1.            Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
 
 
 
2.            Entry into the promotion is open to all residents of NSW, ACT, Victoria, WA and Queensland and New Zealand aged 18 years or over, excluding directors, management, and employees, proprietors of the Promoter, retail tenants in Participating AMP Capital Shopping Centres and the proprietors and staff of companies involved in the production, publishing and administration of this promotion. “Tenants” means Lessees, Licensees and in the case of a corporation, their directors. “Immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. “Participating AMP Capital Shopping Centres” means shopping centres set out in the Schedule, in the case of In-Centre Component, and the shopping centres in the Schedule, plus Malvern Central, Gateway Plaza, Northbridge centres for the purpose of the Major Prize Component.

4.            There are two (2) components to this promotion, namely the (a) In-Centre Component; and (b) Major Prize Component.
 
 
 
5.            Promotion commences
 
9am AEDST on 01.02.12 and closes at 11.59pm AEDST on 29.02.12 (Promotional Period).
 
 
 
In-Centre Component

 
 
6.            To be eligible to enter, individuals must visit a Participating AMP Capital Shopping Centre and purchase good(s) or service(s) from a store located in the Participating AMP Capital Shopping Centre. In the case of Pacific Fair Shopping Centre, the individuals must spend $35 or more on the day of the relevant draw at a store located in centre. In the case of Mt Ommaney Shopping Centre, the individuals must spend $30 or more on the day of the relevant draw at a store located in the centre.
 
 
 
7.            Each Participating AMP Capital Shopping Centre will conduct draws in accordance with the dates and times set out in the Schedule. At each draw, a random number between 1 and 500 (where the prize on offer is valued at up to $500 in the form of an AMP Capital Shopping Centres Gift Card or Visa Gift Card)) or 1 and 200 (where the prize on offer is valued at up to $200 in the form of an AMP Capital Shopping Centres Gift Card or Visa Gift Card) will be selected. See Schedule for relevant prize amount in each Participating AMP Capital Shopping Centre. This number will be announced at each Participating AMP Capital Shopping Centre immediately after the relevant draw has been conducted. Notwithstanding the foregoing, in the case of the of Pacific Fair Shopping Centre and Mt Ommaney Shopping Centre, there will be a different draw process whereby the number announced will be between one and the maximum number of entries received in a particular draw. Further, there will be AMP Shopping Centre Gift cards to the value of $200 to be won in each draw at these two AMP Capital Shopping Centres.
 
 
 
8.            There will be designated promotion area within each Participating AMP Capital Shopping Centre (“Designated Area”). The first individual to visit, within 60 minutes of the relevant draw time, the Designated Area and present an Eligible Receipt to the relevant promotional representative, as determined by the Promoter, and subject to signing the consent form (as detailed below), will win the prize, which will be the amount equivalent to the final total value of dollars (excluding cents) as recorded on the Eligible Receipt (“Eligible Individual”). An “Eligible Receipt” for the purpose of a draw, means a purchase receipt recording goods or services purchased from a store located at the relevant Participating AMP Capital Shopping Centre, after the commencement date and time of the Promotional Period, but before the date and time of the relevant draw, that records a total value in dollars (excluding cents) to the number announced for that draw. The Promoter, in its absolute discretion, will determine whether a receipt presented is an Eligible Receipt. In the case of Australian Participating AMP Capital Shopping Centres, the prize will be awarded in Australian dollars, and in the case of New Zealand Participating AMP Capital Shopping Centres, the prize will be awarded in New Zealand dollars. Notwithstanding the foregoing, there will be a different entry process for the Victorian based centre. In the case of the Victorian based centre, there will be two draws for each prize. One (1) draw to announce the number for the relevant draw, and then second draw to select the winner of the prize. In the case of the Victorian based centre, an individual who has an Eligible Receipt has 60 minutes after the initial number draw to visit the Designated Area and complete the official entry form and place it in the barrel together with their Eligible Receipt. 60 minutes after the initial relevant draw as recorded in the Schedule the Promoter will conduct a second draw where it will draw a valid entry from all entries received during previous 60 minute period. The first valid entry drawn from all entries received in the second draw will win the prize, subject to signing the consent form. For the purpose of the Victorian based centre, the individuals selected to win a prize by the above process at the Victorian based centre will be deemed an Eligible Individual. Notwithstanding the foregoing, there will be a different entry process for the Pacific Fair Shopping Centre and Mt Ommaney Shopping Centre. At each of these centres, the individuals must present their Eligible Receipts (as defined below) to the Designated Area prior to the relevant draw to receive an entry number for that draw. An “Eligible Receipt” for the purpose of a draw at these two centres, means a purchase receipt recording goods or services purchased from a store located at the relevant Participating AMP Capital Shopping Centre, on the date of the relevant prize draw. At each draw, the Promoter will select a number and make an announcement. The person who holds the matching entry number for that particular draw must present their matching entry number and Eligible Receipt within 5 minutes of the announcement at the Designated Area. If they do this successfully, then subject to signing the consent form (as detailed below), they will win the prize. Entry numbers received for other draws will be invalid (i.e. each entry number is only valid for one draw). The Promoter, in its absolute discretion, will determine whether a receipt presented is an Eligible Receipt or entry number presented is a winning entry number.
 
 
 
9.            Before receiving the prize, the Promoter’s representative will invite the Eligible Individual to assess and accept these Terms and Conditions by signing the consent form.  Upon ensuring the Eligible Individual’s compliance with these Terms and Conditions, the individual will be declared a winner.
 
 
 
10.         Eligible Individuals will be notified in writing within 2 days of the draw. If the Eligible Individual is from Victoria, ACT or NSW, and the relevant prize exceeds $250, they will be published online within 2 weeks of the relevant draw at the website of the relevant Participating AMP Capital Shopping Centre as set below where the relevant draw was conducted.If the Eligible Individual is from Victoria, and the relevant prize exceeds $250, they will be published in The Australian on15.03.12.
 
 
 
11.         If no person submits an Eligible Receipt within 60 minutes of the relevant draw (or in the case of Pacific Fair Shopping Centre and Mt Ommaney Shopping Centre no person presents a winning entry number and Eligible Receipt within 5 minutes of the relevant draw)  , or the Eligible Individual submits an Eligible Receipt for the relevant draw but fails to return a signed consent form during the Promotional Period, then the cash amount equivalent to the number announced in the relevant draw will be placed in the 2nd Chance Draw for Australian residents (if the un-won amount was from a Participating AMP Capital Shopping Centre in Australia) or the 2nd Chance Draw for New Zealand residents (if the un-won amount was from a Participating AMP Capital Shopping Centre in New Zealand).
 
 
 
12.         To enter the 2nd Chance Draw, entrants must simply enter the Major Prize Component to automatically be placed in the relevant 2nd Chance Draw, according to their place of residence.
 
 
 
13.         The 2nd Chance Draws for Australian residents and New Zealand residents will take place at the Promoter’s office at Level 16, 50 Bridge Street, Sydney, NSW 2000 on 1.03.12 at 12pm AEDST. The first valid entry drawn in the 2nd Chance Draw for Australian residents will win the amount of money in Australian dollars in the 2nd Chance Draw for Australian residents. The first valid entry drawn in the 2nd Chance Draw for New Zealand residents will win the amount of money in New Zealand dollars in the 2nd Chance Draw for New Zealand residents. Prizes awarded in the 2nd Chance Draw will be awarded in the form of a cheque. The winners of the Australian and New Zealand 2nd Chance Draw will be notified by email and phone within two business days of the draw. If the winner of the 2nd Chance Draw is from Victoria, ACT or NSW, and the prize exceeds $250, they will be published in The Australian on 15.03.12.
 
 
 
Major Prize Component
 
 
 
14.         To be eligible to enter the Major Prize Component the individual must, during the Promotional Period, purchase goods or services from a store located at a Participating AMP Capital Shopping Centre valued between $1 and $1000 inclusive, and retain their receipt. To claim the prize, if selected as a winner, they will be required to present the original relevant receipt.
 
 
 
15.         To enter the Major Prize Component, individuals must, during the Promotional Period, visit the Participating AMP Capital Shopping Centre website (as listed below for each country), where they made the relevant purchase, and follow the prompts, to fully complete the entry form by including all of the requested details, including but not limited to inserting the total value of their purchase receipt (excluding any cents).

16.         The Major Prize Draw will take place at the Promoter’s office at Level 16, 50 Bridge Street, Sydney, NSW 2000 on 1.03.12 at 12pm AEDST. At the Major Prize Draw, a number between 1 and 1000 (inclusive) will be randomly selected. All entries that have a receipt total matching the number selected will be placed into the draw. If there are no entries that have a receipt total matching the number an additional number will be drawn. This process will continue until there is at least one entry which has a matching receipt number. The first valid entry drawn from all entries that have a matching receipt number will, subject to compliance with the requirements in clause 17, win the Major Prize of $10,000 awarded in the form of a cheque in either Australian dollars or New Zealand dollars according to their place of residency (“Provisional Winner”). The Promoter reserves the right to select reserves and record them in the order drawn if the original entry or subsequent reserve entry is deemed invalid.
 
 
 
17.         The Provisional Winner will be notified in writing within 2 days of the draw and published online at each of the websites listed above on 15.03.12. If the Provisional Winner is from Victoria, they will be published in The Australian on 15.03.12.
 
 
 
18.         Before receiving the Major Prize, the relevant individual will be required to sign and return legal documentation as and in the form required by the Promoter (acting reasonably) in its absolute discretion, including but not limited to a legal release and indemnity form as well as the original relevant receipt, which entitled them to enter, before the unclaimed prize draw date. Failure to do so will result in the Major Prize being awarded in the unclaimed prize draw.
 
 
 
General

 
 
19.         Total prize pool value to be awarded via Australian Participating AMP Capital Shopping Centres, including if the winner of the Major Prize is awarded to a Australian resident is up to AUD$125,000.
 
 
 
20.         All entries from the Major Prize Draw from both Australian and New Zealand residents will be entered into the unclaimed prize draw, if one is required. If required, a draw for any unclaimed prizes will take place on 1.06.12 at the same time and place as the original Major Prize Draw, subject to any directions from a regulatory authority. If any winners are Australian residents they will be awarded the prize in Australian dollars in the form of a cheque. If any winners are New Zealand residents they will be awarded the prize in New Zealand dollars in the form of a cheque. Winners, if any, will be notified in writing with 2 days of the draw. If the winner is from Victoria, ACT or NSW, and the relevant prize exceeds $250, they will be published online at each of the Facebook pages listed above on 8.06.12. If a winner is from Victoria, and the relevant prize exceeds $250, they will be published in The Australian on 8.06.12.
 
 
 
21.         The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any eligible entrant who does not comply with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 
 
 
22.         If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
 
 
 
23.         The Promoter’s decision is final and no correspondence will be entered into.
 
 
 
24.         Prizes are not transferable or exchangeable and cannot be taken as cash, unless stipulated otherwise.
 
 
 
25.         Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 
 
 
26.         If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
 
 
 
27.         Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or the Consumer Guarantees Act in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
 
 
 
28.         Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
 
 
 
29.         The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian and New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
