PIZZA HUT VIRTUAL ROOFTOP PARTY PROMOTION
CONDITIONS
 
PARTICIPATION
1. This Promotion (“Promotion”) is conducted by Pizza Hut Adco Limited, ABN 38 085 270 640, of 20 Rodborough Road, Frenchs Forest NSW 2086 (“Promoter”).
2. Entry to the Promotion constitutes acceptance of these conditions.
3. The Promotion is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 13 years of age, or older; (ii) has a current Facebook account; (iii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Promotion; (iv) is not an employee of a Pizza Hut franchisee; and (v) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
4. An Eligible Entrant who is under 18 years of age, must obtain the permission of a parent or guardian to enter.
5. Promotion entry opens at 00:00 hrs on 14/12/11 and closes at 24:00 hrs on 16/1/12 ("Entry Period"). Unless otherwise indicated, all times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. Where times are stated using the 24 hour clock, 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.

FACEBOOK
6. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
7. By participating in the Promotion, each entrant releases Facebook, Inc from any and all liability to the entrant arising in any way from the conduct of the Promotion.
8. All information provided by an entrant in relation to the Promotion is provided to the Promoter and not to Facebook.

PROMOTION STRUCTURE
9. The Promotion comprises two Competitions: (i) the “Biggest Party Competition” for Eligible Entrants who create and hold a virtual Rooftop Party; and (ii) the “Party Goer Competition” for Eligible Entrants who accept invitations to attend virtual Rooftop Parties. Unless indicated otherwise in these conditions, these conditions apply to both the Competitions.

ENTRY TO THE BIGGEST PARTY COMPETITION
10. To enter the Biggest Party Competition, an Eligible Entrant must, during the Entry Period, use a compatible browser to:
(i) visit www.facebook.com/PizzaHut Australia (the “Promotion Website”),
(ii) “like” Pizza Hut Australia (if the Eligible Entrant is not already a Facebook “Fan” of Pizza Hut Australia); and
(iii) follow the directions to create, in the Promotion app (“Promotion App”), a “Rooftop Party”, thereby becoming a Rooftop Party “Host”.
11. To create a Rooftop Party, an Eligible Entrant must, as directed on the Promotion Website invite, at that time, five of the entrant’s Facebook friends (each a “Friend”) to join the entrant’s Rooftop Party. (This will require the Eligible Entrant to give certain permissions.)
12. An Eligible Entrant may not create more than one Rooftop Party and cannot invite himself/herself to his/her own Rooftop Party.
13. Each Friend who is invited by a Host to attend that Host’s Rooftop Party and who in accordance with the acceptance instructions, accepts that invitation, may himself/herself, at that time, invite up to five of their Facebook Friends to attend that Host’s Rooftop Party. Any of those invited Facebook Friends who, who in accordance with the acceptance instructions, accept the invitation may also, at that time, invite up to five of their Facebook Friends to the same Rooftop Party. Such invitation and acceptance may continue without limitation (except that no invitee may invite more than 5 of their Facebook Friends). An invited Facebook Friend need not be an Eligible Person.
14. An Eligible Entrant who is a Host will, subject to condition 15, be recognised as having as guest at their Rooftop Party (each a “Guest”), each Facebook member who, during the Entry Period [and through the Promotion App]: (i) is invited to attend that entrant’s Rooftop Party; and (ii) accepts that invitation.
15. If a person accepts more than one invitation to attend the same Rooftop Party, for the purposes of the Biggest Party Competition, that person will only be counted as being ONE Guest at that Rooftop Party.

WINNER DETERMINATION - BIGGEST PARTY COMPETITION
16. Subject to condition 17, the Eligible Entrant whose Rooftop Party has, at the end of the Entry Period, the most Guests, will win $5,000.
17. If more than one Eligible Entrant has, at the end of the Entry Period, the same highest number of Guests at their Rooftop Party, a draw will be held from those Eligible Entrants at 10.05am on 18/1/12 at 50 Holt Street, Surry Hills NSW 2010 and Eligible Entrant who is first drawn will win the $5,000.

ENTRY TO THE PARTY GOER COMPETITION
18. To enter the Party Goer Competition, an Eligible Entrant must, during the Entry Period:
(i) Host a Rooftop Party; and/or
(ii) be invited through the Promotion App to attend a Rooftop Party and must, as directed, accept that invitation through the Promotion App.
If an Eligible Entrant receives more than one invitation to the same Rooftop Party he/she may only accept one of those invitations. When one invitation is accepted by an Eligible Entrant, they cannot accept any more invitations to the same Rooftop Party. There is no limitation on how many different Rooftop Parties an Eligible Entrant may attend.
19. An Eligible Entrant will:
(i) at the time that they create a Rooftop Party, be awarded one entry for Hosting a Rooftop Party; and
(ii) at the time of accepting an invitation to a Rooftop Party, be awarded one entry into the Party Goer Competition.

DETERMINATION OF WINNERS - PARTY GOER COMPETITION
20. There will be five draws in the Party Goer Competition (each a “Weekly Draw”), one for each of the following periods (each a “Week”):

Week Starts - 14/12/11
Week Ends - 19/12/11

Week 2
Week Starts - 20/12/11
Weeks Ends - 26/12/11

Week 3
Week Starts - 27/12/11
Week Ends - 2/1/12

Week 4
Week Starts - 3/1/12
Week Ends - 9/1/12

Week 5
Week Starts - 10/1/12
Week Ends - 16/1/12

21. Each entry awarded will be allocated to the draw for the Week during which it was awarded by the Promoter and, except for an entry that is a winning entry in a Weekly Draw, will also be included in all subsequent Weekly Draws. An entry awarded exactly on the start of a Week will be allocated to the Week that is just commencing.
22. In each Weekly Draw, the Eligible Entrant whose valid entry is first drawn will win $1,000.
23. Each Weekly Draw will be held at 50 Holt Street, Surry Hills NSW 2010. The Weekly Draws will be held at 10am on each of the following dates: First Weekly Draw on 21/12/11; Second Weekly Draw on 28/12/11; Third Weekly Draw on 4/1/12; Fourth Weekly Draw on 11/1/12; Fifth Weekly Draw on 18/1/12.

WINNERS
24. Each winner, whenever determined, will be notified in writing sent by e-mail to the e-mail address indicated in their entry. The notification will include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
25. The names of the winners will be published in The Australian on 25/1/12.
26. The names of the winners may also be published on the Promotion Website within 7 days of the prize being won (including in a redraw under condition 27), for a period of at least 1 week.
27. Subject, where relevant, to any directions given under the legislation regulating the Promotion, if any prize is not claimed by a winner within 3 months of the draw for that prize, the prize will be awarded to another Eligible Entrant in a redraw for that prize commencing at 10am on 2/5/12 at 50 Holt Street, Surry Hills NSW 2010. If there is a redraw, the name of any winner in the redraw will be published in The Australian on 16/5/12.
28. In order to be entitled to any prize, the winner must, if requested by the Promoter, agree to and sign and return an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize. If a winner under 18 years of age, the winner must ensure that a parent or guardian of the winner agrees to and signs the documents referred to above (if requested by the Promoter).  A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize are signed and returned in accordance with this condition, as and when required by the Promoter.

INTERNET
29. Any costs associated with accessing the Promotion Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
30. Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a Promotion entry service.

PRIZES GENERALLY
31. The total value of all prizes is $10,000. All prizes will be paid by means of a crossed cheque payable to the winner, or if the winner so requests, by means of electronic transfer of funds to any nominated account in Australia. If the person who won is under 18 years of age, references in this condition to the "winner" are references to the parent or guardian of the person who won and that person will be paid the prize money on behalf of the person who is under 18 years of age.
32. A right to receive a prize is not transferable or exchangeable.

GENERAL
33. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.
34. All entries to the Promotion may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
35. The Promoter may, at its absolute discretion, declare any or all entries awarded to an entrant to be invalid if the entrant: (i) fails to establish their entitlement to enter the Promotion to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 34 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process (including the use of multiple Facebook accounts for the same person or for non-existent people) or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these conditions.
36. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct.
37. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion.
38. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
39. All of the Promoter’s decisions are final and no correspondence will be entered into.
40. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Promotion. Entrants should obtain independent tax and financial advice.
41. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Promotion or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Promotion and Consumer Act 2010.
42. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
43. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Promotion and publicise its winners. The personal information of each winner may be provided to others assisting in the conduct of the Promotion, including the Promotion administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.

PIZZA HUT GARLIC BREAD OFFER
(Made in association with the Virtual Rooftop Party Promotion)

OFFER CONDITIONS
1. This offer (“Offer”) is made by Pizza Hut Adco Limited, ABN 38 085 270 640, of 20 Rodborough Road, Frenchs Forest NSW 2086 (“Promoter”).
2. Offer available only to “Eligible Claimants”. An "Eligible Claimant" is an individual who is an “Eligible Entrant” as defined in the Promoter’s PIZZA HUT Virtual Rooftop Party Facebook Promotion (comprising the “Biggest Party Competition” and the “Party Goer Competition”) in which entry opens at 00:00 hrs on 14/12/11 and closes at 24:00 hrs on 16/1/12 (the “Rooftop Party Promotion”) viz., an individual who: (i) is a resident of Australia aged 13 years of age, or older; (ii) has a current Facebook account; (iii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Promotion; (iv) is not an employee of a Pizza Hut franchisee; and (v) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
3. Offer commences at 00:00 hrs on 14/12/11 and closes at 24:00 hrs on 16/1/12 (“Offer Period”). (All times and dates in these conditions are times and dates in Sydney.)
4. Subject to these conditions, an Eligible Claimant who, during the Offer Period:
(i) in the Biggest Party Competition, creates a Rooftop Party, will at that time be awarded one Garlic Bread Voucher; and/or
(ii) in the  Party Goer Competition, accepts an invitation to a Rooftop Party, will at that time be awarded one Garlic Bread Voucher for each such invitation they he/she accepts.
5. An Eligible Claimant who has been awarded a Garlic Bread Voucher may, no later than 23/1/12, claim one serve of PIZZA HUT garlic bread (excluding cheesy garlic bread) (“Claim”)(“Garlic Bread”) by:
(i) using a compatible browser to visit www.pizzahut.com.au (the “Order Site”); and
(ii) through the Order Site:
(a) using the Code that appears on their Garlic Bread Voucher to order one serve of Garlic Bread; and
(b) in the same transaction, ordering one or more other items from the range of products that may be ordered at the same time (together an “Order”).
6. The Order may be for “Pick Up” or “Delivery” but will be subject to the conditions applying to Orders at the time that the Order is placed. These conditions include which stores provide a delivery service.
7. The current purchase price(s) will apply to the purchase of the other item(s) in the Order and must be paid as directed for the Order to be accepted and the Garlic Bread to be provided.
8. If the Order is for:
(i) “Pick Up”, the minimum amount that must be spent to purchase another item is $4.95;
(ii) “Delivery”, the minimum amount that must be spent to purchase another item / other items is $20.
No amount will be payable for the Garlic Bread in the Order.
9. No more than one Garlic Bread Voucher may be used in an Order and the same Garlic Bread Voucher may not be used in more than one Order.
10. By using the Code that appears on their Garlic Bread Voucher when placing a Order that includes a serve of Garlic Bread, a claimant is deemed to have accepted these conditions.
11. The Promoter reserves the right, in its absolute discretion, to verify the validity of all Claims (including the right to confirm and verify the identity of a claimant, by requesting proof of identity and proof of residency. Identification considered suitable is at the Promoter's absolute discretion) and to not accept any Claim from a claimant who, in the Promoter’s opinion, has tampered with the Claim process or submitted a Claim that is not in accordance with these conditions.
12. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Claimant or Friend in connection with the Offer, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify a claimant’s rights under the Competition and Consumer Act 2010.
13. If the Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the Offer.
14. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
15. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS OFFER OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
16. Claimant personal information will be collected by or on behalf of the Promoter to enable it to administer the Offer and, if a Claimant consents, may be used to market its products to the Claimant. The personal information of Claimants may be provided to others assisting in the conduct of the Offer, including the supplier and deliverer of the Garlic Bread. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If a Claimant does not provide accurate personal information the Promoter may determine that they are not eligible to be awarded a Garlic Bread.
