Terms & Conditions Of Entry
The Promoter is Protector Alsafe Pty Limited (ABN 28 007 000 624) of 471 Grieve Parade, Altona North, VIC Australia, 3025. ("Promoter").
Information on prizes and instructions on how to enter the Promotion form part of these terms and conditions. By participating in this Promotion, Participants shall be deemed to agree to abide by these Terms & Conditions of Entry.
Entries and Participants not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify a Participant from the Promotion if its entries do not comply with these Terms & Conditions of Entry.
In these Terms & Conditions of Entry, unless the contrary intention appears, the following words and phrases have the meanings:
"Customer Draw" means that part of the Promotion whereby Customer Entrants compete for the prizes set out in paragraph 20.
"Customer Entrant" means a person who registers for or enters the Customer Draw in the Promotion and who is not an Ineligible Customer Entrant.
"Employee Draw" means that part of the Promotion whereby Employee Entrants compete for the prizes set out in paragraph 19.
"Employee Entrant" means a person employed either in a part time of full time position by the Promoter and who is nominated for entry into the Employee Draw by a Customer Entrant.
"Ineligible Customer Entrant" means the Promoter; employees and directors of the Promoter; immediate families of employees or directors of the Promoter; and all organisations associated with this Promotion and/or contributing prizes to the Promotion. For the purposes of this definition, "immediate family" includes spouse, defacto spouse, parent and natural, adopted or step child or sibling, whether or not they live in the same household as the employee or director of the Promoter.
"Participant" means an Employee Entrant or a Customer Entrant as the case may be.
"Promotion" means this competition (comprising the Customer Draw and the Employee Draw) conducted amongst Participants governed by these Terms and Conditions of Entry and entitled "2011 Protector Alsafe Catalogue Launch Competition".
"Web Site" means the Web Site of the Promoter accessible on the Internet through the World Wide Web being protectoralsafeipadpromo.com.au.
The Promotion is open to residents of Australia, who meet the Participant criteria set out in these terms and conditions.
Entry into the Promotion is free provided that any cost associated with accessing the Web Site is the Participant's responsibility. Customer Draw
Each Customer Entrant may only lodge one entry for the Customer Draw. Customer Entrants are not eligible to lodge an entry for Employee Draw (other than nominating an employee of the Promoter for the Employee Draw).
Protector Alsafe reserves the right to determine whether or not a Customer Entrant has entered the Customer Draw more than once and to disqualify such person from the Customer Draw.
A Customer Entrant may only register its own personal business details for individual participation in the Promotion.
Entry into the Customer Draw Promotion is deemed to occur when a Customer Entrant submits his or her details for the Customer Draw.
To enter the Customer Draw a Customer Entrant must, before the Promotion End Date (5pm AEDT on 16 December 2011), either: a. complete the on-line entry form as prescribed and located on the Web Site; or b. complete the entry form for the Promotion in the 2011 Protector Alsafe Catalogue and lodge the completed entry form at any Protector Alsafe branch, or by sending the completed entry form to the Promoter at 471 Grieve Parade, Altona VIC 3025. A reply-paid envelope has been included in the 2011 Protector Alsafe Catalogue for this purpose.
In the event of a dispute; as to the identity of a Participant, the Promoter reserves the right, in its sole discretion, to determine their identity.
Employee Draw
A nomination of a Protector Alsafe employee in the Employee Draw is made by the Customer Entrant including that employee's name in the entry form used by the Customer Entrant to enter the Customer Draw. A Customer Entrant may nominate no more than one part time or full time employee of Protector Alsafe by name, to participate in the Employee Draw. Employee Entrants may receive multiple nominations for the Employee Draw.
Entry to the Employee is open to all current Protector Alsafe Employees. In order to be eligible to win a prize in the Employee Draw, the person must be an employee of Protector Alsafe on the day of the Employee Draw prize draw.
Promotion Timing, Prizes, Prize Draws and Prize Winners
The Promotion commences on 14 November 2011 and Entries in the Customer Draw must be lodged (and nominations of Employee Entrants for the Employee Draw must be made) before 5pm AEDT on 16 December 2011.
The prize draw(s) for the Customer Draw and the Employee Draw will take place at 20 December 2011 at 11am at the offices of Protector Alsafe Pty Ltd, 471 Grieve Parade, Altona VIC 3025.
The total prize pool of the Promotion is $20,412.00 consisting of twenty eight 3G 16gig Apple Ipad 2 with a list price of $729.00 each. Twelve of the Apple Ipads are to be awarded to the twelve winning entries in the Customer Draw. Sixteen of the Apple Ipads are to be awarded to the sixteen winning entries in the Employee Draw.
The sixteen winners of the Employee Draw will each be awarded a 3G 16gig Apple Ipad 2 with a list price of $729.00. A total prize pool of $11,664.00 is to be awarded to the winners of the Employee Draw.
The twelve winners of the Customer Draw will each be awarded a 3G 16gig Apple Ipad 2 with a list price of $729.00. A total prize pool of $8,748.00 is to be awarded to the winners of the Customer Draw.
The winners of the Customer Draw will be drawn by the Promoter from the entries of Customer Entrants at random.
The winners of the Employee Draw will be drawn by Protector Alsafe from the nominations/entries of Employee Entrants at random.
The Promoter reserves the right not to accept an entry in the Promotion if the entry contains anything slanderous or defamatory as determined by the Promoter in its absolute discretion.
All prize winners will be notified by the Promoter in writing and their names will be published on the Web Site upon determination. The names of the winners of the Customer Draw and the Employee Draw will be advertised in The Australian Newspaper on 23 December 2011 and online at
www.protectoralsafe.com.au.
The Promoter may seek the consent of the winner to take and publish their photograph in external publications.
In the event that a prize winning Participant is unable to accept their prize for whatever reason, or the prize is unable to be allocated, within three (3) months of the results being determined, the Promoter will conduct an unclaimed prize draw at the same time and place as the original draw on 21 March 2012, subject to any written directions given under applicable State or Territory legislation. In the event of any winner or winners in the unclaimed prize draw, the winner or winners will be notified by the Promoter in writing and the names and localities of winners will be published in The Australian on 28 March 2012 and online at
www.protectoralsafe.com.au.
Protector Alsafe reserves the right to reject any entries (or to withhold or withdraw prizes) at its sole discretion, if it suspects fraud or misconduct.
If any prize is unavailable despite the Promoter's reasonable endeavours to obtain it within Australia, the Promoter reserves the right to substitute the prize with a different item with an equal or greater recommended value, subject to any written direction of any State or Territory lottery authority.
Prizes will be delivered to the winners within 28 days of the prize draw. Prizes are awarded to Customer Entrants are not a personal incentive. Allocation of any prizes to any person within an organisation comprising a Customer Entrant is to be determined by the relevant Customer Entrant that has been awarded the prize (or its relevant authorised officer).
The Promoter respects the policies of those of its customers which forbid the acceptance of prizes by their employees or which require the business to determine the recipient of prizes awarded on the basis of purchases made by or for the business. Where a prize is awarded to the purchaser of goods on a business account, the Promoter may require the prize winner to provide signed authorisation from an authorised officer of business account holder confirming permission for the winner to accept the prize.
Prize winners should seek individual tax advice.
To the extent permitted by law, the Promoter reserves the right to withdraw or amend the Promotion as necessary due to circumstances outside its reasonable control or if required by an appropriate regulatory authority. Individual notice of such changes shall not be given but such changes will be recorded on the Web Site.
If the Promoter suspects fraud or misconduct, relevant prize may be withheld or withdrawn in the Promoter's sole discretion.
The Promoter and its related bodies corporate, officers, employees and agents shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to direct, indirect or consequential loss) for any personal injury which is suffered or sustained as a result of taking any of the prizes, except for liability which cannot be excluded by law.
The Promoter takes your privacy seriously. Your personal data is held in accordance with the terms of the Promoter's privacy policy which can be found on the Promoter's website at
www.protectoralsafe.com.au/PrivacyPolicy.aspx. The names and addresses of Participants will be collected by the Promoter for the purpose of conducting the Promotion and will also be entered into a database for the future purpose of the Promoter offering products and services.
