturbance, threatening or harassment of employees of the Promoter, cooperating companies or other participants. It shall be incumbent exclusively upon the Promoter to decide whether an act is appropriate or not.

16.


The Promoter reserves the right, at any time and without prior announcement, to break off or terminate the promotion or parts thereof. This shall apply in particular if, for whatever reasons, the promotion is unable to proceed according to schedule, for example as a consequence of force majeure, through impairment of the information technology required for the running of the promotion and/or for other technical, organisational and/or legal reasons which affect the administration, safety, integrity and/or normal and proper running of the promotion.

The winner must claim their prize by 10/12/11. The Promoter reserves the right in their absolute discretion to award the prize to another Eligible Entrant in the case that the originally declared winner does not claim their prize by 10/12/11.

18.


Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.  No responsibility is accepted for any variation in the value of the prize.

19.


The Promoter collects Eligible Entrants' personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers.  If the information requested is not provided, the Eligible Entrant may not participate in the promotion.  By entering the promotion, unless otherwise advised by the Eligible Entrant, each Eligible Entrant consents to the information they submit (with their literary piece) being entered into a database and agrees that the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the Eligible Entrant. All personal details of the Eligible Entrants will be stored at the office of the Promoter. A request to access, update or correct any information should be directed to that office. In addition, all literary pieces submitted become the property of the Promoter.  Entries will not be returned to any entrant. It is a condition of entry that each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter and that those literary pieces may be used by the Promoter for its own promotional, marketing and publicity purposes without restriction.  Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party.  The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.  Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

20.


Entrants consent to the Promoter using the entrant's name, likeness, image an/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

21.


Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

23.


All contact details entered incorrectly on the website shall be deemed invalid.

24.


If for any reason this promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

25.


The Promoter is not responsible for any problems or technical malfunction of any telephone network on lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.

26.


If one of the provisions of these conditions is or becomes invalid, this shall not affect the validity of the other provisions. In such a case, the Promoter and the Eligible Entrant or winner (as the case may be) shall be obliged to cooperate in creating provisions that result in an outcome which comes as close as possible to the economic purpose and intent of the invalid provision.
