CONDITIONS OF ENTRY
Information on how to enter and prize details form part of these Conditions of Entry. Entry into the “Cowboys & Aliens” Competition is deemed to be acceptance of these Conditions of Entry.
The Competition commences on 8 December 2011. Entries close at 11.59pm 17 December 2011.
Entry is only open to residents of Australia aged 18 years and over who are BLOCKBUSTER® members (Eligible Entrants) excluding:
management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of prizes);
a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 3(a) of these Terms;
persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;
persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
Rent “Cowboys & Aliens” for your opportunity win $1000 cash. Blockbuster will give away $1000 cash every day for 10 days. The total prize value is $10,000.
The sharing of a Prize is not permitted and the Prizes are not transferable, not exchangeable, cannot be taken for cash and are not valid with any other offer.
All prices stated are in Australian dollars, represent the recommended retail price (“RRP”) and include GST. All references to times and dates are to times and dates in Melbourne.
7. The most creative entry judged each day will win $1,000.00, to be paid directly into a nominated bank account by way of electronic funds transfer as directed by winner. Blockbuster accepts no liability for loss, damage or compensation claims due to incorrect bank account details supplied by winner to BLOCKBUSTER®. The winner will be solely responsible for any transfer fees or similar charges imposed by the processing bank.
How to enter
To enter the Competition, Eligible Entrant must make a paid rental for the movie title “Cowboys & Aliens” from any participating Blockbuster store.
9. Eligible Entrant must log on to
http://www.blockbuster.com.au/competitions, click through to the “Cowboys & Aliens” competition page, and answer this question in 25 words or less “What would you do when aliens attack your city and why?”
10. Eligible Entrant must be a member of
www.blockbuster.com.au to enter and must complete all mandatory fields of the entry form in order to be eligible to receive a prize.
Eligible Entrants can enter once during the promotional period. Eligible Entrants can only win a maximum of one prize for the duration of the competition.
How winners will be determined
This is a game of skill and chance plays no part in determining the winner.
A panel of judges will judge the creativeness of entries in answering the question.
The judges will determine the 10 most creative entries and that entry will win the prize based on creative merit.
The judges have absolute discretion in their determinations and their decisions are final. No correspondence will be entered into.
If requested by the Promoter, the provisional Prize winner must produce, within the time requested by the Promoter at its absolute discretion:
Eligible appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the Prize and compliance with these Terms; and
Entrant must have Proof of Rental Purchase of the movie title “Cowboys and Aliens” that corresponds to all entries they have submitted in the Promotion, before the Promoter issues their Prize. If the required Proof of Rental Purchase by the Promoter are not received or a provisional winning entry has not been verified to the satisfaction of the Promoter within the time period required by the promoter, the provisional winner's entry will be invalid and, at the Promoter's absolute discretion, all of the provisional winner's remaining entries will be invalid. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
If more than one person attempts to claim the Prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning entrant.
Each entry must be the entrant’s original work and entrants undertake that their entries is not, and its use by the Promoter or associated agencies will not be, in breach of any other person’s intellectual property rights. The entrant will be solely responsible for their own entry and the consequences of submitting them.
The winners will be notified in writing.
The Promoter may require an entrant to show that they are an Eligible Entrant. Showing that an entrant is an Eligible Entrant may (in the Promoter’s sole discretion) include the Eligible Entrant providing, or showing to, the Promoter:
Proof of Australian residency; and
The Eligible Entrant’s BLOCKBUSTER® membership card.
In the event that any entrant does not claim his or her Prize or cannot show that he or she is an Eligible Entrant within 30 days of written notice being given to that entrant that his or her entry is a winner, the judges may reallocate the Prize to the next most creative entry that has not yet received a Prize.
No responsibility accepted for lost, late, stolen, damaged or misdirected mail.
If for any reason the Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Competition including the Prizes and these Conditions of Entry, subject to the approval (if required by law) of any relevant government authority.
The Promoter and the agencies and companies associated with the Competition will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of entering the Competition or receiving, accepting or using any prize except for any liability which cannot be excluded by law.
The Promoter assumes no responsibility for:
any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
any theft, destruction or unauthorized access to, or alteration of such communications;
any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion;
any incorrect or incomplete information which may be communicated in the course of the administering this Promotion.
CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
The Promoter and the agencies and companies associated with the Competition accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
If the winner of a Prize is under the age of 18 years, the Prize will be awarded to the winner’s parent or guardian.
If for any reason a prize is not available, the Promoter reserves the right to substitute it for another item, in its sole discretion, of an equal or greater recommended retail value.
All claims and entries become the property of BLOCKBUSTER®. Each entrant agrees to do all things requested by BLOCKBUSTER® to ensure that the intellectual property rights in and to his or her entries become the property of the BLOCKBUSTER® and to provide all consents necessary or requested by the BLOCKBUSTER® in relation to moral rights.
BLOCKBUSTER® may use the information an entrant provides for the purpose of conducting the Competition and in any media for further promotional, marketing and publicity purposes unless otherwise advised by the entrant.
BLOCKBUSTER® may disclose entrants’ personal information to its contractors and agents who assist it in conducting the Competition, communicating with entrants and conducting promotional, marketing and publicity activities. BLOCKBUSTER® is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can access and correct the personal information BLOCKBUSTER® holds about them by contacting BLOCKBUSTER® on (03) 9321 1600.
