Terms and Conditions - Game of Skill
By entering the Jetstar Valentine’s Day Competition, you agree to the following conditions:
1. Information on how to enter forms part of the terms and conditions of entry. Entry into the
promotion is deemed acceptance of these terms and conditions.
2. The promoter is Jetstar Airways Pty Limited (ABN 33 069 720 243) of Level 4, 222 Bourke
Street, Melbourne VIC 3000 (Promoter).
Eligibility
3. Entry is open to Australian residents
over 18 years only (Eligible Entrants), excluding
directors, management, employees (and their immediate families) of the Promoter and its
related bodies corporate and registered travel companions of employees of the Promoter and
its related bodies corporate.
4. The promotion commences at 10am (AEDT) on Thursday 9 February and
closes at 10am
(AEDT) Monday 13 February (Promotion Period). Only entries that are received during that
time will be eligible for entry.
Competition entry
5. To enter, Eligible Entrants must, during the Promotion Period:
5.1 Send an email to
valentinesdayau@jetstar.com containing:
5.1.1
“Jetstar Valentine’s Day” in the email subject line;5.1.2 An answer in 50 words or less to the following question:
“What is your dream honeymoon to a Jetstar destination,
and why do you deserve a $500 Jetstar flight voucher to help
get you there?”5.1.3 their first name, last name, email address, phone number,
and state of residence.
6. Incomplete, indecipherable, or illegible entries will be deemed invalid and will be rejected.
The Promoter reserves the right to disqualify any entry where it reasonably suspects that
such materials are prohibited by these terms and conditions, any relevant law, or are
otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions
will not be entered into. Entries that are considered unlawful, harassing, defamatory, abusive,
threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain
objectionable content or are otherwise inappropriate will be deemed invalid and will be
rejected.
7. There is a limit of one entry per person for the duration of Promotion Period.
8. The Promoter reserves the right to verify the validity of entries and reserves the right to
disqualify any Eligible Entrant for tampering with the entry process or for submitting an entry
that is not (in the reasonable opinion of the Promoter) in accordance with these terms and
conditions.
9. The Promoter is not responsible for any lost, late or misdirected entries.
Consent of persons appearing in the entry
10. Each Eligible Entrant confirms that:
a. all persons appearing in the entry, or whose identity is apparent or can be reasonably
ascertained in the entry, have consented to the Eligible Entrant submitting the entry as part
of this competition; and
b. such consent includes consenting to the Promoter’s right to use the entry in accordance with
these terms and conditions.
Judging
11. The winner will be the entry judged by a panel of judges appointed by the Promoter to be the
most original and compelling story from the pool of entries submitted during the Promotion
Period. Entries will be judged at the offices of the Promoter at 11am (AEDT) on Monday 13
February.
12. The competition is a game of skill and chance plays no part in determining the winner.
13. Winner will be notified by phone and/or email by no later than 3pm (AEDT) on Monday 13
February. If any prize remains unclaimed by 5pm (AEDT) on Tuesday 21 February, another
winner for each unclaimed prize will be judged by the panel of judges from the remaining
pool of entries at 1pm (AEDT) on Wednesday 22 February and the winner will be contacted
by email by 5pm (AEDT) on the same day.
14. The judges' decision is final and the Promoter will not enter into correspondence regarding
the result.
15. The winner’s name will be published on Jetstar’s wall on Facebook and Twitter.
Conditions winner must agree to prior to accepting a prize
16. It is a condition of accepting a prize that the winner agrees to the conditions set out in
clauses 17 – 22.
Grant of license to use entry
17. While the winner retains ownership of the copyright of all entries submitted, it is a condition
of accepting a prize that the winner grants to the Promoter a non-exclusive, irrevocable,
royalty-free, world-wide, sub-licensable licence for 2 years without compensation to use their
entry in any media for any purpose, including but not limited to publishing the entry on the
Promoter’s website, promoting future promotions and competitions of a similar nature, in
connection with the Promoter’s promotions, advertising or marketing, and sharing the story
with media agencies and publishers in Australia.
Consent in relation to moral rights and publishing the winner’s name
18. The winner provides an unconditional and irrevocable consent to the Promoter and its assigns
to commit any act or omission in relation to the winner’s entry that may constitute an
infringement of the winner’s rights to integrity of authorship, rights of attribution of
authorship, rights not to have authorship falsely attributed and rights of a similar nature that
exist, or may come to exist, anywhere in the world.
19. Although not obliged to do so, should the Promoter or its assign wish to publish the winner’s
name, the winner consents to their name being published in connection with the entry.
Warranties in relation to the winning entry
20. The winner represents and warrants that:
a. either:
i. all rights to the entry belong to and are original to the winner; or
ii. they have written consent to use the entry, and the entry does not and shall not infringe
on, any copyright or any other third party right;
b. the entry does not violate any applicable law or regulation;
c. the winner has the right to grant any and all necessary rights and licenses in these terms and
conditions, including without limitation, all necessary copyright and other related rights to the
entry.
Winner’s reconfirmation of consent of persons appearing in entry
21. The winner reconfirms that:
a. all persons appearing in the entry, or whose identity is apparent or can be reasonably
ascertained in the entry, have consented to the winner submitting the entry as part of this
competition; and
b. such consent includes consenting to the Promoter’s right to use the entry in accordance with
these terms and conditions.
Agreeing to the terms of the prize voucher
22. It is a condition of accepting the prize that the winner accepts and complies with all the
conditions of use of the prize voucher.
THE PRIZE
23. There is one prize valued at a maximum of AU$500 based on the recommended retail value
at the time of printing. The Promoter accepts no responsibility for any variation in the value
of the prizes.
24. The major prize consists of:
19.1 x $500 AUD Jetstar flight voucher
25. The prize must be taken as stated and no compensation will be payable if the recipient is
unable to use the prize as stated. The prize is not exchangeable or redeemable for cash or
other goods or services. A prize cannot be transferred to any other person, unless agreed to
by the Promoter. There can be no changes made to travel arrangements once tickets are
issued.
26. If any act, omission, event or circumstance occurs which is beyond the reasonable control of
the Promoter and which prevents the Promoter from complying with these terms and
conditions, the Promoter will not be liable for any failure to perform or delay in performing its
obligations and the Promoter reserves the right (subject to any applicable law) to cancel,
terminate or modify or suspend this promotion.
27. The Promoter, its related bodies corporate and their respective officers, employees,
contractors and agents (Promotion Parties) will not be liable for any losses, damages,
expenses, costs or personal injuries arising out of this promotion, the promotion of this
promotion or the use of any prize, including but not limited to any breach of these terms and
conditions, contract or tort (including negligence) and any other common law, equitable or
statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and
consequential Damages, including Damages that cannot reasonably be considered to arise
naturally and in the ordinary course of things, even if those Damages were in the
contemplation of the Promotion Parties.
28. The exclusion of liability in clause 27 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of goods
or services which are supplied by the Promoter in the ordinary course of business. To
remove doubt: third party goods or services, which other than in connection with this
promotion, are in the normal course of business supplied by a third party unrelated to the
Promotion Parties, are not supplied by the Promoter in the ordinary course of business;
and the Promoter’s Conditions of Carriage and general booking conditions (and any
exclusions contained therein) apply despite any statement to the contrary in these terms
and conditions; or
b) to the extent it is not permissible at law to limit or exclude liability in the manner
contemplated in that clause (in which case that liability is limited to the maximum extent
allowable by law).
29. This promotion is in no way sponsored, endorsed or administered by, or associated with,
Facebook. Entrants understand that they are providing their information to the Promoter and
not to Facebook. The information an entrant provides will only be used for the purposes
outlined in these Terms and Conditions. By entering this competition, each Eligible Entrant
releases Facebook from any action or claim arising out of the competition. Any questions,
comments or complaints about this promotion must be directed to the Promoter and not to
Facebook.
30. The Promoter collects personal information about entrants for the purpose of running this
competition. The name and photograph of the winner may be used for promotional purposes
by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting
the prize. Entry details remain the property of the Promoter. Eligible Entrants consent to the
Promoter using personal information provided in connection with this promotion for the
purposes of facilitating the conduct of the promotion and awarding any prizes. Without
limiting the foregoing Eligible Entrants' personal information provided in connection with this
promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of
which is available at
