1. Competition

1.1. By entering the "Win an Evocities iPad 2" Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of the Conditions of Entry.

1.2 The promoter of the competition is SHJ, ABN 67 617 073 688, Level 3, 63 York Street, Sydney 2000 (Promoter).
2. Who may enter

2.1. Entry into the Competition is open to all permanent residents of Australia aged 18 years or over.

2.2. Each participant may only submit one entry in the Competition.

2.3. The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter, its related corporations (including the councils of Albury, Armidale, Bathurst, Dubbo, Orange, Tamworth and Wagga Wagga) and associated agencies are not eligible to enter the Competition. 
3. Competition Period

3.1 The Competition commences at 9:00am Australian Eastern Standard Time (AEST) on Tuesday 10 January 2012 and closes at 6:00pm AEST on Thursday 23  February 2012 (Competition Period). .

3.2 Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win.
4. How to enter

Eligible participants must, during the Competition Period:

(a) Click “Like” on one or more of the seven Evocities and;

(b) Be a fan of one of the Evocities Facebook pages on the closing date of the competition and:  (b) Visit www.evocities.com.au/facebook, enter and submit all details requested and:

(c) Correctly answer the following question: “Name the seven Evocities
5. Final conditions and winner notification

5.1 This is a game of skill. Chance plays no part in determining the winner.  The first correct entry drawn will be deemed the winner and be awarded first prize. The second correct entry drawn will be deemed the runner up and be awarded the runners up prize.

5.2 The judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judges' decision will be final and no correspondence will be entered into.

5.3 All entries become and remain the property of Evocities.

5.4 Evocities assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alterations of entries, and reserves the right to take any action that may be available. If for any reason this competition is not capable of running as planned, due to causes including, but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the rights in its sole discretion to disqualify any individual who tampers with the entry process,  take any action that may be available, and to cancel, terminate, modify or suspend the competition.

5.5 All details of the entrants will be used and preserved in accordance with the National Privacy Principles.   

5.6 Judging will be conducted by a representative of the Promoter at Level 3, 63 York St, Sydney NSW 2000 at 9:00am AEDT on Friday 24 February 2012 (Draw Date).

5.7 The first entry drawn and judged as correct will win a 32GB Wi-Fi + 3G iPad 2 with the Evocities website address engraved on the back (valued at $839.00);

5.8 TThe first entry drawn and judged as correct will win an Evocities gift basket valued at approximately $350, including;

Gourmet hamper of local produce from the Albury area, including:
Cofield Sparkling Wine, Table Top dried figs, Trentham Tucker lavosh, Jim Jam quince paste, Jim Jam fig paste, 2 x wooden pate knives

5.9 The total combined prize value is $1,189 (including GST).

5.10 The first and second prize winners will be notified via email on Friday 24 February 2012. The first prize winner’s name will be published in the Public Notices section of The Australian newspaper on Friday 2 March 2012. The Promoter accepts no responsibility for any variation in the value of a prize. Prizes are not transferable or exchangeable. Prizes are not redeemable for cash or kind and must be taken as offered. In the event that any element of the prize is not available, the Promoter reserves the rights to substitute a prize of equal or greater value, subject to written directions from State regulatory bodies.

5.12 The prize winner is responsible for all expenses not specified in these Conditions of Entry.

5.13 The prize winner acknowledges that the prize may be subject to additional terms and conditions imposed by third party prize suppliers. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. The Promoter does not accept responsibility and is not liable for any additional conditions imposed on the taking of the prize or the breach of those conditions by any person.

5.14 If for any reason the prize winner does not take an element of the prize during the stated period and on the conditions stipulated by the Promoter or any third parties, then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize.

5.15 No single prize will be valued at over AUD$1,000 and the total prize value of the promotion will not exceed AUD$100,000.
6. Information for prize winner

All entrants agree to provide the Promoter or the Promoter’s authorised agent with identification and/or proof of age if selected as a prize winner. By accepting a prize, the prize winner agrees to the release set out below. The form of identification and/or proof of age are at the discretion of the Promoter.
7. Release

To the full extent permitted by law, the Promoter and its associated companies and agencies and any of their personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition or prizes, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter and their associated companies and agencies and any of their personnel; (iii) any liability for personal injury or death.
8. Limitation of Liability

8.1 The Promoter makes no representation or warranties as to the quality, suitability or merchantability of any of the goods or services offered as the prize. If the Promoter is liable for any claim by a prize winner, including a claim arising from the Promoter’s negligence, the Promoter’s liability for any such claim will not exceed the value of the prize won as set out in these Conditions of Entry.

8.1 The Promoter is not liable for the cancellation of all or any part of the prize, for any reason.

9 Privacy

By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant’s personal information to assist in conducting the Competition or communicating with the entrant regarding special offers from the Promoter. Entrants in the Competition acknowledge that the Promoter may share an entrant’s personal information with the Promoter’s Australian related entities which may contact the entrant with special offers. If an entrant elects to receive information from third parties, the Promoter may also disclose the entrant’s personal information for that purpose. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). The Promoter’s Privacy Policy is available at http://www.evocities.com.au/footer/privacy. Entrants can access the personal information the Promoter holds about them, notify the Promoter that they do not wish the information to be disclosed or notify the Promoter that they do not wish to receive further promotional material by writing to the Promoter at SHJ, Level 3, 63 York Street, Sydney 2000 (Promoter).

10 General

10.1 All entries must be original to and created solely by the entrant. All entries into the Competition and all copyright and other rights in such entries and/or other materialsbecome the property of the Promoter and will not be returned. Each participant agrees to provide a written assignment of all rights to the Promoter if requested. By submitting an entry into the Competition and any other materials (other than any personal information) to Promoter in connection with the Competition, each participant:

(a) specifically authorises Promoter to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, whether currently in existence or developed in the future, and alone or together or as part of other information, content and/or material of any kind or nature; and

(b) represents and warrants that all elements contained in the Competition entry or other material:
(i) are original to the participant and fully cleared for use as contemplated in these Conditions of Entry; (ii) do and will not, in any way, violate or breach any of the terms of any other agreement the participant may be a party to; (iii) do not contain defamatory, tortious, or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right, or contain any matter the publication or sale of which will violate any federal or state statute or regulation; (iv) are not obscene or in any other manner unlawful or likely to cause offence; (v) are not in any way cruel nor abusive; and(vi) will not require the Promoter to pay or incur any sums to any person or entity as a result of the Promoter’s use or exploitation of the same; and

(c) unconditionally and irrevocably consents to any act or omission which would otherwise infringe any of their moral rights in the entry and waives all moral rights in the entry that arise outside Australia.

10.2 The Promoter’s decision is final and binding. No correspondence will be entered into.

10.3 The prize remains the property of the Promoter until it is collected by the selected prize winner or unclaimed prize winner as the case may be.

10.4 If for any reason the Competition is not capable of running as planned due to any causes beyond the Promoter’s control, including infection by computer virus or bugs, tampering, technical failure, emergency or disaster, the Promoter reserves the right in its sole discretion to cancel, modify, terminate or suspend the Competition, subject to written directions from State regulatory bodies.

10.5 The Promoter reserves the right to disqualify any individual who conspires with others to gain an unfair advantage or who is otherwise involved in manipulating, interfering or tampering with the entry process or any other element of the Competition. The use of any automated entry software or any mechanical, electronic or other means which allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

10.6 Neither the Promoter nor its authorised agents will take responsibility for lost, ineligible, misdirected or late entries due to technical reasons, telecommunications issues or any other reason. Entries that are not genuine, are incomplete or late or are in any way fraudulent will be declared void.

10.7 Prize winners are responsible for all taxes (excluding GST) which may be payable as a consequence of receiving a prize.
11 Contact details

11.1 It is the entrant’s responsibility to inform the Promoter of any change to the entrant’s contact details, including their email address.
