SECTION 1: PROMOTION
1. Promotion: Burswood’s Christmas, Cars and Cash
2. Promoter: Burswood Nominees Ltd ABN 24 078 250 307, as trustee for The Burswood Property Trust
trading as Burswood Entertainment Complex (ABN 35 491 389 282), Great Eastern Highway Burswood,
Western Australia 6100.
3. Promotion Period: The Promotion will commence at 6am Monday, 21 November 2011 and will close at
6pm Sunday, 18 December 2011. All times recorded throughout these terms and conditions are in
Australian Western Standard Time.
SECTION 2: ELIGIBILITY
4. Eligibility: To be eligible to enter the Promotion, the entrant must:
• be 18 years of age or older.
5. Non-Eligibility: In addition to the criteria for being eligible, persons are not eligible to enter the
Promotion or win any Prize if:
a. they are an employee of the Promoter;
b. they are an immediate family member, being a spouse, partner, sibling, parent or child, of the
following employees of the Promoter:
• All members of the Executive Team;
• All employees within the Club Burswood department;
• All employees within the Corporate Information Team;
• All employees within the Information Technology department;
• All employees within the Marketing department; and
• The Technical Systems Manager within the Entertainment department;
c. they are excluded for any reason from the property of the Promoter;
d. any personal information or contact details are entered incorrectly; or
e. they are a VIP Program Player (anyone not domiciled in Western Australia and / or interstate or
overseas program player).
SECTION 3: ENTRY TO THE PROMOTION
6. Entry: Entry to the Promotion can be earned in the following ways:
If a person joins Club Burswood as a member during the promotion period, they receive one
bonus manual entry form from the Club Burswood host at the time of joining.
If a person joins Club Burswood as a Mailable Club Burswood Member during the promotion
period, the member is entitled to one bonus entry form per day from a VIK from the point of
joining.
Club Burswood members can earn one entry for every 250 Club Burswood points earned per
gaming day, up to a maximum of 20 entries per gaming day.
Active Mailable Club Burswood Members are entitled to two bonus entry forms per day from a
VIK.
Active Club Burswood Members who become Active Mailable Club Burswood Members during
the promotion period are entitled to two bonus entry forms per day from a VIK from the date they
become Active Mailable Club Burswood Members.
All entries earned through a VIK must be printed on the day they are earned.
Manual entries can also be earned in the following ways:
Eligible entrants must place their completed entry form in one of the corresponding Cash Prize Draw
Barrels located next to the promotional stage near Carbon Sports Bar, in the Meridian Room or in
The Pearl Room before a Cash Prize Draw to be eligible for that Cash Prize Draw. All relevant
entries will be placed into one Cash Prize Draw Barrel before the commencement of each Cash
Prize Draw. To be eligible for the Grand Prize Draw, all Cash Prize Draw barrels will be emptied into
the Grand Prize Draw barrel after each Cash Prize Draw is conducted. The Grand Prize Draw barrel
will be emptied after each Grand Prize Draw.

SECTION 4: DRAWS / PROMOTIONAL GAME
7. Prize Draws:
Cash Prize Draws:
At 2pm and 9pm every Monday to Saturday during the promotion period, a representative of the
Promoter will conduct a random barrel based draw of all entries in the Cash Prize Draw Barrel at the
Promotional Stage, Burswood Entertainment Complex to determine one (1) entrant to participate in
the Cash Prize Draw Promotional Game (Prize Winner).
Grand Prize Draws:
At 6pm every Sunday during the promotion period, a representative of the Promoter will conduct a
random barrel based draw of all entries in the Grand Prize Draw Barrel at the Promotional Stage,
Burswood Entertainment Complex to determine three entrants to participate in the Grand Prize Draw
Promotional Game (Prize Winners).
The Prize Winners must claim their Prize/right to participate in the promotional game in accordance
with term 12.
8. Promotional Games:
Cash Prize Draw Promotional Game:
The Prize Winner will be directed by the Promoter to choose a Christmas Cracker from the
Christmas Tree on the Promotional Stage. Each Christmas Cracker will contain a Cash Prize
value amount. At the commencement of the Promotion, there will be 48 Christmas Crackers
representing the following Prizes:
o 5 x $300;
o 6 x $400;
o 6 x $500;
o 8 x $600;
o 7 x $700;
o 5 x $800;
o 5 x $900;
o 4 x $1,000; and
o 2 x $1,500.
Christmas Crackers are not to be replaced once chosen.
The Prize Winner will then have the opportunity to either keep the cash prize or choose one of
three Christmas stockings, each representing a Prize of either ‘$200’, ‘$1,000’ or ‘Double’
(representing double the cash value Prize of their chosen Christmas Cracker). The Prize Winner
does not get to choose which prize they keep, if they decide to choose a stocking, the stocking
will be the final prize.
Grand Prize Draw Promotional Game
Each Prize Winner will choose a Christmas stocking, in order of when they were drawn (first
drawn entrant choosing first etc). One will represent ‘Pick a Gift’ and the remainder will represent
a Prize of ‘One night accommodation at Holiday Inn Perth Burswood’.
The Prize Winner who has chosen ‘Pick a Gift’ will pick out one Christmas present from under
the Christmas tree to reveal their prize. At the commencement of the Promotion, there will be
four presents, comprising of:
o 2 x 2011 Hyundai i30SX Hatch 2.0L, Bluetooth Audio, Automatic, Dealer Deliver, Metallic
Paint, Carpet Mats and Full Tank Petrol; and
o 2 x $5,000 cash.
Presents are not to be replaced once chosen.
Each Prize Winner participating in the promotional game must comply with the directions of the
Promoter, whose decision will be final.
Only the Prize Winner stated on the entry form may participate in the promotional game. A Prize Winner that
has claimed their Prize but who is unable to participate due to health, medical or other reasons as approved
by the Promoter, is permitted to nominate a proxy to participate on their behalf. The nominated proxy will only
be entitled to participate in the promotional game if that proxy has not personally participated previously as a
proxy in the promotion period.
SECTION 5: PRIZE
9. Prize: The Prize(s) for the Cash Prize Draws and the Grand Prize Draws will be the Prize won by each
Prize Winner during the relevant promotional game as described in term 8.
10. Prize Value: The total maximum retail value of the Prize(s) is: $115,205.46.
11. Prize Conditions: The Prize(s) are subject to the following conditions:
a. No exchange of Prize: If for any reason, a Prize Winner cannot take any component of the Prize(s) or
the Prize(s), then the Prize will be forfeited.
b. Ancillary Costs: Subject to any provision to the contrary, and if applicable, all transport, meals,
beverages, spending money, insurances, service charges, taxes, transfers and ancillary costs, including
cost of travel to and from the airport and the property are not included in a Prize unless specified and are
the responsibility of the Prize Winner.
c. Taxes: If a Prize(s) or receipt of it incurs a tax liability, the Prize Winner is liable for payment of such
tax.
d. Prize Availability: Subject to any provision to the contrary, and if applicable, all components of the
Prize(s), including accommodation are subject to availability and any separate and individual terms and
conditions applicable to that Prize, some of which may not be within the control of the Promoter. In the
event that any component of a Prize is unavailable for any reason, subject to State legislation, the
Promoter reserves the right to substitute that Prize component with another prize of equal value and the
Prize Winner will be notified accordingly.
12. Claim of Prize: If the Prize Winner wishes to claim the Prize or his/her right to participate in the
promotional game, the Prize Winner must confirm this fact and his/her eligibility to win under these terms
and conditions by personally notifying a Club Burswood, Meridian Room or The Pearl Room host within
two (2) minutes of the announcement of the relevant draw. If a draw is broadcast live into another venue
within the Complex, the Prize Winner may claim the Prize or his/her right to participate in the promotional
game by notifying one of the Promoter’s hosts within that venue by the deadline. The Prize Winner must
provide personal identification to the satisfaction of the Promoter.
If the Prize Winner fails to claim the Prize or his/her right to participate in the promotional game by the
deadline, the Prize Winner will be deemed to have forfeited the Prize or his/her right to participate in the
promotional game (as applicable) and a redraw by the Promoter will be undertaken in accordance with
term 14.
13. Contact: The Promoter will not contact any winners to notify them of the draw outcome unless stated.
14. Redraw: The Promoter reserves the right to redraw, in accordance with the terms and conditions of the
original draw, in the event of a Prize Winner being unable to satisfy these terms and conditions or
forfeiting their right to the prize or to participate in the promotional game. A redraw is to occur up to a
maximum of ten times (or any other number of times as determined by the Promoter in its sole
discretion). If a Prize Winner has not claimed their right to participate in the promotional game in
accordance with these terms and conditions after ten redraws (or that number of redraws as determined
by the Promoter) the right to participate in the promotional game and to the Prize will be forfeited.
15. Winner Publicity: The Promoter reserves the right and licence to use Prize Winners’ names, suburbs,
photographs, images and likeness for the purpose of promoting and advertising Club Burswood, Meridian
Room, Riviera Room, The Pearl Room and Burswood Entertainment Complex unless a written request
for anonymity is received from the Prize Winners.
SECTION 6: GENERAL CONDITIONS
16. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or
misdirected mail or any other communication.
17. Release: To the fullest extent permissible by law, each entrant in the Promotion including without
limitation the Prize Winner and any other person participating in the Prize(s), releases the Promoter from
any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in
any way incurred by such entrant in connection with the Prize or their participation in the Promotion or
Prize. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable
for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect,
consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion
of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law.
Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or
technical malfunction of any telephone network or lines, computer online systems, servers, or providers,
computer equipment, software, technical problems or traffic congestion on the Internet or any website, or
any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of
entries to the Promoter, injury or damage to participants' or any other person's computer related to or
resulting from participation in or down-loading any materials in this Promotion. The use of any automated
entry software or any other mechanical or electronic means that allows an entrant to automatically enter
repeatedly is prohibited and will render all entries submitted by that entrant invalid. The Promoter’s
responsibility for the provision of prizes is limited to the prizes as described in these terms and
conditions, the Promoter accepts no further liability or commitment beyond those stated and is not liable
for any failure of the Promoter’s agents or contactors to supply the prizes as stated.
18. Force Majeure: Subject to State legislation the Promoter will not be responsible for any act, omission,
failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any
labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the
Promoter.
19. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no
correspondence will be entered into.
20. Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in
relation to entrants. This may include, but is not limited to, the names, email addresses, telephone
numbers and credit card details of the entrants. The entrants' personal information is collected so the
Promoter is able to conduct the Prize Draw and to contact and award the Prize to the Prize Winner, to
publish the results of the Promotion and/or to publicise the Promotion.
21. Consent to use of Personal Information for Marketing Purposes: Furthermore, by entering this
Promotion, unless otherwise advised by the entrant, each entrant consents to the retention and use of
the information collected pursuant to term 20 by the Promoter, which trades as Burswood Entertainment
Complex. Uses may include future promotional, marketing and publicity purposes without any further
reference or payment or other compensation to the entrant.
22. Definitions: If referred to in these terms and conditions, the following terms have the following means:
a. ‘gaming day’ means 6am to 5.59am the following day.
b. ‘active Club Burswood member’ means a Club Burswood member who has earned reward points
using their Club Burswood card in the 12 months prior to Friday, 18 November 2011. Any patron joining
Club Burswood must ensure that, prior to 5.59am on Friday, 18 November 2011, they have earned
reward points using their Club Burswood card to be classified as an ‘active Club Burswood member’.
c. ‘mail’ means SMS, email or postal mail.
d. ‘mailable Club Burswood member’ means a Club Burswood member who has agreed to receive mail
from Burswood. Any Club Burswood member who changes their status to agree to receive mail from
Burswood will be classified as a ‘mailable Club Burswood member’ from that day.
e. ‘active mailable Club Burswood member’ means a Club Burswood member who receives mail and has
earned reward points using their Club Burswood card in the 12 months prior to Friday, 18 November
2011. Any patron joining Club Burswood as a mailable member must ensure that, prior to 5.59am on
Friday, 18 November 2011, they have earned reward points using their card to be classified as an ‘active
mailable Club Burswood member’. Any active Club Burswood member who changes their status to
‘mailable’ will be classified as an ‘active mailable Club Burswood member’ from that day.
23. Alteration of Terms and Conditions: Subject to approval being granted under Condition 12 of the
general conditions attaching to Trade Promotion Lotteries issued by the Gaming and Wagering
Commission of Western Australia, the Promoter reserves the right to alter these terms and conditions to
address any misinterpretation, misinformation or misunderstanding that may arise in the application of
these terms and conditions, as is permitted by law. The Promoter’s decision will be final.
24. Acceptance of Terms and Conditions: Participation in the competition constitutes an acceptance of
these terms and conditions.
25. Disqualification: Any failure to comply with these terms and conditions may result in immediate
disqualification of an entrant or the Prize Winner. Disqualification will be at the Promoter’s sole discretion
and no correspondence will be entered into.
26. Cancellation of the Promotion: The Promoter reserves the right to cancel the Promotion at any time
prior to the commencement of the Promotion Period for any reason whatsoever
