NEW YORK TRIP Terms & Conditions
1. These terms and conditions are for the Sunglass Hut Inner Circle Competition for a chance to win the Main Prize of a trip for two to New York (the "Promotion"). Information on how to enter and the entry registration process forms part of these terms and conditions of entry and is the property of the Promoter. Entry into the Promotion is deemed acceptance of these terms and conditions.

2. To be eligible to enter the Promotion, entrants must be residents of Australia or New Zealand ("Eligible Entrants"). Employees and their immediate families of the Promoter and its related entities and agencies (incl. Moon Group Creative Agency) connected with the Promotion are not eligible to enter.

3. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

4. The Promotion commences on 15 September 2011 at 09:00am (Sydney Time) and concludes on 31 December 2011 at 11:59pm (Sydney Time) ('Promotional Period').

5. To enter the draw, Eligible Entrants must visit the Sunglass Hut Inner Circle website and register their details (First name, surname, email address, country of residence), and tell us in 25 words or less what they would like to see on the Sunglass Hut Inner Circle website during the Promotional Period. The entry judged to be most aligned with the Sunglass Hut brand values set out in clause 9 below will be judged the winner.

6. Eligible Entrants may enter the Promotion as many times as they wish.

7. Entries must be received by 11:59pm (Sydney Time) 31 December 2011. The Promoter accepts no responsibility for any late, lost, not entered or incorrectly entered entries.

8. Main Prize: The prize package includes:

2 x Return flights to New York City from the winner's nearest capital city in Australia or New Zealand valued at up to AUD$6000 (depending on departure city). Flight dates and times to be confirmed when winner is notified. Travel must be taken prior to 31 December 2012.
Five nights accommodation for two in a double room at Morgan's Hotel in NYC, valued at up to AUD$2500.
USD$4000 spending money on a prepaid Visa travel card.
USD$1000 Sunglass Hut gift card to use in the New York Fifth Avenue Sunglass Hut store.

9. The maximum retail value of the total prize pool is USD$13,500 (including GST). Prizes are not transferable and cannot be redeemed for cash. Prizes must be taken as described and no compensation will be payable if a winner is unable to use the prize as described.

10. This competition is a game of skill and chance plays no part in the competition. The entry judged by a panel of experts from the Moon Communications Group (Creative Agency) and Sunglass Hut to be the most aligned with the Sunglass Hut brand values set out below will be the winner:

11. The winner will be contacted by phone on 31 January 2012 and the winner's name will be published on the Sunglass Hut Inner Circle at sunglasshut.com.au/innercircle and sunglasshut.co.nz/innercircle on 31 January 2012. The panel of judges' decision is final. No correspondence will be entered into:

12. The Promoter's decision on all matters in relation to the Promotion is final and binding.

13. By entering the Promotion the entrant consents to receipt of any email regarding the Promotion and to their information being published on the internet.

14. Elements that constitute the Main Prize will be dispatched by post and/or email upon confirmation of bookings.

15. Second Chance Draw: If the main prize winner is unable to claim the prize, the entry judged second best will claim the prize. A second chance draw will be conducted on 14 March 2012 at 12.00pm (Sydney Time). In the event of a re-drawn winner, they will be notified in writing within two days of the re-draw and published on the Sunglass Hut Inner Circle at sunglasshut.com.au/innercircle and sunglasshut.co.nz/innercircle the week commencing 19 March 2012. The prizes will be dispatched by post and/or email to the redrawn winners. No further re-draw will be conducted in the event a re-drawn prize is forfeited or unclaimed.

16. It is a condition of accepting a prize that the winner must comply with all conditions of use of the prize and may be required to sign any legal documentation as and in the form required by the Promoter and/or the supplier of the prize including but not limited to a legal release and indemnity

17. The winner and their travelling companion are responsible for all other expenses including additional spending money, additional flights, meals (unless specified), drinks, transfers, laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

18. The winner and travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to the winner's nearest capital city for flight departure.

19. If the winner is under the age of 21 as at the date of the draw, an adult must accompany the minor in the participation of the prize.

20. The prize must be taken by 31 December 2012 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays (if applicable) and cannot be changed once the booking has been made.

21. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

22. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

23. The following additional terms and conditions apply to the travel component of the Main Prize:

23a. Travel insurance is advisable for Prize winner/s for any unforeseen and unpredictable circumstances and, if it is to be taken, must be arranged by the winner and/or their guests at their own cost.

23b. It is the sole responsibility of the prize winner and their guest to ensure that their personal documentation is valid. Any expenditures incurred as a result of not meeting such requirements are the sole responsibility of the prize winner and/or their guest.

23c. The prize winner and their guest must depart from and return to the same capital city nearest to the winner's address.

23d. The entire cost of the airline ticket (including taxes and other charges) is included in the prize. All other ancillary costs incurred in taking and using the prize (including but not limited to transport/transfers to and from airport in prize winner's nearest capital city, meals, mini bar, spending money, insurance and taxes) are the responsibility of the prize winner and their guests. Unless expressly stated as being part of the Prize, all other expenses are the sole responsibility of the prize winner and their guest. Furthermore, any prize costs exceeding the dollar limit as specified by the Promoter in clause 8 must be paid by the prize winner and their guest.

23e. All prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

23f. The Promoter reserves the right to refuse to allow the Prize winner or his or her guests to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Prize.

23g. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

25. The following additional terms and conditions apply to the USD$1000 Sunglass Hut gift card to use in the New York Fifth Avenue Sunglass Hut store:

Sunglass Hut gift cards are honored online and at Sunglass Hut stores in North America are non-refundable, are not redeemable for cash, may not be sold or transferred, and will not be replaced if lost or stolen. Pursuant to applicable laws, Sunglass Hut gift cards have no expiration date, and no dormancy fees may be charged.

26. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Unless otherwise nominated, the winner's prize will be sent to the address held by the Promoter for the entrant.

27. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.

28. Once prizes have left the Promoter's or its agent's premises, no responsibility is accepted for prizes damaged, delayed or lost in transit.

29. In the event that for any reason whatsoever the winners do not take the prize or an element of the prize at the time required, then that prize or element of the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize or that element of the prize.

30. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

31. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner's participation in any aspect of the prize. The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

32. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

33. Should an entrant's contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

34. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under regulation.

35. The Promoter and its agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prizes except for any liability which cannot be excluded by law. The Promoter is not responsible or liable for any costs, loss or damage arising out of any incorrect or inaccurate information, or information provided by the entrant, any variation in prize value to that state in these Terms and Conditions, any tax liability incurred by a winner or entrant, any costs whatsoever associated with use of the prize or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

36. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any written direction given under applicable regulation.

37. A request to access, update or correct any information should be directed in writing to the Promoter.

38. In the event that a prize item is unavailable despite the Promoter's reasonable endeavours to procure it, the Promoter reserves the right to substitute a different prize of equal or greater value.

39. Collection, use and disclosure of information: The Promoter ("we", "us") collects the information that the entrant ("you") choose to provide to us - for instance by providing us with information at the time of purchase or by entering into a promotion (including this Promotion) that we are conducting. We adhere to privacy legislation by only using your personal information for the purpose it was collected or consented to be collected (for instance by agreeing to separate terms and conditions), and for directly related secondary purposes. By entering the Promotion, you agree that the Promoter and its related entities may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to you, including sending the entrant electronic messages. For websites you visit in connection with us, the collection, use and management of your personal information while visiting the websites may be governed by additional privacy policies and terms and conditions.
