Conditions of Entry01. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia Travel Money Card MasterCard GRAMMY® Awards Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by the winner(s) is deemed as acceptance of these Conditions of Entry.
02. The Promoter is the Commonwealth Bank of Australia (ABN 48 123 123 124) of 201 Sussex Street, Sydney, NSW 2000. Telephone 13 22 21 (the “Promoter”).
03. The Promotion commences at 09.00 AEDST on November 14 2011 and closes at midnight AEDST on December 31 2011 (the “Promotion Period”).
04. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
* Are 18 years of age or over
* Are not employees of the Promoter
* Are not members of the immediate family of employees of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter)
05. To receive an automatic entry, you must satisfy the Eligibility Requirements and during the Promotion Period purchase a new Commonwealth Bank Travel Money Card and load it with at least AUD $1,500 (excluding any purchase fees).
06. If an individual does not wish to be automatically entered into the promotion, they should contact the Promoter on the details outlined above.
07. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.
08. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
09. There will be eight (
prize draws consisting of seven (7) weekly draws and one (1) overall main prize draw from all eligible entries. Entries included in each draw will be those received between 00.01 and midnight AEDST on the dates outlined in the table below. The computerised draws will be conducted by a representative of the Promoter at Commonwealth Bank, 201 Sussex Street, Sydney, NSW 2000 at 11.00 AEDST on the dates listed in the table below. Non-winning entries in each weekly draw will not be entered into subsequent weekly draws. All entries received during the Promotion Period will be entered into the main prize draw. Winners will be notified in writing within two (2) business days of the relevant draw and all winners will be published in the public notices section of The Australian newspaper on the dates specified in the table below.

10. There will be eight (
prizes. The first valid entry drawn in each weekly draw will each win AUD $1,000 reloaded to the weekly winner’s Commonwealth Bank Travel Money Card. The first valid entry drawn in the main prize draw win the major prize of a holiday to Los Angeles, USA for two (2) adults including Premium Economy return flights with V Australia from the winner’s closest capital city via Sydney, a Prepaid MasterCard, with currency preloaded to the value of USD$600, a new Commonwealth Bank Travel Money Card loaded with AUD $1000, return airport transfers, four (4) nights twin share hotel accommodation and breakfast daily for two (2), at the Beverly Wilshire Hotel, Beverly Hills, California, a private tour of the Hollywood Walk of Fame, makeover with a professional stylist and attendance at the 54th Annual GRAMMY Awards on February 10th 2012 at the STAPLES Center, as well as attending the official GRAMMY Celebration® after-party. Total major prize valued at up to AUD $23,000. The Prepaid MasterCard and 54th GRAMMY Awards tickets are courtesy of MasterCard. The winner of the major prize will be required to fly to Los Angeles, USA departing Sydney International Airport on VA1 at 14:40 AEDST on February 9th 2012 (landing in Los Angeles on February 9th 2012 at 09:30 local time), returning from Los Angeles on VA2 at 20:25 local time on February 13th 2012 (landing in Sydney on February 15th 2012 at 06:25 AEDST). If necessary, a winner will be flown to and from Sydney from their nearest capital city in order to board this flight.
11. The total prize value is up to AUD $30,000 based on the recommended retail value provided by the supplier and is correct at the time of printing.
12. Major prize is subject to the terms and conditions of booking, accommodation, carriage and use of any suppliers. Where they contradict these Conditions of Entry, these Conditions of Entry will prevail. Frequent flyer points will not form part of the major prize. The winner of the major prize may be required to present their credit card at time of accommodation check in.
13. All flight bookings are to be made via the agent that the winner is directed to by the Promoter. On behalf of MasterCard, Octagon will manage all other elements of the 54th GRAMMY Awards prizes and will contact the major prize winner on January 12th 2012. The 54th GRAMMY Awards prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
14. Unless expressly stated all other expenses including travel insurance, taxes (excluding airport/airline taxes), passports, visas, spending money, additional meals, beverages, optional excursions whilst using the prize, transfers to and from departure points, additional accommodation and insurance will be the sole responsibility of the major prize winner.
15. By acceptance of any prize, winners agrees to their names being published in the public notices section of The Australian newspaper on the dates outlined in the table above. Winners’ details will also be published on the Commonwealth Bank Facebook page (facebook.com/commonwealthbank) and on
www.commbank.com.au on the same dates.
16. By acceptance of the major prize, the major prize winner agrees to provide (via email) a minimum of ten (10) photographs and captions, taken whilst on the GRAMMY Awards holiday, to the Commonwealth Bank representative by February 13th 2012 (“Material”). The Material will be posted on the Commonwealth Bank Facebook page from February 14th 2012. The Commonwealth Bank will provide guidelines on the Material to the major prize winner on January 12th 2012 and the winner agrees to abide by these guidelines. The major prize winner agrees to licences the Promoter to use the Material in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. The winner warrants to the Promoter that the Material submitted is the original work of the entrant that does not infringe the rights of any third party. Winner agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Winner consents to any use of their Material which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
17. Prizes are not transferable or exchangeable and cannot be taken as cash. Upon notification of winning a weekly prize, Commonwealth Bank will arrange for AUD $1000 to be loaded onto the winner’s Commonwealth Bank Travel Money Card within twenty four (24) hours of the specified publication date.
18. The Promoter’s decision is final and no correspondence will be entered into.
19. The Promoter will use its best endeavours to provide the prizes listed. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute for that prize or item for a prize or item of an equivalent value subject to any written directions given under applicable trade promotion laws and regulations.
20. In the event that for any reason whatsoever the major prize winner does not take an element of the major prize at the time agreed by the Promoter then that element of the prize will be forfeited by the major prize winner and cash will not be awarded in lieu of that element of the prize.
21. The Promoter reserves the right to request that the winner demonstrates their eligibility for the prize as a condition of receipt of a prize. Identification considered suitable for verification is at the discretion of the Promoter.
22 If the major prize winner fails to claim their prize by January 19th, 2012 a draw for this prize will take place on January 20th 2012 at the same time and place as the original draw subject to any written directions from a regulatory authority. Winner will be notified in writing within two (2) business days of the draw and their name will be published in the public notices section of The Australian newspaper on January 27th 2012.
23. A draw for any unclaimed weekly prizes may take place on April 12th 2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners (if any) will be notified in writing within two (2) business days of the draw and their names will be published in The Australian on April 26th 2012.
24. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion, subject to the approval of all relevant State and Territory Lottery Departments. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
28. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions. 29. These Conditions of Entry shall be governed by the laws of Australia and each entrant agrees to submit to the non-exclusive jurisdiction of Australia.
