Valid for first time participants only. Valid only at Tennis Australia registered Cardio Tennis Coaches (listed on Find A Cardio Tennis Coach). Valid for local residents 16 years or older only. Voucher is only for the person named on the confirmation email and can only be used once. Valid at times which are made available by the Cardio Tennis Coach. Not valid with any other offer. Valid only where voucher is redeemed. Vouchers that have been photocopied, altered or damaged cannot be accepted. Vouchers are not transferable. The free trial offer must be mentioned when booking the Cardio Tennis workout. Cardio Tennis free workouts minimum is 30 minutes. Must be used by 30 June 2012. TERMS AND CONDITIONS OF REGISTRATION AND PARTICIPATION

“GET IN THE ZONE” ACTIVITIES ON GRAND SLAM OVAL AND AT THE FEDERATION SQUARE LIVE SITE DURING AUSTRALIAN OPEN 2012 (the “Cardio Tennis Activities”)

As a participant in, or the parent/legal guardian of a participant in the Cardio Tennis Activities conducted by Tennis Australia Limited (Tennis Australia) at or during Australian Open 2012  , you must agree to the following terms and conditions.  If you do not agree to those terms and conditions you should not register yourself/ your child/ward to participate in the Cardio tennis Activities.  Your registration or the registration of your child/ward to participate in the Cardio Tennis Activities  and/or your/ your child/ward’s participation in the Cardio Tennis Activities  will be deemed an acceptance of all of these terms and conditions.

Requirements of participation

1. If under 18, each participant in the Cardio Tennis Activities must be accompanied by a parent/legal guardian at all times.

2. Each participant, and if under 18, their parent/guardian agree to comply with and be bound by Tennis Australia’s policies and procedures as advised by Tennis Australia from time to time.

Consent to use of image

3. Each participant, and if under 18, their parent/legal guardian consents to Tennis Australia:

a. taking, retaining, reproducing and using their image or likeness in Tennis Australia publications whether hard copy, electronic or online (including but not limited to Tennis Australia’s Facebook page and websites); and

b. its Member Associations and commercial sponsors and suppliers, taking, retaining, reproducing and using their image or likeness in any promotional, advertising or marketing or other materials, including, but not limited to, hard copy, electronic and online publications, without any notice or compensation to them or their assigns.

4. Each participant and if under 18,  their parent/legal guardian acknowledge and agree that all photographs, video footage, television footage, electronic images, sound recordings, and other records that are obtained by or on behalf of Tennis Australia and include their image, voice or likeness, shall remain the property of Tennis Australia.

Consent to medical treatment and transport

5. Each participant, and if under 18,  their parent/legal guardian acknowledge and agree that tennis is a physical sport and that there is risk of injury involved in participating in the Cardio Tennis Activities and authorise any director, officer, employee, official, agent or representative of Tennis Australia to obtain on the  participant and/or their parent/legal guardian’s behalf and at the parent/legal guardian’s expense any medical assistance, treatment and transport as deemed reasonably necessary.

Fitness to participate

6. Each participant, and if under 18,  their parent/legal guardian declare that the participant is medically and physically fit and able to participate in the Cardio Tennis Activities.  Each participant, and if under 18, their parent/legal guardian will immediately notify Tennis Australia of any change to the participant’s medical condition, fitness or ability to participate.  Each participant, and if under 18 their parent/legal guardian  understand that if Tennis Australia were not provided with all relevant and necessary information about the participant’s health and capacity it would not be able to fully appreciate the risk of harm or injury to the participant in providing instruction and in allowing the participant to participate in the Cardio Tennis Activities.  Each participant, and if under 18,  their parent/legal guardian understand that Tennis Australi will continue to rely upon this declaration as evidence of the participant’s fitness and ability to participate.

Privacy

 7. All registrations are the property of the Tennis Australia.

8. By registering to participate in Cardio Tennis Activities, each participant and if under 18,  their parent/legal guardian understands and agrees that Tennis Australia may use and disclose the information provided as part of the registration process, including the participant’s and/or their parent/guardian’s personal information, to administer the Cardio Tennis Activities. The participant, and if under 18,  their parent/legal guardian consents to Tennis Australia providing the personal information of the participant  and  their parent/legal guardian to third parties that assist Tennis Australia with administering the Cardio Tennis Activities, and to third parties as required by law. If the participant and they are under 18, their parent/guardian are not willing for this to occur the participant  cannot participate in the Cardio Tennis Activities.

9. Each participant and if under 18,  their parent/legal guardian consents to Tennis Australia using their personal information to advise them of promotions, events, special offers and other like activities offered by Tennis Australia or its stakeholders.  Except where permitted or required by law, or where the participant’s and their parent/legal guardian’s consent is obtained, this information will not be disclosed to third parties.

10. Each participant and if under 18,  their parent/legal guardian are able to access personal information which they provide as part of their registration by contacting Tennis Australia upon reasonable notice.

Modification or cancellation of Cardio Tennis Activities

11. Tennis Australia reserves the right to modify, cancel or discontinue the Cardio Tennis Activities at any time and in its discretion, for reasons including but not limited to predicted or actual inclement or extreme weather, or Tennis Australia’s other activities, programs and requirements (including but not limited to the Australian Open Qualifying competition).

12. Tennis Australia also reserves the right to refuse entry to or remove any participant and their parent/legal guardian from the Cardio Tennis Activities at any time and in its discretion, for reasons including but not limited to the participant and/or their parent/legal guardian’s breach of these terms and conditions.

Release and Indemnity

13. In consideration of the participant participating in the Cardio Tennis Activities, the participant and if under 18,  their parent/legal guardian agree to release and discharge Tennis Australia from all liability, including for Tennis Australia and/or its directors, officers, employees, volunteers and agents’ negligence or carelessness.

14. Without limiting the foregoing, the participant and if under 18,  their parent/legal guardian also agree to release, defend, hold harmless and indemnify Tennis Australia and its directors, officers, employees, volunteers and agents from and against any actions, proceedings, claims, demands, expenses (including legal expenses), damages and liabilities howsoever arising or incurred as a result of or in connection with the participant’s participation in the Cardio Tennis Activities, the participant and their parent/legal guardian’s conduct and/or negligence.

Exclusion of liability

15. To the extent permitted by law, Tennis Australia is not liable for any loss suffered or sustained to personal property and including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by Tennis Australia, or its servants or agents, in connection with the arrangements for supply, or the supply, of any goods or services by any person to any participant and/or their parent/legal guardian.

Term of consents

16. Each participant, and if under 18,  their parent/legal guardian agree that the above consents and terms and conditions will be binding from the date on which the registration process is complete until they advise Tennis Australia in writing that they wish to revoke those consents and agreement to the above terms and conditions.  Consent/agreement cannot be revoked retrospectively.

Competition Terms and Conditions

Information on eligibility and how to enter this competition (the “Competition”) forms part of these Terms and Conditions.  Entry into and/or participation in this Competition shall be deemed to be an acknowledgement and acceptance of these terms and conditions.

1:  THE PROMOTER
Tennis Australia Ltd, (ABN 61 006 281 125) trading as Tennis Australia, Melbourne Park, Batman Avenue, Melbourne, Victoria, 3000.

2:  WHO MAY ENTER AND HOW TO ENTER
(a)                          The following persons are eligible to enter the Competition:  Eligible persons who:

(i)                            Take promotional material from the promotional staff at any one of the Promoter’s activation points; and

(ii)                          Scan the QR Code with a Smartphone or log directly onto the Cardio Tennis website (www.cardiotennis.com.au/register) and complete the entry form by providing personal information including, First Name, Last name, State, Post Code, Date of Birth, gender (male/female), their email address, how they heard about the competition and whether they are currently registered in a Cardio Tennis program.; and

(b)                         Entry is only open to, and the prize can only be awarded to, persons currently residing in Australia (no age restrictions). The Promoter reserves the right to request the winner to provide proof identity and residential address, in order to claim a prize. Proof of age, identification and residential address considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.  The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, can be considered objectionable, profane, potentially insulting, inflammatory or defamatory, or any entrant whose entry is not compliant with these terms & conditions of entry or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.

(c)                          Only one entry/redemption permitted per person.

The competition is not open to:
(a)             Employees of, or contractors to, the Promoter, or any of its agencies or contractors involved with this Competition; or
(b)             Immediate family members of such employees and contractors.

3:  THE PRIZE
(a)             All participants submitting a valid entry will go in the draw to win [2 tickets to the 2013 Australian Open Men’s or Women’s Final] (“the Prize”).
(b)             The Prize includes:
2 tickets to the 2013 Australian Open Men’s or Women’s Final valued at $758 inclusive of GST, if the winner and/or their guest lives more than 200 km from Melbourne return economy flights for up to 2 people to the maximum value of $1,500 inclusive of GST and 3 star twin-share accommodation for up to 2 people to the maximum value of $1500 inclusive of GST. Total prize value is not greater than $3,758 inclusive of GST (but is not available for retail sale as a package other than through the Promoter’s official tour operators). All tickets issued are subject to the 2013 Australian Open Ticket Conditions of Sale and Entry as amended from time to time.

(c)            The prize is not transferable, exchangeable or redeemable for cash. The prize value is accurate at the date of commencement of the Competition. The Promoter accepts no responsibility for any variation in the value of a prize after that date. Refunds will not be made in respect to unused services or prizes. Where a prize, or part of a prize, is unavailable, the Promoter retains the right to substitute the prize (or part) with a prize (or part) of equal or greater value.

(d)             The Promoter’s decision and all matters pertaining to this Competition will be final.  No correspondence will be entered into.

(e)             Any additional travel or accommodation costs incurred by the winner are their own responsibility.

(f)              In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

(g)             If the winner/s is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize.

(h)             The prize must be redeemed on the days of the Australian Open 2013 Men’s/Women’s Final  to coincide with the event currently scheduled to take place on 27 January 2013. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the scheduled game of the Australian Open Women’s Final is cancelled, postponed, rescheduled or relocated for any reason whatsoever.

4:  COMPETITION DATES

(a)             The Competition will run from 9:00am on 14 January 2012 to 4:00pm on 29 November 2012.  All entries / redemptions received before or after this time are ineligible for entry into the Competition and no responsibility will be accepted by the Promoter for lost, late or misdirected entries / redemptions.

(b)             The Promoter is neither responsible nor liable for any late, lost or misdirected entries and all entries are deemed to be received at the time of receipt by the Promoter.

5:  THE DRAW

The Competition shall be determined as follows:

(a)             The prize winners will be drawn at random from all valid competition entries received.

(b)             Due to the nature of the prize (tickets to the Australian Open) the draw will take place at Tennis Australia, Melbourne Park, Batman Avenue at 4:30pm (EST) on 30th November 2012 (“the Draw”).

(c)             The Promoter may conduct such further draws at the same time and place as the original draw as are necessary on 28th December 2012 in order to distribute any prizes unclaimed by that date.  In the event of any winners of a prize worth more than $100 in an unclaimed prize draw, their names will be published on the Promoter’s web site on (www.cardiotennis.com.au/register) Friday 14 December 2012.

6:  NOTIFICATION AND COLLECTION OF PRIZE AND REDRAW

(a)             The Prize Winner will be notified in writing within seven (7) days of the Draw and their full name published on the Promoter’s web site (www.cardiotennis.com.au/register) on 3 December 2012 and in the Australian on Friday 14 December 2012.

(b)             The Winner must contact the Promoter to claim their Prize by 27 December 2012, after which the Prize will be mailed to the Winner.

(c)             In the event that the Prize Winner is unable to be contacted, and all methods of communication are unsuccessful, unclaimed prizes will be dealt with as prescribed by the law of the State or Territory of Australia in which the winner resides and, subject to any relevant laws, as follows:

(i)              A prize winner will be drawn at random from all remaining valid competition entries received (the “Redraw Winner”).

(ii)             The redraw will take place at Tennis Australia, Melbourne Park, Batman Avenue, at 9am (EST) on 28 December 2012 (“the Redraw”).

(iii)             The Redraw Winner will be contacted in writing by email using contact details provided in their entry, within seven (7) days of the Redraw and their full name published on the Promoter’s web site (www.cardiotennis.com.au/register) and in The Australian on 4 January 2013.

(d)       The prize remains the property of the Promoter until claimed by the Prize Winner or the Redraw Winner.

(e)       ] In the event the Prize is not collected by the Redraw Winner, the Competition will be cancelled and there will be no Prize given.

7:  PRIVACY

All redemption coupons are the property of the Promoter. By entering this Competition, entrants understand and agree that the Promoter may use and disclose the information provided, including the entrant’s personal information, to administer the Competition and announce the winner. The entrant consents to the Promoter providing the entrant’s personal information to organisations that assist the Promoter with administering the Competition and announcing the winner, and to third parties as required by law (including authorities that regulate this Competition). If you are not willing for this to occur you cannot participate in the Competition.

You consent to the Promoter using your personal information to advise you of promotions, events, special offers and other like activities offered by the Promoter or its stakeholders.  Except where permitted or required by law, or where your consent is obtained, this information will not be disclosed to third parties.

Entrants are able to access personal information which they provide as part of their entry by contacting the Promoter upon reasonable notice.

8:  DISCONTINUATION AND DISQUALIFICATION OF THE COMPETITION

(a)             The Promoter reserves the right to discontinue the Competition at any time and at may cancel, terminate or modify the competition subject to the approval of all relevant State and Territory Lottery Departments.

(b)             Without limiting the foregoing, the Promoter reserves the right, in its sole discretion, to disqualify any individual:

(i)              for tampering with the entry process or the Competition generally;

(ii)             if the Promoter becomes aware that the entrant does not own, or have full legal authority to authorise the use and reproduction of any photograph or materials that they submit or use in connection with the Competition; or

(ii)             for otherwise acting in violation of these terms and conditions.

9:  EXCLUSION OF LIABILITY

(a)             The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery or contact details provided by an entrant.

(b)             The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods or services offered as prizes.

(c)             The Promoter is not responsible for losses associated with any change to the value of any prizes.

(d)             To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangements for supply, or the supply, of any goods or services by any person to the prize winner(s) and where applicable, to any persons accompanying the winner.

10:  PERMITS

(b)             When the Promoter notifies the Prize Winner, it will also discuss flight and accommodation arrangements with the Prize Winner, the details of which will subsequently be finalised and emailed to the Prize Winner.  The Promoter will also arrange with the Prize Winner for the Australian Open Tickets to be collected from the Promoter at Melbourne Park, Batman Avenue.

(c)             In the event that the Prize Winner is unable to be contacted, and all methods of communication are unsuccessful, unclaimed prizes will be dealt with as prescribed by the law of the State or Territory of Australia in which the winner resides and, subject to any relevant laws, as follows:

(i)              A prize winner will be drawn at random from all remaining valid competition entries received (the “Redraw Winner”).

The entrant consents to the Promoter providing the entrant’s personal information to organisations that assist the Promoter with administering the Competition and announcing the winner, and to third parties as required by law (including authorities that regulate this Competition). If you are not willing for this to occur you cannot participate in the Competition.

You consent to the Promoter using your personal information to advise you of promotions, events, special offers and other like activities offered by the Promoter or its stakeholders.  Except where permitted or required by law, or where your consent is obtained, this information will not be disclosed to third parties.

Entrants are able to access personal information which they provide as part of their entry by contacting the Promoter upon reasonable notice.

 

8:  DISCONTINUATION AND DISQUALIFICATION OF THE COMPETITION

(a)             The Promoter reserves the right to discontinue the Competition at any time and at may cancel, terminate or modify the competition subject to the approval of all relevant State and Territory Lottery Departments.

 

(b)             Without limiting the foregoing, the Promoter reserves the right, in its sole discretion, to disqualify any individual:

(i)              for tampering with the entry process or the Competition generally;

(ii)             if the Promoter becomes aware that the entrant does not own, or have full legal authority to authorise the use and reproduction of any photograph or materials that they submit or use in connection with the Competition; or

(ii)             for otherwise acting in violation of these terms and conditions.

 

9:  EXCLUSION OF LIABILITY

(a)             The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery or contact details provided by an entrant.

(b)             The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods or services offered as prizes.

(c)             The Promoter is not responsible for losses associated with any change to the value of any prizes.

(d)             To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangements for supply, or the supply, of any goods or services by any person to the prize winner(s) and where applicable, to any persons accompanying the winner.

The competition is conducted pursuant to NSW Permit No. LTPS\11\12180 and ACTW Permit No. ACT TP11/05363.
