2012 Lunar New Year Dragon Competition

 

TERMS AND CONDITIONS

 

METHOD OF ENTRY

 

1.     Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

 

2.     Entry is open to Australian residents aged 18 and over only.  Employees of SBS, Air Asia, Harvey Norman and their immediate families are ineligible. By entering this competition, entrants will be deemed to agree with these terms of entry.

 

3.     The “The 2012 Lunar New Year Dragon” Competition commences on Friday, 13 January, 2012 at 10:00am AEDT and ends on Thursday, 16 February, 2012 at 11:59pm AEDT.

 

4.     To enter, participants must log onto www.sbs.com.au/findthedragon and follow the directions on the website.  Participants must register their details, including (but not limited to) name, address, postcode and phone number.  Each Friday for five weeks, a Weekly Prize winner will be randomly selected.  If entrants decide to participate in the Major Prize element of the competition, they must answer in 25 words or less the following question:  What do you enjoy most about Lunar New Year?” Submit their entry by clicking on the “Enter Competition” button. 

 

The Major Prize component of the competition is a game of skill. Chance plays no part in determining the Major Prize winner.  Each entry will be individually judged, based upon literary and creative merit.  All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights.

 

5.     Online entries are limited to one entry per email address per day. All entries become and remain the property of SBS.

 

6.     SBS reserves the right to request winners to provide proof of identity, proof of Australian residency status at the nominated prize delivery address and/or proof of entry validity, in order to claim a prize. Acceptance of proof of identification, Australian residency and entry considered suitable for verification is at the discretion of SBS. In the event that a winner cannot provide proof, the winner will forfeit the prize in whole and no substitute will be offered.

 

7.      Incomprehensible and incomplete entries will be deemed invalid.

 

PRIZES:

 

8.     Weekly Prizes:

 

The Weekly Prize consists of one Samsung tablets for each of the five Weekly Prize winners.  A total of five tablets will be distributed over a five week period to each of the Weekly Prize winners.  Each Weekly Prize winner will have the choice of either a black or white Samsung tablet:

or

P7510UWDXSA      Galaxy Tablet 10.1 WIFI 16GB WHT (White)

 

Each Weekly prize is valued at up to AU$579 (RRP).

Total Weekly (5) Prizes valued at up to AU$2895 (RRP).

 

The Weekly Prize entries will close at 11:59pm (AEDT) each Thursday evening.   The Weekly Prize draws will take place at 10:00 am AEDT each Friday morning at the SBS office, 14 Herbert Street, Artarmon, NSW 2064. A SBS representative will randomly select one weekly winner from all those entrants who have validly entered for that week.  The five Weekly Prize winners will be notified by phone and email. Each Friday, the Weekly Prize winner for the current week will be published on the SBS website www.sbs.com.au from 1:00 pm AEDT.  The five Weekly Prize winners will be drawn and their names published respectively on the following dates: 20 January, 27 January, 3 February, 10 February and 17 February, 2012.

 

9.     Major Prize

 

The Major Prize winner will receive the following:

 

    * 2 x Premium return flights to Kuala Lumpur (Malaysia) or Hangzhou (China) from Melbourne, Perth or the Gold Coast; (valued at up to AU$7,500)

 

    * Transfers and accommodation to the value of AU$2,000

 

    * Taxes and airport charges to the value of us to AU$500

 

Total Major Prize is valued at up to AUS$10,000

 

Total Weekly and Major Prizes valued at up to AU$12,895.

 

10.  All valid entries which include an answer to the Major Prize element are automatically entered into the Major Prize draw. The Major Prize winner will be selected by a representative at SBS, 14 Herbert St, Artarmon NSW 2064, on Wednesday, 22 February, 2012 at 2:00pm AEDT.  The Major Prize winner will be notified by phone and email. The name of the winner will be published on the SBS website www.sbs.com.au Wednesday, 22 February, 2012 and published in The Australian on Wednesday, 29 February, 2012.

 

11.  If the Major Prize winner cannot be contacted by Wednesday, 6 June, 2012 at 10:00am AEST, SBS will award the Major Prize to the next best entry, judged at SBS, 14 Herbert St, Artarmon NSW, 2064 on Wednesday, 6 June, 2012 at 12:00 noon (AEST) or each hour until a winner is contacted.  The winner will be notified by phone and email.  The name of the winner will be published on the SBS website, and published in The Australian on Wednesday, 13 June, 2012.

 

12.  All prizes are as depicted or described in the promotions for the competition and are not subject to change.

 

13.   SBS accepts no responsibility for any loss, damages, or injury incurred to enter the competition or in connection with taking up the prizes.

 

14.  Prizes are not transferable or exchangeable and cannot be taken as cash.

 

15.  Once prizes have left the Prize Supplier’s premises, we take no responsibility for prizes damaged, delayed or lost in transit.

 

TRAVEL PRIZE (Major Prize)

 

16.  The winner of the Major Prize (and their travel companion) will not accrue any frequent flyer points from taking the prize.

 

17.  Travel must be completed as set out below.  If travel has not been completed within this time period, tickets shall be deemed null and void. The air tickets must be booked through AirAsia. Reservations require a turnaround of at least 10 working days.  The tickets are non-refundable, non-transferable and not exchangeable for cash or any other benefits in kind.

 

18.   Tickets are valid for up to 6 months from date of issue (outgoing and return flights must be completed within this period) and are subject to the below terms and conditions.

 

19.  Changes to the flight destinations are not permitted unless agreed upon by AirAsia

 

20.  AirAsia will not grant any request to extend the validity period.

 

21.  Major Prize is subject to AirAsia Terms and Conditions of Carriage at www.airasia.com 

 

22.  The terms and conditions of any third party will apply to the Major Prize where applicable.

 

23.  The Major Prize does not include anything not listed above including but not limited to: travel insurance, passports, visas, meals, baggage allowance, any taxes and charges (beyond the $500 stated in clause 9) and any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the Major Prize winner and their travel companion.

 

24.  The Major Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Major Prize as stated.

 

25.  There can be no changes (name of traveller, travel date) made to travel arrangements once bookings are made.

 

26.  AirAsia accepts no responsibility for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the winner or their guest in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

 

27.  AirAsia retains the right to substitute the Major Prize with another of similar value in the event the original Major Prize offered is not available due to circumstances beyond its reasonable control.

 

28.  All bookings must be made directly to AirAsia via the contact person provided (winner will be provided with this information). Bookings cannot be made via a third party.

 

29.  By making a booking, the winner and guest are deemed to have agreed to the terms and conditions of this Major Prize as well as AirAsia’s terms and conditions of carriage available at airasia.com.

 

30.  AirAsia reserves the right to amend the terms and conditions listed at any time without prior notice.

 

31.  All bookings are subject to availability. Bookings cannot be made on flights during weekends, eve of public holidays, public holidays and other embargo periods. The Major Prize winner must check with AirAsia for said periods.

 

32.  Neither SBS nor AirAsia or their associated companies will be held liable for any loss, damage or injury of the results directly or indirectly from the winner taking part in any aspect of the Major Prize. Where relevant, the winner agrees that they take full responsibility for any activities engaged in while travelling and engaging in the Major Prize package.

 

33.  Travel insurance is not included in the prize and will be the responsibility of the winner. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

 

34.  Travel arrangements to and from cities other than Melbourne, Perth or the Gold Coast do not form part of the Major Prize and are the responsibility of the winner.  It is also the responsibility of the winner to arrange their own transportation to the relevant airport.

 

35.  The Major Prize winner and their travelling companion must travel on the same flight as each other to their destination.

 

36.  It is the responsibility of the Major Prize winner to enquire about local issues and conditions at destinations before travel.

 

37.  Neither SBS nor Air Asia or their associated companies is responsible, to the extent permitted by law, for acts of god, acts of terrorism or war (declared or undeclared) or other events beyond SBS and AirAsia’s control which prevent awarding or acceptance of the Major Prize in accordance with the Major Prize description.

 

FINAL CONDITIONS

 

38.  Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). SBS accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

 

39.  It is a condition of accepting the prizes that the winners must comply with all the conditions of use of the prize and the prize supplier’s requirements.

 

40.  SBS, AirAsia nor Harvey Norman assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alterations of entries, and reserves the right to take any action that may be available. If for any reason this competition is not capable of running as planned, due to causes including, but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the rights in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition. Subject to state regulations.

 

41.  The Promoter’s decision is final and no correspondence will be entered into.

 

42.  The Promoter takes no liability for any tax issues that may arise from winning a prize in this promotion. Consult an independent Tax Adviser on this.

 

43.  If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

 

44.  Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal or permanent injury or loss of life; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

 

45.  The Promoter will not be responsible for: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.

 

46.  All details of the entrants will be used and preserved in accordance with the Information Privacy Principles and SBS Privacy Policy.  A request to access, update or correct any information should be directed to the SBS Privacy Contact Officer. Unless otherwise notified, SBS may use the entries and details of entrants for promotional and publicity purposes.  Entrants consent to their full names and/or their entries being used in all media by SBS.
