•Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
•Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
•Promotion commences 07/11/2011 and entries close 11.59pm AEDST on 29/02/2012 (‘Promotional Period’).
•There will be two (2) components to this promotion: (i) a game of skill determined by public voting (“Competition”); and (ii) a draw for all individuals who submit a vote for an entry in the Competition (“Draw”).
•To enter the Competition, individuals must, during the Promotional Period, visit www.DoKokoda.com.au, follow the prompts to the Competition entry page, input the requested details including their name, email address and one (1) of their life goals and submit the fully completed entry form.
•Entries must not contain any material determined by the Promoter in its absolute discretion to be obscene, offensive or inappropriate. The Promoter reserves the right, at any time, to refuse to accept any entry or remove any entry from the Competition that it deems, in its absolute discretion, to be obscene, offensive or inappropriate, or infringing upon the rights of any third party.
•To submit a vote, and receive an entry into the Draw, individuals must, during the Promotional Period, visit www.DoKokoda.com.au, follow the prompts to the Competition entry page and cast a vote for the life goal entry they believe to be the best. Individuals will also receive one (1) entry into the Draw for every vote they submit, subject to Clause 11 below.   
•The Promoter reserves the right, at any time, to verify the validity of entries and entrants and voters and votes (including an entrant’s/voter’s identity, age and place of residence) and to disqualify any entrant or voter who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry or voting process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
•The Promoter reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities or email addresses.
•Incomplete or indecipherable entries/votes will be deemed invalid.
•Multiple entries/votes permitted, subject to the following: (a) each Competition entry must be submitted separately and in accordance with entry requirements; (b) each Competition entry must be substantially unique and (c) only one (1) vote permitted per Competition entry. For the sake of clarification, an individual may vote for their own Competition entry, but may only do so once.
•If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
•The entrant whose Competition entry accumulates the most votes and ranks the highest as at the conclusion of the Promotional Period will be deemed the major prize winner. The major prize winner will receive a trip for two (2) people to Port Moresby, Papua New Guinea valued at up to $9,500. Prize includes return economy airfares for two (2) people from winner’s nearest capital city to Port Moresby, Papua New Guinea, two (2) nights twin share accommodation at a (minimum) three (3) star hotel, chartered flight to Kokoda, services of an Australian Tour World War 2 Historian, Papua New Guinea carriers for food and equipment (to be used on the Trek), seven (7) nights camping accommodation on the Kokoda Track in a two (2) person tent and all meals for two (2) included whilst on the Kokoda Track. Prize also includes two (2) nights twin share accommodation at the Tufi Resort, Oro Province, including transfers and meals for two (2) people. Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.  Prize must be taken by 28/02/2013 and is subject to booking and flight availability.   
•Flights to and from Port Moresby must be made via Airlines PNG from either Brisbane or Cairns. Flights from originating capital city to/from Brisbane or Cairns must be made via Virgin Australia. No other carrier will be included in the prize.
•In the event of a tie for the major prize, all tied entrants will be entered into a tie breaker draw, which, if necessary, will take place at GTI Tourism, Level 2, 35 Grafton Street, Bondi Junction NSW 2022 at 12.00pm AEDST on 02/03/2012.
•The Draw will take place at GTI Tourism, Level 2, 35 Grafton Street, Bondi Junction NSW 2022 at 12.00pm AEDST on 02/03/2012 to determine the Draw winner. The first valid entry randomly drawn will be deemed the Draw winner. The Draw winner will receive a four (4) week Fitness First outdoor Training Package for two (2) people. Prize includes three (3) x one (1) hour training sessions per week for four (4) weeks valued at up to $400. 
•Winners will be notified by telephone and in writing by email within two (2) business days of winner determination and their names will be published in The Australian on 16/03/2012.  The Promoter’s decision is final and no correspondence will be entered into.
•The major prize winner and their companion are responsible for ensuring that they have valid passports, vaccinations and travel documentation.
•The major prize winner and their companion must depart from and return to the same departure point and travel together.
•Frequent flyer points will not form part of the major prize. Major prize is subject to the standard terms and conditions of individual prize and service providers. The major prize winner may be required to present their credit card at time of accommodation check in.
•If the winner of the major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf and a nominated parent/guardian must accompany the winner throughout the entire duration of the prize.
•If for any reason a winner does not take or redeem their prize (or an element of their prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
•The winner of the major prize and their companion acknowledge that travelling along the Kokoda Track is a potentially dangerous activity (“Activity”) that may result in injury or death, and participate at their own risk. The winner and their companion must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or their companion from participating in the Activity if, at any time, they reasonably believe that the winner or their companion poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
•If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
•Total prize pool value is up to $9,900. 
•Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
•A draw for any unclaimed prizes may take place on 04/06/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified by telephone and in writing by email within two (2) business days of the draw and their names will be published in The Australian on 18/06/2012.
•Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
•If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
•Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

•Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
•Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
•As a condition of accepting the major prize, the major prize winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 
•The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
