Disney Junior's Princess Tea Party Competition
BRIEF OVERVIEW OF CONTEST
1.1 To enter Disney Junior's Princess Tea Party Competition (the "Contest"), entrants must watch the movie shown on Disney Junior, Saturdays (at 18:00 AEDT in Australia and 18:00 local time in New Zealand) from 28 January 2012 to 18 February 2012.
During the movie shown, a Disney Princess will be revealed on screen. Once entrants have identified the Disney Princess, they must go to www.DisneyJunior.com.au in Australia and www.DisneyJunior.co.nz in New Zealand and click through to the competition page. There, entrants must correctly enter the name of the Disney Princess revealed during the most recently shown movie, and complete and submit the entry form to go in the draw to win (the "Entry"). 1.2
The Contest is made up of four (4) minor draws (each a "Minor Draw") and one (1) major draw ("Major Draw"). Entrants may enter each Minor Draw once only by submitting one (1) entry in accordance with the dates set out in clause 1.3 for each Disney Princess revealed. An entrant must enter a minimum of three (3) Minor Draws to be eligible for the Major Draw.
1.3 The Contest commences at 18:00 (AEDT for Australian residents and NZ Local Time for New Zealand residents) on Saturday, 28 January 2012 and concludes at 17:59 (AEDT for Australian residents and NZ Local Time for New Zealand residents) on Saturday, 25 February 2012. Each Minor Draw opens at 18:00 (AEDT for Australia, NZ local time for New Zealand) on the "Opening Date" shown below, and closes at 17:59 (AEDT for Australia, NZ local time for New Zealand) on the "Closing Date" shown below.

1.4 By clicking the "I Accept" button and ticking the box on the competition webpage and submitting an Entry, you are stating that you agree to be bound by all of these terms and conditions of the Contest (the "Official Rules".
1.5 It is important that you read and understand these Official Rules, particularly clauses about Disney's legal responsibility to you such as clause 7. If you do not understand these Official Rules, you should seek help to understand them.
1.6 If you are younger than 18 years old, your parent/guardian (who is over 18 years of age) will need to consent and agree to your participation in the Contest. We may send an email to your parent/guardian (at the email address recorded in your Entry) confirming their consent and agreement to these Official Rules.
NAME OF PROMOTER
2.1 The promoter of this Contest is The Walt Disney Company (Australia) Pty Limited, Level 3, 68 York Street, Sydney NSW 2000, Australia, ABN 30 054 610 025 ("Disney"). Disney may contract the services of Salmat IDR or such other agency as Disney may determine in its discretion ("The Agency") to administer certain parts of this Contest.
ELIGIBILITY
3.1 To be eligible to enter the Contest:
(a) you must be a permanent resident of Australia or New Zealand;
(b) if you are younger than 18 years old, your parent/guardian must have provided consent for your Entry as required by clause 1.6;
(c) Neither you nor anyone in your immediate family (including your parents/guardian, brothers and sisters), can be an employee of Disney or The Agency, affiliated with Disney, Salmat IDR or connected to the Contest in any way; and
(f) Your Entry must be in English and legible.
3.2 Disney may disqualify you if:
(a) your Entry does not comply with any of the above requirements;
(b) your Entry includes any objectionable material or infringes the rights (including intellectual property rights) of any third party;
(c) Disney reserves the right to invalidate entries or the winner if the appropriate authorization from the parent/legal guardian is or was not provided;
(d) you are in breach of these Official Rules; or
(e) you have tampered in any way with the operation of the Contest.
3.3 You may only enter each Minor Draw once by submitting one (1) entry for each Disney Princess revealed per movie. You must enter a minimum of three (3) Minor Draws to be eligible for the Major Draw at the conclusion of the Contest. You may only enter the Major Draw once
3.4 Each entrant into a Minor Draw may only be awarded a maximum of one (1) Minor Prize (as defined below) for that Minor Draw. An entrant may win multiple prizes from separate Minor Draws and/or the Major Draw.
3.5 Illegible, incomprehensible and incomplete entries will be deemed invalid.
3.6 The cost of accessing the promotional website will be dependent on the entrant's individual Internet Service Provider.
HOW AND WHEN WINNERS WILL BE SELECTED
4.1 The Contest is a game of chance where skill will play no part in the Contest and Winners (defined below) will be determined at random.
4.2 Each valid entrant who has entered the Contest over the duration of the entry dates and times outlined in the Official Rules will be entered into the relevant Minor Draw. Ten (10) valid entrants into each Minor Draw will be drawn at random to become Minor Prize winners (as defined below). A total of four (4) weekly Minor Draws will be conducted in total.
4.3 At the conclusion of the Contest, one (1) valid entrant into the Major Draw will be drawn at random to become the Major Prize winner (as defined below). Entrants must have entered a minimum of three (3) Minor Draws to be eligible to enter the Major Draw. All draws will take place at Salmat IDR Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 on the dates and times outlined within the draw table in clause 1.3.
4.4 The winners will be notified by phone and via email advising them of their prize within two (2) business days of the draw. The Major Prize winner will be published in the public notices section of The Australian Newspaper on Monday 5 March 2012. The names of all winners (both Minor Draws and Major Draw) will also be displayed at
www.DisneyJunior.com.au or
www.DisneyJunior.co.nz at the times identified in the Official Rules.
4.5 All reasonable attempts will be made to contact the Major Prize winner and Minor Prize winners.
4.6 The Major Prize must be claimed by Monday, 02 April 2012 at 11:30(AEDT) and 13:30 (NZ Local Time). If the prize is not claimed by this date and time, an unclaimed major prize draw will take place at Salmat IDR Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, on Monday, 02 April 2012 at 12:00 (AEDT) and 14:00 (NZ Local Time) subject to State Regulation. Any winners will be notified on the phone number specified when entering the Contest and notified by email. The redrawn Major Prize winner will be published in the public notices section of The Australian Newspaper on Monday, 30 April 2012
4.7 All Minor Prizes will be held for a maximum of 3 months from draw dates as per the Official Rules. If the prize is not claimed by the date and time outlined within the Official Rules, an unclaimed prize draw will take place at Salmat IDR Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, on Monday, 28 May 2012 at 10:00 (AEDT) and 12:00 (NZ Local Time) subject to State Regulation. Any winners will be notified on the phone number specified when entering the Contest and notified by email.
If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
PRIZE(S)
5.1 There will be one (1) Major Draw prize (the "Major Prize") and 40 (40) Minor Draw prizes (each a "Minor Prize") to be won during the course of the Contest as follows:
(a) The Major Prize will consist of
A family trip to London consisting of the following;
Four (4) return economy flights to London (based on two adults aged over 18 plus two children, aged under 18 years old) valued at a maximum of AUD $4,000
Four (4) nights' hotel accommodation in London from Friday 18 May 2012 to Monday 21 May 2012 valued at a maximum of AUD$2,000
Four (4) tickets to Rapunzel's Royal Tea Party at Kensington Palace with Rapunzel on Sunday 20 May 2012 valued at a maximum of AUD $2,000
Pre-arranged airport transfers to and from hotel in London valued at a maximum of AUD $500
Total of AUD $1000 spending money
The maximum value of the Major Prize pool is valued at a maximum of AUD $9,500
(b) The Minor Prizes shall consist of:
One (1) x Rapunzel Princess Doll, valued at AUD $30.99 each
The total Minor Prize pool is valued at a maximum of AUD $1239.60
The total prize pool is valued at a maximum of AUD $10,739.60
5.2 Major Prize and Minor Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). Neither Disney nor Salmat IDR accepts any responsibility for a change in prize value between now and the ultimate prize redemption date subject to State Regulation.
5.3 If you are a Major Prize or Minor Prize winner, you may not transfer the Major Prize or Minor Prize to anyone or ask for an alternative prize (including cash). Disney may replace the Major Prize or Minor Prize with a prize of equal value in the unlikely event that the Major Prize or Minor Prize becomes unavailable subject to State Regulation.
5.4 Once a Major Prize or Minor Prize has left the premises of Disney, responsibility for any damage, delay or loss to any Major Prize or Minor Prize during transit, shall pass to the winner.
5.5 Disney may ask you and your parent/legal guardian to provide proof of your age, identity and residency, and to sign any required documentation before claiming the Major Prize or Minor Prize.
5.6 Disney reserves the right to refuse to allow a winner to take part in any or all aspects of the prize if Disney determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. Award of the prize is conditional upon the winner and his/her parent/legal guardian (if under the age of 18 years) agreeing to and signing a legal release in a form determined by Disney in its absolute discretion.
5.7 If you are unable to claim or collect the Major Prize or Minor Prize for whatever reason, Disney will award the Major Prize or Minor Prize to someone else subject to State Regulation and these Official Rules.
5.8 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
5.9 Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
5.10 Award of the Major Prize or Minor Prize is conditional upon the winner and his/her parent/legal guardian agreeing to and signing the appropriate release forms and/or agreements and/or any additional documentation required by Disney.
5.11 By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
5.12 To be entitled to the Major Prize, you and those traveling with you must, at the very least:
(a) be able to travel on the following dates: Thursday 17 May 2012 to Tuesday 22 May 2012
(b) obtain valid visas for travel to the United Kingdom (if required)
(c) provide Disney with proof of successful visa applications prior to departure if requested; and
(d) have passports that are valid for six months or more from departure.
5.13 Except as set out above, the Major Prize Winner/their parent or legal guardian and travel companions are responsible for all expenses connected to your participation in the Contest, including meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
5.14 Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The Major Prize does not include any travel insurance. It is the responsibility of the Major Prize Winner to purchase travel insurance.
5.15 In the event it is determined that any criteria under these Official Rules is not met by the Major Prize Winner, the Major Prize will be forfeited automatically and awarded to another Major Prize Winner who meets the criteria under these Official Rules.
5.16 The Major Prize is only valid from Thursday 17 May 2012 to Tuesday 22 May 2012. The winner can elect to extend their trip and travel for a longer period (at their own cost) however travel dates outside of the above period are subject to airline flight availabilities. The travel dates for the Major Prize cannot be changed once the booking has been made.
5.17 If you are the Major Prize Winner, you and your travelling companions must travel at the same time during the specified travel dates, must depart from the same capital city, and are responsible for transport from your residence to your nearest capital city for flight departure.
5.18 If the Major Prize Winner is under the age of 18 as at the date of the draw, a parent/legal guardian must accompany the minor in the participation of the Major Prize.
5.19 Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
5.20 A credit card imprint or cash deposit may be required to check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
5.21 It is the traveler's personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travelers.
5.22 Disney and Salmat IDR Pty Limited make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
OWNERSHIP/RIGHTS
6.1 Disney will own your Entry and will not return your Entry at the end of the Contest.
6.2 You agree that all of the rights (including intellectual property rights) in your Entry, including any recording and performance in your Entry, belong to Disney and hereby assign any rights you may have to Disney. This includes all copyright (present or future), other intellectual property rights and rights of ownership. You grant a perpetual worldwide license (including a right to sub-license) to Disney of all rights in your Entry pending completion of this assignment.
6.3 You agree to do all things necessary (which may include signing documents) to transfer these rights to Disney.
6.4 You consent to Disney doing anything, or omitting to do anything, that infringes your moral rights in your Entry. Moral rights are your inherent rights in your Entry as the author and/or performer in the Entry and comprise:
(a) the right to be attributed as the author of and/or performer in the Entry;
(b) the right not to have your authorship of and/or performance in the Entry falsely attributed; and
(c) the right of integrity of authorship
LIABILITY AND INDEMNITY
7.1 Disney may cancel, modify, suspend or delay the Contest at any time if something happens that is beyond its reasonable control, including for any technical or operational reason subject to State Regulation.
7.2 Disney is not liable, and you release Disney from liability, for any loss or damage that you may suffer from your participation in the Contest, including (without limitation) if:
(a) the Contest is cancelled, modified, suspended or delayed under clause 7.1; or
(b) Disney does not receive your Entry within the contest period for any reason
7.3 The Competition and Consumer Act 2010 (Cth) as well as other laws in Australia may imply certain conditions, warranties and undertakings, and give you other legal rights. If they apply, these cannot be modified or excluded by any contract. You may consider seeking legal advice as to whether they apply to you.
7.4 Nothing in these Official Rules generally affects your rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law. Other than these consumer guarantees, and subject to clause 7.3, Disney makes no warranties about any prizes offered as part of the Contest, including warranties as to the quality, merchantability or fitness for purpose of such prizes. You, your accompanying parent/legal guardian and accompanying family members and/or guests (the "Participants") also take full responsibility for any and all liability, claims, demands or causes of action that the Participants may hereafter have for injuries or damages arising out of any part of the Prizes or, in the case of the Prize winner, their participation in the trip. The Participants agree that NONE OF THEM WILL SUE OR MAKE CLAIM against Disney for damages or other losses sustained as a result of any injury, or death, sustained from acceptance or participation in the Prize. The Participants hereby expressly recognize that this release of liability, waiver of legal rights, and assumption of risk is a contract pursuant to which the Participants have released, and released on behalf of any Participant under the age of 18, any and all claims against Disney resulting from any injury, or death, sustained from acceptance and participation in Prize, including without limitation any claims for negligence of Disney.
7.5 You agree to indemnify Disney against all liabilities suffered or sustained by Disney arising from any claim by a third party that your Entry infringes the rights (including intellectual property rights) of any third party.
REPRESENTATIONS AND WARRANTIES
8.1 You represent and warrant that you have all of the rights necessary to effect the transfer of rights to Disney under clause 6.
PRIVACY
9.1 Disney will collect your personal information (such as your name and biographical data) as part of the Contest and may use this information anywhere in the world for the purposes of Disney Channel, Disney Junior and/or the Contest. Your personal information may be provided to Disney affiliates, including overseas affiliates for future promotional, marketing and publicity purposes without notice and without any fee being paid unless otherwise advised by the entrant. You hereby waive any rights of privacy, publicity or similar rights which you may have in the Entry.
9.2 No personal information collected from participants will be used for any marketing or promotional purposes, either by Disney or its affiliates, without their express consent.
9.3 Disney will comply with its privacy policy in the collection and use of your personal information. Disney's privacy policy is available at

DISNEY INTELLECTUAL PROPERTY
10.1 Unless expressly stated in these Official Rules, your participation in the Contest does not entitle you to use any of Disney's intellectual property rights (including any Disney trade mark or copyright) for any purpose.
10.2 You may not disclose your Entry to anyone other than Disney. You may only use your Entry to participate in the Contest. You may keep any copy of your Entry for your personal records.
GOVERNING LAW
11.1 These Official Rules are governed by the laws of the relevant State authorities. You submit to the non- exclusive jurisdiction of courts exercising jurisdiction there, and waive any right to claim that those courts are an inconvenient forum
AMENDMENTS
12.1 Disney reserves the right to change, amend, delete or add to these Official Rules subject to State Regulation without prior notice at any time and each Entrant shall be bound by such changes. Disney will post any changes to the Official Rules on the competition website. Before you submit your Entry, please check the website to ensure you are aware of the terms.
SEVERABILITY
13.1 Any provision (or part thereof) of these Official Rules that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions (or parts thereof) of these Official Rules nor affect the validity or enforceability of that provision (or part thereof) in any other jurisdiction.
ENTIRE AGREEMENT
14.1 These Official Rules and any Entry Forms contain the entire agreement between you and Disney with respect to the Contest. They set out the only conduct that you have relied on and supersede all earlier conduct and prior agreements and understandings between you and Disney in connection with the Contest.
