Te Hana Competition – Terms and Conditions
1. Instructions on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to residents of Australia only who are aged 18 years and over. Employees of the Promoter, advertising agencies and their immediate families, are not eligible to enter.
3. Only one entry per person will be permitted.
4. The promotion commences on 16th November 2011 and closes 11:59pm AEDST on 17th January 2012. The judging will take place at the Promoter's premises, 54 Park Street, Sydney and will begin on 19th January 2012. The winner will be notified by phone and email using the contact details given in their entry.

madisonmag@acpmagazines.com.au with the subject title 'Te Hana Competition' so that it is received during the promotional period and must include (in the body of the email) their name, residential address, valid email address, daytime telephone number and in 25 words or less an answer to the question "Which woman shines the most in your life and why?"
6. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on the literary and creative merit of the answer to the question provided. The judges' decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
7. The Entrant warrants to the Promoter that the entry submitted is an original literary work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoters publications, future broadcasts, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth)
9. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.
10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. The best (1) valid entry as determined by the judges will be deemed the major prize winner and will receive:
* Dinner for two (2) people at a minimum four (4) star restaurant in the winners nearest capital city valued at up to $500.00 – awarded in the form of a voucher. The exact restaurant will be selected by the Promoter in its absolute discretion.
* Hair wash & blow dry, make-up and manicures at salon for two (2) people in the winners nearest capital city valued at a total of up to $520.00 – awarded in the form of a voucher. The exact salon will be selected by the Promoter in its absolute discretion.
* Two (2) x David Jones clothing voucher valued at a total of $2,000.00 – awarded in the form of two (2) x $1000 vouchers.
* One (1) rental of a luxury car (with a driver) for one evening valued at up to $500.00 – This component of the prize must be taken to coincide with and on the same date as the redemption of the dinner component of the prize. The car will be available to the winner for a maximum of five (5) hours, from the time of pick up to the time of drop off.
The dinner, the salon experience and the luxury car service are subject to booking availability at all times.
12. Total prize pool is $3,520.00. Any ancillary costs associated with redeeming any element of the prize are not included. These are the responsibility of the winner.
13. At the time of winner notification, the winner will be asked to select a date when they would like to redeem the prize. The promoter makes no guarantees that the prize can be taken on this date. All components of the prize are subject to availability at the time of booking. As indicated above, all variable components of the prize are determined by the promoter in its complete discretion.
14. Prize (with the exclusion of the David Jones vouchers which are valid until the date indicated on the voucher) must be redeemed in full by 19th April 2012. In the event that for any reason whatsoever the prize is not redeemed by this date, the prize will be forfeited by the winner and cash (or any other prize) will not be awarded in lieu of the prize being forfeited.
15. Any unused balance of any voucher or gift card will not be awarded as cash. Redemption of any voucher or gift card is subject to any terms and conditions of the issuer including those specified on the voucher or gift card. Vouchers are valid until the date indicated on the voucher or, if a date is not included on a voucher, until the date indicated by the Promoter. Redemption of the voucher prizes is subject to the terms and conditions stipulated on the voucher and the terms and conditions of the voucher supplier. The Promoter will not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
16. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the relevant salon or dinner component of the prize is postponed, cancelled, rescheduled or relocated for any reason whatsoever.
17. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
18. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to delivery of any prizes).
19. Entries not completed in accordance with the Terms and Conditions or received after the closing date will not be considered. Indecipherable or incomplete entries will be deemed invalid.
20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
21. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
