Caption Compare Competition - Terms and Conditions

1. Information on how to enter and prizes form part of these Conditions of Entry.
2. Entry is only open to residents of Australia aged 18 years and older (Entrants). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
3. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
4. Multiple entries per person are permitted as long as they are original in concept.
5. No responsibility accepted for late, lost or misdirected entries.

7. To enter the promotion, Entrants must, during a Promotional Period:
a. visit the Captain Compare page on Facebook (
www.facebook.com/captaincompare) (Captain Compare Page);
b. ‘like’ the Captain Compare Page. Entrants who have ‘liked’ the Captain Compare Page prior to the start of the Promotional Period will not be required to complete this step. For the avoidance of doubt, to ‘like’ in this context means to click on the ‘like’ icon on the Captain Compare Page;
c. Post a comment on the current promotional period’s picture which has been posted to the Captain Compare Facebook wall by Captain Compare. Only comments on the original competition image on the Captain Compare Facebook wall will be considered for entry.
8. Winners will also be announced to the public on the Captain Compare Facebook wall where they will be asked to email
social@captaincompare.com.au from the same email address they use for their facebook page and verify their eligibility to win. Judges' decision is final and no correspondence will be entered into. The winners will have 48 hours from the time their name is posted on the Captain Compare Facebook page to email Captain Compare at the email address provided and claim their prize. If after 48 hours that promotional period winner has not emailed Captain Compare, another winner will be chosen. This process will continue until a winner has claimed the prize.
9. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion
10. The best and most creative entry, as judged by the Promoter, will win. Winning entry will be judged on merit and creativity.
11. Entrants guarantee on submission that the contents of the comment(s) will not be obscene or defamatory. Captain Compare reserves the right to remove any posts and therefore forfeiting the entrant’s entry submission.
12. By entering, the entrant or entrants agree that Captain Compare may use entry materials for any promotional purposes. This may include but is not exclusive to placing your entry on the
www.captaincompare.com.au and
www.facebook.com/CaptainCompare websites.
13. There are four (4) winners in total. One (1) winner will be selected for each of the promotional periods. The winners will receive a AUD$500.00 cash prize with the maximum total prize pool value up to AUD$2,000.00. A prize will be awarded to a winner in the form of a cheque made payable to the winner. Prizes are not transferable or exchangeable. A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.
14. The Promoter may review further entries, at the same place as the original judging is held, as are necessary, 48 hours after the winner is announced if the winner has not yet emailed Captain Compare to claim their prize.
15. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. Entries will only be accepted when submitted from a personal Facebook profile account. Any entries submitted from a Facebook pages account will be deemed invalid.
16. If for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
17. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
18. Any costs associated with accessing the Captain Compare Australia page on Facebook is the entrant’s responsibility and is dependent on the Internet service provider used.
19. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of participating in this promotion or accepting any of the prizes, except for any liability which cannot be excluded by law.
20. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
21. The Promoter shall not be liable for any merchandise that has been lost, stolen, forged, damaged or tampered with in any way.
22. All entries are deemed to be received at the time of receipt into the promotional database and not at the time of transmission by the entrant.
23. The Promoter collects entrants’ personal information in order to conduct the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use their name and winning entry, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
24. The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
