 Terms and Conditions
 
1. This competition (the “PROMOTION”) is conducted by NBC Universal Global Networks Australia (Services) Pty Ltd (“NBCU”) ABN: 76 103 226 026 of 5 Thomas Holt Drive, North Ryde, NSW, 2113 (the “PROMOTER”).
 
2. The Promotion is a game of chance, and skill plays no part in determining the winners.

3. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
 
4. The Promotion is only open to eligible entrants (the “ENTRANTS”), being individuals who are:

a) permanent residents of Australia; and
 b) are a FOXTEL, AUSTAR, Optus TV featuring FOXTEL, or FOXTEL from Telstra subscriber, or live in a household with a FOXTEL, AUSTAR, Optus TV featuring FOXTEL, FOXTEL from Telstra subscription and have the subscriber’s permission to enter the Promotion; and
 c) are over the age of 18;

and are not:
 
d) employees of the Promoter, FOXTEL, AUSTAR, Optus TV featuring FOXTEL, FOXTEL from Telstra, the supplier (the “SUPPLIER”), or an employee of these companies’ related corporations or agencies or any other company associated with the Promoter and the Promotion; or
 e) a spouse, de facto spouse, parent, child or sibling (whether natural or by adoption) of such an employee. 

5. Entry to the Promotion commences at 00:00hrs on Tuesday 3 January 2012 and closes at 23:59hrs on Monday 30 January 2012 (the “PROMOTION PERIOD”). All times and dates are times and dates in Sydney, which may be AEST or AEDT depending on the date. All times are stated using the 24 hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day. There will be weekly entry periods as outlined below:

6. The competition will be advertised on 13th STREET and on the website www.13thstreetuniversal.com.au

7. To enter the Promotion during one of the entry periods outline in Clause 5, an Entrant must:
 
a) Watch 13th STREET (channel 113) to collect the advertised weekly code word;
 b) SMS their full name, State, and corresponding weekly code word to 1971 1913 (the “SMS NUMBER”);
 or
 c) Call 1900 966 334 (“the PHONE NUMBER”) and leave their full name, state, daytime phone number and the corresponding weekly code word;
 or
 d) Log onto www.13thstreetuniversal.com.au and register their details including (but not limited to) name, address, phone number, e-mail address and the corresponding weekly code word.

8. Inaudible, illegible, incomprehensible and incomplete entries will be deemed invalid.
 
9. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the SMS number. Entrants should check with their individual service provider in this regard.
 
10. 190/SMS cost is $0.55 (including GST). Higher rates apply to calls to the 190 number from mobile phones. Service not available from payphones. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.

11. SMS entries sent using the internet or sent by computer generation are invalid and will not be accepted.
 
12. Entrants in the competition may enter as many times as they like. However, only one prize per household is permitted (SA residents are entitled to win more than one prize).  A Weekly Prize winner is also eligible to win the Major Prize.
 
13. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
 
14. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
 
15. Entries must be received by the times and dates indicated in CHART A.  The time of entry will in each case be the time the telephone call, SMS or online entry is received by the Salmat IDR database. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account are invalid and will not be accepted.
 
16. Any entry that is made on behalf of an Entrant by a third party will be invalid.
 
17. There will be one Major Prize Winner. The Major Prize is a trip for 2 people to Vancouver, Canada and includes:

• Return economy airfares (including taxes) for the winner and their travel companion, from the winner’s nearest state capital city to  Vancouver, Canada, valued at a maximum of $6,680.00
• Return shuttle transfers from airport/hotel for the winner and their travel companion, valued at a maximum of $380.00
 • 5 nights’ accommodation in a 4 star hotel in Vancouver CBD (in a standard room, twin share), valued at a maximum of $1890.00
 • A four hour City Tour for for the winner and their travel companion, valued at a maximum of $300.00
 • Entry the winner and their travel companion to the Vancouver Police Museum including a 2 hour ‘Sins of the City’ walking tour, valued at a maximum of $120.00
 • Tickets to Vancouver Aquarium for the winner and their travel companion, valued at a maximum value $530.00
 • A full day tour to Whistler for the winner and their travel companion, valued at a maximum of $100.00
 
The Major Prize Pool is valued at a maximum of $10,000.00
 
18. There are four Weekly Prize Winners. The Weekly Prize is 1 x iPad 2 with Wi-Fi 16GB (in either Black or White), valued at a maximum of $526.36
 
Total Weekly Prizes valued at a maximum of $2,105.44
 
19. Total Prize Pool is valued at a maximum of $12,105.44
 
20. Prize values are in Australian Dollars and are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

21. Prizes cannot be transferred, exchanged or redeemed for cash.
 
22. The winner and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.  Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
 
23. The winner and their travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide, Perth, Hobart, Canberra or Darwin.).

24. The prize must be taken by 1 February 2013 and is subject to hotel and flight availability. Travel must be booked within two months of the winner being notified of their prize. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made.
 
25. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule.  Frequent Flyer points are not available from any airline.
 
26. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
 
27. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.
 
28. NBC Universal Global Networks Australia (Services) Pty Ltd, Salmat IDR Pty Limited and Granted Worldwide make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
 
 29. Unless expressly stated in these terms and conditions all other become the responsibility of the winner.
 
30. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
 
31. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
 
32. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
 
33. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize, at no cost to the Promoter.

34. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with any media or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
 
35. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
 
36. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
 
37. The Weekly Prize Winners will be drawn at random from the valid entries received during each entry period on the dates and times as outlined Clause 5 (1 Weekly Prize Winner per week, 4 Weekly Prize winners in total).  The draws will take place at Salmat IDR, Level 2, 116 Miller St, North Sydney 2060. The Weekly Prize winner will be notified in writing and by phone within 2 days of the draw. The Weekly Prize Winners will be published in the Public Notices section of The Australian newspaper on Wednesday 8 February 2012.
 
38. The Major Prize Winner will be randomly selected from all valid entries received during the entire promotion period by Salmat IDR, Level 2, 116 Miller St, North Sydney 2060 at 10:00hrs (AEDT) on Wednesday 1 February 2012. The Major Prize Winner will be notified in writing and by phone within 2 days of the draw. The Major Prize Winner will be published in the Public Notices section of The Australian newspaper on Wednesday 8 February 2012.
 
39. Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat IDR Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 on Tuesday 1 May 2012 at 10:00 (AEST). The Winners will be notified in writing and by phone within 2 days of the draw. The Winners will have their details published in the Public Notices section of The Australian newspaper on Tuesday 8 May 2012.

40. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.

41. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder). 

42. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

43. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
 
44. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
 
45. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
 
46. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
 
47. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.  The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
 
48. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
 
49. NBC Universal Global Networks Australia (Services) Pty Ltd, Salmat IDR and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
 
50. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
 
51. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. 

52. STANDARD OPT-IN: All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
 
53. Salmat IDR, on behalf of NBC Universal Global Networks Australia (Services) Pty Ltd, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat IDR for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
 
54. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
