TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into this promotion is deemed acceptance of these Terms and Conditions by each Entrant (defined below).
2. Entry is limited to current Optus consumer residents aged 18 years and over within Australia ("Entrants"). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. Promotion commences at 12:01am (AEDST) on 01/11/2011 and closes at 11:59pm (AEDST) on 09/12/2011 ("Promotional Period").
4. To be eligible to enter, Entrants must register or be registered with Optus Movie Rewards during the Promotional Period. Non-members can register with Optus Movie Rewards by visiting
www.optusrewards.com.au and following the prompts to register. To enter, Entrants who are new or existing Optus Movie Reward members must visit
www.optusrewards.com.au, follow the prompts to the TIN TIN promotion entry page, input the requested details and submit the fully completed entry form during the Promotional Period.
5. Limit of one (1) entry per Entrant.
6. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Incomplete or indecipherable entries will be deemed invalid. An Entrant must remain a current Optus consumer residential customer aged 18 or over at the time of the draw to be eligible to win a prize.
8. If there is a dispute as to the identity of an Entrant, the Entrant will be deemed to be the person in whose name the Optus residential account is held.
9. Entries are deemed to be received at the time of receipt into the promotional database and NOT at the time of transmission by the Entrant.
10. All valid entries received during the Promotional Period will be entered into the draw to be held on Tuesday 13/12/2011 at 15:00 (AEDST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113. The Promoter reserves the right to draw additional reserve entries and record them in case an invalid entry or ineligible Entrant is drawn.
11. The first valid entry drawn will win the major prize of an ultimate experience for two (2) people (any child companion must be aged 6 years or over) to the Whitsundays, Australia, valued at up to AU$9,000, depending on the major prize winner's date and point of departure. Prize includes return economy airfares (including all airport and airline taxes) for two (2) people from the major prize winner's nearest capital city to Hamilton Island, Australia, return boat transfers for two (2) people from Hamilton Island to Able Point Marina, four (4) nights twin share accommodation [minimum 4 star rating] in Hamilton Island, Australia, return airport/hotel transfers in Hamilton Island, three (3) nights sailing adventure on Whitsundays, one (1) sea plane adventure for two (2) people for approximately 2 hours, and a Hamilton Island Safari Tour for two (2) people for approximately 4 hours. Prize must be taken by 13/12/ 2012, subject to booking and flight availability at time of booking . Prize cannot be taken over Australian public/school holidays. Major prize winner must give a minimum of 8 weeks' notice of ideal travel dates. Prize is not transferable or exchangeable.
12. If the major prize winner is from Hamilton Island, then the prize does not include airfares and return airport/hotel transfers in Hamilton Island and the airfare and airport/hotel transfer components of the prize is not redeemable for cash.
13. Spending money, meals, additional taxes, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are the responsibility of the major prize winner and his/her companion.
14. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The major prize winner and his/her companion are responsible for ensuring that they have valid vaccinations and travel documentation. The major prize winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. The Promoter accepts no responsibility for the cancellation or rescheduling of any flight. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Major prize winner may be required to present credit card at time of accommodation check in.
15. The next ten (10) valid entries drawn (runner up winners) will each win a double movie pass (2 Movie tickets for 2 adults) to see the movie ‘TIN TIN' at any cinema showing ‘TIN TIN' (valued at $30 each) AND a limited edition Money Can't Buy ‘TIN TIN' Adventure Kit (valued at $150 each). The limited edition Money Can't Buy ‘TIN TIN' Adventure Kit includes a pet camera, translator and notepad. Each runner up prizes is valued at AU$180.
16. Any costs associated with attending the movie including travel to and from the cinema is the responsibility of the winner. Any ancillary costs associated with redeeming the double movie pass are not included. Any unused balance of the double movie pass will not be awarded as cash. Redemption of the double movie pass is subject to any terms and conditions of the issuer including those specified on the double movie pass. Total prize pool of all runner up prizes is AU$1,800.
17. The double movie pass prizes are subject to the cinema venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
18. If for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
19. Winners will be notified in writing by e-mail and also by telephone within two (2) days of the draw. The name of the major prize winner will be published in The Australian on 15/12/2011.
20. Total prize pool value is up to AU$10,800. Prizes, or any unused portion, are not transferable or exchangeable and cannot be taken as cash.
21. A draw for any prize(s), if unclaimed, may take place on 13/03/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority in order to award the prizes (or prizes of equivalent value). Winner(s), if any, will be notified in writing and by telephone within two (2) days of the draw and the name(s) of any unclaimed prize winner will be published in The Australian on 16/03/2012.
22. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Any cost associated with accessing the promotional website is the Entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
25. The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this promotion, or by any technical error that may occur in the course of the administration of this promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
26. If for any reason this promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any Entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion, subject to any written directions from a regulatory authority.
27. The winner agrees to participate in any reasonable amount of news and media/PR activities surrounding the promotion. The Promoter reserves the right to use each winner's name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.
28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
29. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use/taking of a prize.
30. All entries become the property of the Promoter. The Promoter requires Entrant's personal information in order to conduct the promotion. If Entrant's do not provide the mandatory personal information requested then they will not be able to take part in the promotion. By entering this promotion, each Entrant is taken to consent to the Promoter using the Entrant's personal information to administer the promotion, announce the winners and disclosing the Entrant's personal information to organisations that assist the Promoter with administering the promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this promotion).
