“MCDONALD’S AND IT’S A KNOCKOUT BRINGING YOU
REAL SUMMER FUN” PROMOTION
TERMS AND CONDITIONS

    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Entry is via the Internet only.
    Entry into the promotion is only open to Australian residents aged 18 years or over (Entrants). The directors, management and employees (and their immediate families) of the Promoter, its related entities, corporations, franchisees and agencies associated with this promotion are ineligible to enter the promotion.
    Promotion commences at 9.00am (AEDT) on 09/01/2012 and entries close 9.00am (AEDT) on 30/01/2012 (Promotional Period).
    During the Promotional Period, entrants must enter the promotion by logging on to the “MCDONALD’S® REAL SUMMER FUN” application on the Facebook Platform. Entrants can locate the “MCDONALD’S® REAL SUMMER FUN” application on the “REAL SUMMER FUN” tab on the McDonald’s Australia Page on Facebook (www.facebook.com/mcdonaldsau).
    Entrants must “Like” the McDonald’s Australia Page and agree to accept the “MCDONALD’S® REAL SUMMER FUN” application. Entrants must use the MCDONALD’S® REAL SUMMER FUN” application to answer the promotional question, when prompted, (in 25 words or less), “What’s your favourite family moment?”. Entrants have the opportunity to upload one (1) photograph when completing their entry. Photographs must be in one (1) of the following formats: jpeg, gif or png and must not exceed 30MB in file size. Upon completion of the above, entrants must complete and submit (in full) the online entry form in the manner required during the Promotional Period. For the removal of doubt, entries will be judged on the creative and literary merit of the answer provided to the question only, and any photograph submitted with an entry will not influence the judging of the entry.
    Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
    Without limiting the generality of the above, entries must not contain any material determined by the Promoter in its absolute discretion to be obscene, offensive or inappropriate. The Promoter will review each entry/photograph for suitability to appear in the application. The Promoter may then upload the entry/photograph to appear in the application. The Promoter reserves the right, at any time, to refuse to accept any entry/photograph or remove any entry/photograph from display that it deems, in its absolute discretion, to be obscene, offensive or inappropriate, or infringing upon the rights of any third party.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    Incomplete, inaccurate, erroneous, ineligible, incomprehensible or indecipherable entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
    Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements. Only one (1) prize permitted per entrant.
    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    This is a game of skill and chance plays no part in determining the winners. There will be one (1) round of judging for each week of the Promotional Period (3 in total). Entries for each weekly round of judging close at 9.00am AEDT on 16/01/2012, 23/01/2012 and 30/01/2012.
    In each round, each entry will be individually judged based on creative and literary merit. The judging of each round will take place from 10.00am AEDT on 16/01/2012, 23/01/2012 and 30/01/2012. All judging will take place at 32 Pyrmont Bridge Road, Pyrmont NSW 2009.
    Non-winning entries in each round will be submitted into further rounds. The judges reserve the right to select additional reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.
    Winners will be notified by telephone and mail. The Promoter’s decision is final and no correspondence will be entered into.
    The best valid entry in each round, as determined by the judges, will each win a trip for two (2) adults and two (2) children (aged 3-13 years of age) to the Gold Coast, QLD, valued at up to $3,629.96 depending on date and point of departure. Prize includes return economy airfares from winner's nearest capital city to the Gold Coast, QLD (if necessary), airport transfers to Sea World, five (5) nights twin share accommodation at the Resort Room at Sea World Resort, a Dolphin Discovery presentation valid for one (1) morning of their stay and four (4) Super Passes (valid at Sea World, Wet n’ Wild and Movie World). If a winner is from the Gold Coast, QLD, then the prize does not include airfares or airport transfers, and the airfare component and airport transfers component of the prize is not redeemable for cash. Spending money, additional transfers, meals, taxes, insurance, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs are not included. The prize must be taken by 30/06/2012 and is subject to booking and flight availability. The prize cannot be taken during gazetted Australian school holidays in any State or Territory, public holidays or peak periods. The prize must be taken for five (5) consecutive nights and cannot be taken on a Saturday night. For the removal of doubt, the prize must be taken from either a Monday – Friday, or a Sunday – Thursday. Notice of intent to travel must be received in writing to the Promoter at least thirty (30) days prior to proposed travel dates.
    During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
    Winners and their companions must depart from and return to the same departure point and travel together. The itinerary will be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The winner of the prize must adhere to the standard terms and conditions of individual prize and service providers. Winners may be required to present credit card at time of accommodation check in.
    Any ancillary costs associated with redeeming a Super Pass are not included. Any unused balance of a Super Pass will not be awarded as cash. Redemption of a Super Pass is subject to any terms and conditions of the issuer including those specified on the Super Pass.
    The Super Pass prizes are subject to venue and ticket terms and conditions, including any applicable age restriction. The Promoter and venue organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication and inappropriate behaviour whilst participating in any element of the prize.
    If any prize (or part of any prize) is, or becomes unavailable for any reason beyond the Promoter’s reasonable control, the Promoter, in its absolute discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal or greater value and/or specification.
    Total prize pool value is up to $10,889.88.
    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. It is a condition of accepting a prize that the winner may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
    Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
    The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
    Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    All entries (which shall include photographs) submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
    Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, franchisees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) participation/use of a prize.
    The Promoter collects personal information in order to conduct the promotion and entrants consent to the Promoter, for this purpose, to disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. By entering into the promotion, an Entrant acknowledges and agrees that the Promoter may use the Entrant’s personal information in the manner set out in this promotion. Entrants consent to the Promoter at the Promoter’s election to, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages (SMS Short Message Services), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing not or in the future or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at PO Box 392, Pennant Hills NSW 2120. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.

Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions.     The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
