CONDITIONS OF ENTRY

BAILEYS® Catch-Up Promotion – Game of Skill

1. Information on how to enter and the prizes form part of these Conditions of Entry. Participating in this promotion is deemed acceptance of these Conditions of Entry.

Entrants

2. Entry is only open to Australian residents who are aged 18 years or over. Employees and contractors and their immediate families of the Promoter and their agencies associated with this promotion are ineligible to enter.

How to Enter

3. The promotion commences on 1 December 2011 at 11.00am and closes on 29th February 2012 at 11:59pm (“Promotion Period”). All times indicated are AEDST. Any entry received after the closing date will be invalid. Proof of sending is not proof of receipt. The Promoter does not accept any responsibility for late or lost entries due to delays or malfunctions of the Internet; misdirected entries; any problems, delays or technical malfunctions of any telephone, broadband or other network or of lines, computer online systems, servers, computers, or other equipment or software; failure of any entry to be received; or any damage to the entrant’s or any other person’s computer, other equipment or software resulting from participation in the competition.

4. Desktop users –To enter the promotion, users must visit and ‘like’ the Baileys Australia Facebook page (www.facebook.com/BaileysAustralia), click on the “Catch Up & WIN” app link then click on the “Enter Competition” link to get to the registration and image upload form. To enter the promotion, they must complete their details (name, email address, phone number and date of birth), upload their photo (ticking the boxes to confirm it complies to the requirements outlined) and agree to these Terms & Conditions.

OR

Mobile users –To enter the promotion, users must visit the Baileys Australia Facebook page (www.facebook.com/BaileysAustralia), click on the “Catch Up & WIN” app link, then click “Enter Competition” link to get to the “Your Information” form. On the “Your Information” form, enter the following details: name, email address, phone number and date of birth; tick the boxes to confirm their photo complies to the requirements outlined, agree to these Terms & Conditions and then click the “Continue” link. Users will then be supplied with a Baileys Catch-Up email address which they must send their photo to in order to complete their entry. The user will then receive a follow up email confirming their entry has been successfully received and will be provided with a link to their photo on the Baileys Australia facebook page.

5. The photo submitted must comply with the following requirements:

(a) The photo must contain an image of two or more people, the entrant and at least one other friend and must feature the Baileys product – either in liquid or bottle form.
(b) The entrant must confirm that all persons in the photo are of legal purchase age for alcohol or older (= 18 years or older in Australia).
(c) The entrant must confirm they have obtained consent from all persons in the photo to upload the photo as part of this promotion.
(d) The photograph must be an original, unmodified digital camera image which complies with the Facebook requirements for the upload of photographs. No print or film submissions will be accepted for entry into this competition.
(e) Obscene, provocative, inappropriate, offensive or otherwise objectionable content will not be considered and any such entry will be deemed invalid, and such determination is solely at the discretion of the Promoter. An entry will be deemed invalid if, in the Promoter’s opinion, it encourages excessive consumption or irresponsible use of alcoholic beverages, or otherwise is not compliant with applicable laws, or Diageo’s Marketing Code and responsible drinking policies.
(f) By entering the competition, the entrant acknowledges and warrants that the submitted photograph is an original work created solely by themselves or on their behalf and that no party other than the entrant has any right, title, claim, or interest in the photograph.


6. A maximum of two (2) entries is allowed in each entry/judging period (month) per entrant and each must be from different days and events.

7. Online entries must be made by the authorised account holder of the email address submitted at the time of entry. “Authorised account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.

8. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.

9. An entry will be invalid and void if the entry (including the entered photograph) does not comply with these conditions or if, in the Promoter’s reasonable belief, the entry is incomplete, damaged, irregular, altered, produced in error, or obtained through fraud or theft.

10. Entries and material submitted in connection with any contest (whether in written, audio, electronic or visual form, or a combination of those) become the property of the Promoter which may use the material in any medium (including internet) and in any reasonable manner it sees fit. All present and future copyright in any such material becomes and remains the sole property of the Promoter. Entrants undertake to the Promoter that their entry is not in breach of any third party intellectual property rights.

Awarding of Prizes

11. There will be three entry & judging periods:
(a) December: Entries received between 11am on 1st December 2011 and 11:59pm on 31st December 2011 will be judged over the next two working days following the end of the month. One winner will be selected and notified by email on the 4th of January 2012.
(b) January: Entries received between 11am on 1st January 2012 and 11:59pm on 31st January 2012 will be judged over the next two working days following the end of the month. One winner will be selected and notified by email on the 2nd of February 2012.
(c) February: Entries received between 11am on 1st February 2012 and 11:59pm on 29th February 2012 will be judged over the next two working days following the end of the month. One winner will be selected and notified by email on the 2nd of March, 2012.

12. The winning entry for each period will be selected by a panel of four judges who are members of the Baileys team, employees of the promoter and their agencies. The winning entry will be selected on the basis of its creative merit (taking into account originality, artistic skill, manner of use of the BAILEYS® product and style). The judges’ decision is final and no correspondence will be entered into.

13. The winner for each period will have their name published in the newsfeed of the Baileys Australia facebook page by the 15th of the month following the judging period.

14. There will be three winners in total, one for each period. Each winner must choose one of the following prizes:
(a) A Year’s Supply of Baileys to share with their friends (defined as 12x700ml bottles of Baileys Original Irish Cream, the equivalent of 1 bottle per month). The prize will be delivered in one delivery and the winner will be required to provide a copy of their ID to the Promoter. ID will be required to be presented in order to receive the delivery. If the winner is not present at the time of delivery, the delivery may be held at the delivery depot/post office and the winner will be required to pick it up. Prize valued at AUD $371.88 RRP incl. GST.
(b) 2 x night’s of Babysitting. Each night consists of 4 hours onsite childcare at the winner’s home for up to 4 children over 1 year old and apply for any normal weekday or weekend day. This prize is not available on public holidays. Services are supplied by Dial An Angel. More information on their services can be found at www.dialanangel.com. Any additional hours or services not defined here will be at the winner’s expense. The use of these services is subject to the terms and conditions of the third party (Dial-An-Angel Pty Limited) and the Promoter is in no way responsible for the services provided. Prize valued at AUD $404.40 RRP incl. GST.
(c) A $350 Restaurant Voucher to a restaurant/cafe/food venue of the winner’s choice. If the winner’s chosen venue is unable provide a voucher or credit, the Promoter reserves the right, at its discretion, to choose an alternative restaurant in a nearby location to the winner’s place of residence or provide a Visa Debit card to the value of $350. Redemption of the prize is subject to the terms and conditions of the third party. Prize valued at AUD $350 RRP incl. GST.

15. The total prize pool of the promotion is valued at up to AUD $1,213.20 incl. GST.

16. Prizes must be claimed and choice of prize confirmed by 9.00am on the 15th of each month after the corresponding monthly promotion. If a prize remains unclaimed by such date and time, the Promoter may conduct such further draws at the same place as the original draw as are necessary after 9.30am on the 15th of the month in order to distribute any unclaimed prizes. Unclaimed prize draw winners will be notified by email.

17. Prizes are not transferrable or redeemable for cash.

18. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law.


Miscellaneous

19. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.

20. The Promoter advocates responsible drinking. Legal aged consumers are advised to visit www.alcoholguidelines.gov.au for information on responsible drinking, standard drinks and related issues.

21. By entering this competition, the entrant will be deemed to have accepted these rules and to agree to be bound by them. Failure to abide by any of these rules will disqualify them from taking part in the competition and the entry will be deemed invalid.

22. The Promoter is Diageo Australia Limited (ABN 33 004 167 720) of 162 Blues Point Road, McMahons’ Point, NSW 2060.
