WIN A GASMATE V8 BBQ GRIL WORTH $999 (Kleenheat Gas Newsletter – Summer 2011)1. The promoter is Wesfarmers Kleenheat Gas Pty. Ltd. ABN 40 008 679 543 of Campus Drive (off Murdoch Drive), Murdoch WA 6150, (“Kleenheat Gas”).
2. Instructions on how to enter and other details contained within promotional, electronic and print materials form part of the terms and conditions. By participating in this promotion entrants shall be deemed to agree to abide by these terms and conditions. These Terms and Conditions prevail to the extent of any inconsistency with the terms and conditions set out in any such materials.
3. The promotion is open to Kleenheat Gas customers between 12pm Western Standard Time (WST) on 1 December 2011 and 12pm on 31 January 2012 in Western Australia, Northern Territory, South Australia, Queensland, New South Wales, Victoria, Australian Capital Territory and Tasmania. Entry is limited to one original entry form per person.
4. Only completed entry forms lodged at Wesfarmers Kleenheat Gas, Campus Drive, Murdoch WA 6150 prior to 12pm, 31 January 2012 are valid. Photocopies and facsimiles are not acceptable.
5. Entries must be received via mail, addressed in the Australia Post preferred way as indicated on each entry form.
6. Entries must be posted to the address as stated on the entry form to: Win A Gasmate V8 Grill, Wesfarmers Kleenheat Gas, PO Box 4184, Myaree Business Centre, WA 6960.
7. The competition commences 12pm, 1 December 2011 and ends 12pm, 31 January 2012.
8. The major prize is one Gasmate V8 Grill valued at $999. Prize is not redeemable for cash and is non transferable.
9. All prizes must be taken as offered and are not transferable or exchangeable for cash or other goods.
10. If the prize is unavailable despite Kleenheat Gas’ reasonable endeavours to obtain it within Australia, Kleenheat Gas reserves the right to substitute the prize with a different item with an equal or greater recommended value, subject to any written direction of any relevant State or Territory lottery authority.
11. The prize winners will be drawn at random from all completed and qualified entries received from Wesfarmers Kleenheat Gas in Murdoch. The first valid entry drawn will win the major prize. The draw will take place at Kleenheat Gas, Campus Drive, Murdoch, Western Australia at 2pm on 3 February 2012. The major prize winner will be notified by telephone and mail.
12. Details of the prize winners will be published in The Australian, issue dated 10th February 2012.
13. In the event that the prize remains unclaimed, they automatically forfeit the prize and, subject to any direction to the contrary from a relevant State or Territory lottery authority, an unclaimed prize draw will take place at Kleenheat Gas, Campus Drive,
Murdoch, Western Australia at 2pm on 3rd May 2012. In the case of this eventuality the unclaimed prize winner would be notified in writing and announced in The Australian, issue dated 16th May 2012.
14. Prizes winners must be 18 years of age or older.
15. Subject to compliance with regulatory requirements, the organisers reserve the right to alter or amend these Terms and Conditions any time without notice.
16. Employees (and the immediate families of employees) of Kleenheat Gas, its agencies and all organisations associated with the promotion and/or contributing the prizes, are ineligible to enter. For the purposes of the promotion, “immediate family” includes spouse, de facto spouse, parent, and natural, adopted or step child or sibling, whether or not they live in the same household as the employee.
17. To the maximum extent permitted by law, Kleenheat Gas shall not be liable for any delay, cancellation, accident, death, injury, damage, loss or liability whatsoever (including, but not limited to direct, indirect or consequential loss, damage or liability) relating to any property or person arising out of or in connection with this competition, or with any defect in or unsuitability of any prizes. This clause does not apply to limit any guarantees, conditions or warranties implied or applied by the Competition and Consumer Act 2010 (C’th) – to the extent that guarantees, conditions or warranties are implied or applied by the Competition and Consumer
18. Act (or any other law which cannot be excluded) then, to the maximum extent permitted by law, Kleenheat Gas limits its liability in relation to any breach of such implied condition or warranty to the replacement of goods supplied, or supply of equivalent goods.
19. In the event of a dispute regarding these Terms and Conditions, the decision of the General Manager of Kleenheat Gas will be final and binding and no correspondence will be entered into. All entries remain the property of Kleenheat Gas. All competition winners consent to Kleenheat Gas using their name and photograph for publicity purposes.
20. Kleenheat Gas respects your rights under the Privacy Act (C’th) and complies with the National Privacy Principles. The names and addresses of entrants will be collected by Kleenheat Gas for the purpose of conducting the competition and will also be entered into a database for the future purpose of offering Kleenheat Gas products and services. At any time, should entrants wish to gain access to their personal information, be removed from this database or stop receiving direct marketing material from Kleenheat Gas they can contact Kleenheat Gas on 13 21 80. www.privacy.gov.au21. On-road costs such as registration and insurance is not included in the prize and is the responsibility of the winner (except in Victoria where initial on-road costs are part of the prize).
22. The Terms and Conditions also operate for the benefit of the supplier of any goods in relation to the promotion.
