TERMS AND CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over who are available to travel on 22/02/2012. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter.
Promotion commences 06/02/2012.
Entries close 11.59pm AEDST on 13/02/2012 (‘Promotional Period’).
To enter, individuals must, during the Promotional Period:
visit and ‘Like’ the FX Australia Facebook page (
http://www.facebook.com/ FXTVAU);
navigate to the Watch & Win tab;
input the requested details in the application box provided;
watch the FX video of the day; and
Include an answer to a question relating to the FX video of the day, and submit the fully completed entry form. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) each entry must be submitted separately and in accordance with entry requirements; and (b) a maximum of one (1) entry per person per day is permitted.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
There are two (2) types of draws for this promotion, a daily draw and a major prize draw. For the daily draws, there will be one (1) draw conducted for each day of the Promotional Period (8 in total, each a “daily draw”). Entries received on each day of the Promotional Period will be entered into the relevant draw for that day, which will take place the following business day. Final daily draw will close 11.59pm AEDST on 13/02/2012. Each daily draw will take place at The Shop, 71 Balfour Street, Chippendale NSW 2008 at3:00pm AEDST. Daily draws will be conducted each day between 07/02/2012 and 14/02/2012 (excluding weekends and NSW public holidays, if any, in which case the draw for that day will take place the following business day). The major prize draw will take place at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 on 14/02/2012 at 12.00pm AEDST. Non-winning entries in each daily draw will not be entered into any subsequent daily draws but all entries (including winners in a daily draw) will be entered into the major prize draw. The Promoter may draw additional reserve entries in the major prize draw and record them in order in case an invalid entry or ineligible entrant is drawn.
All winners will be notified in writing by email and phone within two (2) business days of the relevant draw. The major prize winner’s name will be published in The Australian on 16/02/2012. The Promoter’s decision is final and no correspondence will be entered into.
The first valid and correct entry drawn in each daily draw will each win FX Promotional Merchandise, to be determined by the Promoter in its absolute discretion, valued at $30.00.
The first valid entry drawn in the major prize draw will win a trip for two (2) people to Sydney, NSW valued at up to $1,000.00 depending on date and point of departure. Prize includes one (1) nights twin share accommodation at a minimum four (4) star hotel, and a double pass to the FX launch party and FX VIP experience. If the major prize winner is not from Sydney, NSW, prize also includes return economy airfares from the major prize winner’s nearest capital city to Sydney. If the major prize winner is from Sydney, NSW, then the major prize does not include airfares and the airfare component of the major prize is not redeemable for cash. Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Major prize must be taken to coincide with the FX launch party with flights departing on 22/02/2012 and is subject to booking and flight availability.
Frequent flyer points will not form part of the major prize. The major prize winner may be required to present their credit card at time of accommodation check in. Major prize is subject to the standard terms and conditions of individual prize and service providers.
If for any reason the major prize winner does not take the major prize (or an element of the major prize) at the time stipulated by the Promoter, then the major prize (or that element of the major prize) will be forfeited and will not be redeemable for cash.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The FX launch party double pass is subject to the event venue and ticket terms and conditions. The Promoter and event organisers hereby expressly reserve the right to eject the major prize winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the major prize.
Total prize pool value is up to $1,240.00.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed daily prizes may take place on 16/05/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing by email and by phone within two (2) business days of the draw. If the major prize remains unclaimed by 3:00pm AEDST on 17/02/2012 an unclaimed prize draw will take place. The first valid entry drawn and successfully contacted by phone and in writing will win the major prize. If the unclaimed major prize prize draw winner cannot be contacted within twenty four (24) hours, the Promoter will contact the next drawn major prize winner until a major prize winner is determined. Results will be published in The Australian on 21/02/2012.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the FX launch party is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; (g) use of a daily prize; or (h) taking the major prize.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
