MasterChef Kitchen Experience Terms and Conditions

1. Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Promotion commences 15/10/2011 and ends for purchases at close of business on 24/12/2011. Final entries must be received by 11.59pm AEDST on 27/12/2011.

3. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. To be eligible to enter, individuals must purchase any Sunbeam branded product from a participating store nationally between 15/10/2011 and close of business on 24/12/2011.

5. To enter, eligible entrants must then visit www.sunbeam.com.au and follow the prompts to the promotion entry page, input the requested details including name, address, contact number, email address, model purchased, date of purchase, store purchased from and submit the fully completed entry form by 11.59pm AEDST on 27/12/2011

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per participating Sunbeam product purchased; and (b) each entry must be submitted separately and in accordance with entry requirements.

9. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.

10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

11. The draw will take place at Greeneagle Distribution and Fulfilment, Unit 10-20 Ricketty Street, Mascot NSW 2020 on 28/12/2011 at 3.00pm AEDST. The winner will be notified by telephone and in writing by mail within two (2) business days of the draw and their name will be published in The Australian on 31/12/2011. The Promoter's decision is final and no correspondence will be entered into.

12. The first valid entry drawn will win a trip for four (4) people to Sydney, NSW to visit the set of MasterChef valued at up to $20,000 depending on date and point of departure. Prize includes transfers to the Sydney Harbour Marriott Hotel at Circular Quay, three (3) nights twin share accommodation at the Sydney Harbour Marriott Hotel at Circular Quay and a two (2) hour site visit to the MasterChef kitchen (including the pantry). The winner and their companions will also be able to view part of the filming of an episode of MasterChef Series four (4). If the winner and their companions are not from Sydney, NSW, the prize also includes return economy airfares from the winner's nearest capital city. If the winner and their companions are from Sydney, NSW, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Spending money, meals, insurance, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by a date to be determined by the Promoter in conjunction with the producers of the MasterChef TV show, which will be no earlier than 29/01/2012 and is subject to booking and flight availability.Due to filming dates and requirements, this date will not be able to be changed.

13. Prize is subject to the standard terms and conditions of individual prize and service providers. No photographs can be taken during the site visit component of the prize. The winner and their companions will be required to sign a confidentiality agreement before entering the MasterChef premises.

14. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The winner may be required to present their credit card at time of accommodation check in.

15. If for any reason the winner does not redeem the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

16. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification.

17. Total prize pool value is up to $20,000. The prize is not transferable or exchangeable and cannot be taken as cash.

18. A draw for the prize, if unclaimed, may take place at 4.00pm AEDST on 16/01/2012 at the same place as the original draw, subject to any directions from a regulatory authority. The winner (if any) will be notified by telephone and in writing by mail within two (2) business days of the draw and their name will be published in The Australian on 20/01/2012

19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

21. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

23. Except for any liability that cannot be excluded by law including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special orconsequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b)any theft, unauthorised access or third party interference; (c) any entry or prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) use of the prize.

24. As a condition of accepting the prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

25. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
