Temple and Webster Pty Ltd (also called “Temple & Webster”, “we” and “us”) is a privately owned Australian company. We organise private online sales events for our members (“you”) featuring beautiful items for the home through our web site at

Terms and ConditionsThese Terms and Conditions set out the terms of the agreement between you and Temple & Webster.
By using our web site you unreservedly accept these Terms and Conditions and agree that your use of our web site, including any purchase of goods from us, is subject to these Terms and Conditions.
These Terms and Conditions cannot be varied without our written consent. We may update these Terms and Conditions from time to time and the current version will always be shown on the Terms and Conditions page of our web site.
Membership
Temple & Webster is a shopping club for members only. Membership is free. By applying for membership on our web site you warrant that you are at least 18 years of age, resident in Australia and that you are able to form legally binding contracts in Australia.
We reserve the right to decline an application for membership or cancel a membership at our sole discretion and without giving any reasons.
Members may not have more than one active account. You are responsible for all activity on your account and for maintaining the security of your password. We are not liable for any losses caused by someone else using your account. If you believe someone else has accessed your account, you must tell us immediately.
Referrals and referral credit
We may provide you with the ability to send email invitations via our web site or invitations via Facebook to your friends and family for the purpose of inviting them to apply for membership. You agree to send invitations only to people who know you personally, and not to use this feature to send any content which is unlawful, abusive or obscene.
We may from time to time, at our sole discretion, offer to credit the account of the referring member with a fixed sum for use on our web site after the first purchase by a person they have referred (“referral credit”). Referral credits are non-transferrable and cannot be exchanged for cash.
Any abuse of this email messaging feature or referral credit system, including for the purpose of manipulating the referral credit system for financial gain, may result in the cancellation of your Temple & Webster membership and the forfeiture of any referral credit on your account.
Our products
The products for sale on our web site are intended solely for purchase by members for their personal use. You agree not to commercially resell any product you buy from our web site. We may restrict orders to normal household quantities.
We endeavour to ensure that all the products on our web site are accurately described, and we rely on information provided by our suppliers. Unfortunately, on some occasions it is possible that our web site will contain errors and we reserve the right to correct any errors or inaccuracies at any time. You should also be aware that colours may appear slightly differently on different displays and screens.
Your order
After you have placed your order and we have processed your payment we will provide you with an order confirmation by email. This email does not guarantee that the product(s) you have ordered is/are available and our acceptance of your order is not a legally binding obligation to fulfill your order. Your order represents an offer to purchase, which we accept when we dispatch your product(s) and send you an email letting you know that your product(s) has/have been dispatched.
In the unlikely event that a product is unavailable, we will contact you by email as soon as possible to let you know. You may choose to have a credit to your account or a refund to the value of the unavailable product.
Prices, payment and GST
All prices displayed on our web site are in Australian dollars and include GST and all payments are processed in Australian dollars. We accept payment by Visa, MasterCard, and PayPal.
The retail price for each product is provided to us by our supplier and is shown alongside the sale price for your reference.
Delivery
Delivery costs and times vary for different products and are calculated based on size, weight and destination. Each product listing will include the estimated delivery time for that product. The delivery price for each product will be displayed during the check out process, prior to payment and order confirmation.
Temple & Webster generally receive the products at our warehouse within 5 business days after the sale event has closed. We endeavour to dispatch products from our warehouse within 5 business days. We will send you an email to let you know when your item has been dispatched by us.
We will have your purchase delivered using Australia Post or couriered to the delivery address provided by you. We cannot deliver to PO boxes. Australia Post may leave a card at the address and you will need to pick up the delivery from your nearest Post Office. A courier may leave a card if no-one is at the address to sign for the delivery, and you will need to contact the courier company to arrange for re-delivery.
We deliver most products Australia-wide. In some cases, we will only be able to deliver products in metropolitan areas. This information will be shown on the product listing. We are not able to accept orders for international delivery at this time.
Returns
If you are not satisfied with your purchase, you may return it to us, unused and in its original packaging, within 7 days of receiving it.
If your product is faulty or otherwise non-compliant with a consumer guarantee under the Australian Consumer Law we will either replace it (subject to availability) or provide you with a refund of the purchase amount (less the delivery charge).
In most other circumstances, we will provide you with a credit to your Temple & Webster account of the purchase amount (less the delivery charge). Note that we do not hold stock, so exchanges are not usually possible.
Gift Cards
Members may purchase Gift Cards from our web site. We will email the Gift Card to the recipient’s email address, as provided by the member. Recipients of Gift Cards who are not already members will need to apply for membership of Temple & Webster before they are able to use their Gift Card. Membership is free.
Gift Cards, once verified, may only be used for purchases at Temple & Webster. Gift cards are not transferrable and cannot be returned or exchanged wholly or partly for cash. The available funds will be verified at the time of redemption on the Temple & Webster web site. Any balance that remains on a Gift Card may only be used in whole or in part for future purchases at Temple & Webster. Gift Cards have an expiry date 365 days from the date of their purchase and this expiry date cannot be modified. If a purchase made using a Gift Card is for less than the amount of the Gift Card, any remaining balance will appear on the user’s account for future use. Any balance that remains after the expiry date will not be available for use.
$1,000 Shopping Spree Promotion - Conditions of Entry
Entry is limited to Australian residents over 18 years of age who are not employees or contractors of Temple & Webster or their immediate families. To enter, refer one or more friends to Temple & Webster using your unique refer a friend link. Your entry will go into the draw if a referred friend becomes a valid member of Temple & Webster before the closing date of midday on 31st January 2012. Only one entry per person will be accepted. The promoter reserves the right to verify the validity of entries and disqualify any entrant who tampers with the entry process in any way. The winner will be the first entry drawn at random from all eligible entries on 3rd February 2012. The winner will receive a $1,000 Temple & Webster voucher that is non transferable, not exchangeable and may not be taken as cash. The winner will be notified via email. Liability
To the extent permitted by law, we exclude our liability for any loss or damage (including but not limited to indirect or consequential losses) arising out of your use of or purchase from our web site. To the extent permitted by law, our liability to you in relation to any product supplied to you is limited to the purchase price of the product.
Intellectual property
We are the owners or licensees of the intellectual property in the content on our web site including (but not limited to) text, graphics, logos, trade marks, design, icons, the arrangement of any of the foregoing, sound recordings, video and all software relating to our web site. You are not permitted to copy, publish or use any of the content in any way, whether personal or commercial, without our prior written permission.
Third party web sites
Our web site may contain links to web sites which are operated by third parties. We are not responsible for the content of any third party web sites and we suggest you inform yourself of any relevant terms and conditions or privacy policies applicable to those sites.
Email communication
You consent to receive communication from us electronically, either by email or by us posting notices on our web site and you agree that all communications that we provide to you electronically will satisfy any legal requirement that a communication be in writing.
Privacy Policy
The Privacy Policy available on our web site informs you of our practices regarding the collection, use and disclosure of any information we collect from or about you. Our Privacy Policy forms part of these Terms and Conditions.
Force Majeure
Temple & Webster is not liable for any delays in performing its obligations caused by circumstances beyond our reasonable control. We will endeavour to perform our obligations as soon as possible within a reasonable extension of time.
Applicable law
These Terms and Conditions, including our Privacy Policy are governed by the laws of New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of New South Wales.
