Australian Open 2012 Semifinal Tickets Promotion
Conditions of Entry
1 Information regarding prizes and how to enter the competition forms part of these conditions. By entering, entrants accept these conditions.
2 Entry to the competition is open only to Australian residents aged 18 or over except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this promotion.
3 The competition will be conducted between 12:00 pm AEST on 16/01/12 and 12:00 pm AEST on 23/01/12 (“Competition Period”), with judging between 12:01 pm AEST on 23/01/12 and 10:00 am AEST on 24/01/12. Winner will be announce after 10:00 AM AEST on 24/01/12.
4 To enter the competition, entrants must comply with the following:
(a) Visit www.facebook.com/virginaustralia during the Competition Period and click on the competition tab.
(b) Complete the registration form in full and submit via the competition tab: Send us a creative photo that includes a tennis ball in it, and you could win a trip to see the Australian Open Semifinal in Melbourne!
© Non-original submissions will be deemed invalid, so be original!
5 There is no limit to the amount of entries per person, as long as each submission is substantially unique. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise.
6 Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion. Promoter will not advise entrant if their entry is deemed invalid. If the winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and the relevant prize will be re-awarded in accordance with the relevant clause of these conditions of entry as if the discarded entry had not been received. This is a game of skill; chance plays no part in determining the winners. Each entry will be individually judged by the Promoter’s judges. When the judging period begins, the Promoter’s judges will choose the winning submission based on, among other things, originality, creative merit and relevance. All entries deemed to meet these conditions will be deemed a valid entry. The Promoter’s judges’ decisions are final and no correspondence will be entered into.
7 All entries become the property of the Promoter and will not be returned to the entrant. Each submission must be the entrant’s original work. By entering this competition entrants:
(a) consent to the Promoter making copies of or publishing the whole or any part of their entry (including the submission) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purposes; and
(b) undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights and to the extent relevant obtained unconditional, genuinely given, irrevocable written consent from each individual author to any acts or omissions of the entrant or Promoter which might otherwise infringe the ‘Moral Rights’ (as defined in the Copyright Act 1968 (Cth) as amended from time to time) of the individual authors.
8 The entrant:
(a) assigns all ‘Intellectual Property Rights’
(which means all registrable and non-registrable industrial and intellectual property rights throughout the world including but not limited to copyright, patent, trade mark and design) in the entry photograph to the Promoter. If requested by the Promoter, the entrant must bring into existence, sign, execute or otherwise deal with any document to enable the vesting of the Intellectual Property Rights contemplated by this clause in the Promoter; and
(b) gives an unconditional, irrevocable consent to any acts or omissions of the Promoter which might otherwise infringe their Moral Rights.
9 Prize: There is one prize to be won. At the end of the Competition Period, the winning entry, will receive 2 tickets to the Australian Open 2012 Men’s Singles Semifinal on Thursday 26 January 2012, return economy flights for 2 people on Virgin Australia from the winner’s nearest Virgin Australia port to Melbourne at a time specified by the Promoter and 1 night’s standard room accommodation in a 4 star hotel in Melbourne. Ground transfers are responsibility of the winner. Should the winner be from Melbourne and not require flights, a flight voucher for return economy flights for 2 people to be used within the Virgin Australia domestic network will be issued with a validity of 6 months from date of issue; subject to the terms displayed in the voucher. The prize is valued at $1,600. Further terms and conditions may apply to the prize. Winner is responsible for any additional costs or expenses associated with the prize.
10 The winner will be notified by phone and/or email on 24/01/12.
11 Winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
12 The Promoter may require winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
13 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.
14 Prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
15 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition (including but not limited to the functioning of the competition website) or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
16 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
17 If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
18 If the Promoter is unable to make contact with the winner within 24 hours of announcement, the winner’s entry will be deemed invalid and the prize will be re-awarded to the next best valid entry.
19 The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
20 The information entrants provide will be used by the Promoter for the purpose of conducting this competition and otherwise in accordance with the Promoter’s Privacy Policy (available at http://www.virginaustralia.com/Privacy/index.htm#useanddisclosure). The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
