Nationwide Jewellers Diamond Pendant Christmas Competition 2011 Acceptance by you
1. The Nationwide Diamond Pendant Christmas Competition (“the competition”) is provided by Jewellery & Gift Buying Service Pty Ltd T/A Nationwide Jewellers ABN: 63 050 055 591 of Suite 1, 1st Floor, 939 Pacific Hwy PYMBLE NSW 2073 (“the Promoter”). These conditions (including without limitation the information on how to enter and prize details which we publish in relation to the
competition) apply to the competition. By entering the competition, you acknowledge that you have read and understood, and agree to be bound by these conditions. IF YOU DO NOT ACCEPT THESE CONDITIONS YOU MUST NOT ENTER THE COMPETITION.

Entering the competition
2. The competition commences on Saturday 19th November 2011 at 9am Australian Eastern Standard Time AEST until Saturday 24th December 2011 at 11.59pm AEST (“Promotional Period”).

3. Entry is only open to residents of Australia and New Zealand. Employees and their families of the Promoter, participating Nationwide stores and their associated agencies and companies are not eligible to enter.

4. If you are aged under 18, you must seek the consent of your parent or legal guardian before entering this competition.

5. To enter and be eligible to win, entrants must, during the Promotion Period, visit the Nationwide Jewellery web site www.nationwidejewellers.com.au to complete an online entry form. 

Prize
6. There is one prize to be won in Australia & one prize to be won in New Zealand. A computerised electronic prize draw will take place at 11am AEST at Markad Consulting, 5/42 Shore St Cleveland, Qld 4163 on Tuesday 10th January 2012.

7. The first entry drawn in each country will win an 18ct yellow gold pendant set with a 0.50ct round brilliant cut diamond. (H, SI quality).  The pendant will be hung on an 18ct yellow gold neck chain.   

8. The prize will be made available to the winner within 28 days of the winner being drawn. 

9. The Total maximum value of all prizes is A$3,200.00 including GST. (NZ$4,000.00 including GST) 

10. Prize values are correct at time of printing.

11. If a person under the age of 18 years is a winner, the prize will be awarded to their nominated parent or guardian at the Promoter’s discretion.

12. The Promoter will endeavour to contact all prize winners via phone and writing within 2 business days of them winning their prize to arrange collection of their prize.

13. All prize winners will have their details published in the Public Notice section of The Australian newspaper & the Auckland Herald newspaper on Friday 13th January 2012.

14. If the prize remains unclaimed by close of business on Thursday 1st March 2012 the Promoter may conduct an unclaimed prize draw at the same place as the original major prize draw on Wednesday 7th March 2012 at 11am to award the unclaimed prize, subject to any written directions from any regulatory authority. The Winner(s) of any unclaimed prize will have their details published in the Public Notice section of The Australian newspaper & the Auckland Herald newspaper on Friday 9th March 2012.

15. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any services or products provided by the Promoter and their associated companies.

Disclaimers
16. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

17. Incomplete, indecipherable or illegible entries will be deemed invalid. 

18. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

19. The Promoter is not responsible for any late, lost or misdirected mail.

20. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).

21. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the competition.

Exclusions and our liability
22. We shall not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the competition or accepting any prize offered as part of the competition, except for any liability which cannot be excluded by law.

23. The law implies various conditions and warranties which might apply to us supplying goods or services to you. We exclude all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose.

24. Provisions of the Trade Practices Act 1974 and other statutes in some cases either cannot be excluded, restricted or modified; or can only be restricted or modified to a limited extent. If any of those provisions apply, then to the extent permitted our liability under those provisions is limited as set out below. Our liability in relation to goods we supply is limited at our option to: a) replacement of the goods or the supply of equivalent goods; or b) repair of the goods; or c) payment of the cost of replacing the goods or of acquiring equivalent goods; or d) payment of the cost of having the goods repaired; and our liability in relation to services we supply, is limited at our option to: a) the supplying of the services against; or b) the payment of the cost of having the services supplied again.

Termination
25. We may terminate or cancel your entry in the competition immediately in our reasonable discretion or if you breach any of your obligations under these conditions.

Your personal information
26. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on 02 9983 9111  during office hours.

You indemnify us
27. You release and agree to keep us indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your entry in the competition or any claim by a third party arising from an act or omission by you.

Failure to comply and severability
28. We are not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.

Entire agreement and governing law
20. These conditions constitute the entire agreement between you and us as to its subject matter. By entering the competition, you accept that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in New South Wales, Australia in accordance with the laws in force in New South Wales, Australia from time to time.
