THE AUSTRALIANS `Handa Opera on the Harbour Promotion 1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via email only. 2. Entry into the promotion is open to residents of Australia aged 18 years or older who enter via email to the specified address - (click to respond) using the subject line: La Traviata. The Promoter is Nationwide News Pty Limited A.B.N. 98 008 438 828 of 2 Holt Street, Surry Hills, NSW 2010. Officers and employees (and their immediate families) of the Promoter and Opera Australia, their related bodies corporate and the Promoters participating outlets, newsagents, sub-agents and agencies associated with this promotion, are ineligible to enter. 3. On 11/2/12 and 13/2/12 a promotional advertisement will be published in the Review section of The Weekend Australian/The Australian with a question for Entrants to answer. Entrants must answer the question in 25 words or less and send their entry via email to (click to respond) Entrants must include a contact telephone number. 4. The promotion commences at 12.01 am (Sydney time) on Saturday 11/2/12 and ends at 11.59 pm (Sydney time) on 13/2/12 ("Promotional Period"). The Promoter accepts no responsibility for late, lost or misdirected entries. 5. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoters legal rights to recover damages or other compensation from such an offender are reserved. 6. Entrants can only enter in their own name. 7. The winner will be entrant whose answer is judged to be the most creative. The competition judging will take place on Tuesday 14/2/12 at The Australian, 2 Holt Street, Surry Hills, NSW 2010. Winners will be notified by telephone and email following the judging and their name and locality will be published in The Weekend Australian on 18/2/2012. All reasonable steps to notify the winner of the result will be taken by the Promoter. The result of the judging is final and no correspondence will be entered into. The Promoters decision in relation to all aspects of the promotion is final and no correspondence will be entered into. 8. The prize package for two is: Two tickets to an evening performance of Handa Opera on Sydney Harbour, La Traviata Two return business class fares to Sydney Two nights accommodation in a Sydney Medina Apartment Hotel including breakfast. Dinner and interval drinks at the exclusive Platinum Lounge Exclusive behind the scenes tour Maximum total prize pool value is up to $5,500. All prize values are based on the recommended retail price (depending on point of departure and the date the prize is taken). The prize includes airfares as stated from the Australian capital city nearest the winners usual Australian residential address. The prize is inclusive of charges and taxes included in the price of airfares. Business class flights will not be awarded if the winners permanent residential address is in Sydney. The accommodation portion of the prize is for two consecutive nights accommodation in a one-bedroom apartment for two adults at a Medina Apartment in Sydney as specified by Toga Hospitality. The winner must provide a valid credit card at check-in to cover any incidentals incurred throughout the stay. 9. The prize date is subject to availability. The prize including accommodation and travel must be booked by 24/2/2012 . Opera Australia will make the bookings for the prize winner. 10. The Promoter reserves the right to request the winner and travel companion to produce appropriate photo identification and other documentation (to the Promoters satisfaction, at its discretion) in order to confirm the winner and travel companions identity, age and residential address before issuing the prize. It is a condition of accepting the prize that a winner (and their travel companion) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 11. All meals, beverages, extra activities, spending money, insurance, , taxes not included in the price of the ticket, transport to and from departure point, airport transfers and all other ancillary costs are the responsibility of the winner and their travel companion, except to the extent expressly identified above as included in the relevant prize. Compliance with any health or other government requirements is the responsibility of each prize winner and their nominated travel companion. The winner and their travel companion must travel together on the same flights. There can be no changes made to travel arrangements by the winner or their travel companion once tickets are issued. 12. The winner and their travel companion are responsible for obtaining (and the cost of obtaining) medical advice prior to taking the prize and obtaining any recommended medical treatment), before travelling. 13. Taking of the prize is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers or tour provider (where applicable) and in particular, health, behaviour, age and safety requirements. Any part of a prize that is not taken for any reason is forfeited. No compensation will be payable if the winner, or their travel companion, are unable to use any element of the prize as stated for whatever reason, including participation in certain activities for health, behaviour or safety reasons. 14. Use of any passes, tickets or vouchers issued as part of the prize is subject to prevailing terms and conditions of use and passes. Tickets or vouchers are only valid for the dates specified. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. 15. The Promoter and Opera Australia accept no responsibility for any variation in any prize value. 16. The prize, or any unused portion of the prize, is not exchangeable for other goods or services and cannot be taken as cash. A prize is not transferable. No prize or any component of a prize can be sold on e-Bay or any other online auction site. The prize must be taken as offered and cannot be varied. The prize is subject to availability. 17. In the event that any part of a prize becomes unavailable due to circumstances beyond the Promoters control, including cancellation of the event by Opera Australia, the Promoter reserves the right to provide an alternative prize in its sole discretion by the Promoter, subject to any written directions made under applicable State or Territory legislation. 18. The Promoter and Opera Australia, their related bodies corporate and their respective officers, employees and agents shall not be liable for any loss (including, without limitation, direct, indirect and consequential loss), or for any damage, personal injury or death (including but not limited to that arising from any persons negligence) suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize (including but not limited to any component of the winners or their travel companions trip), except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agencies associated with this promotion takes no responsibility for prizes (or parts of prize) damaged or lost in transit. 19. In the event of any circumstance beyond the control of the Promoter and Opera Australia or any prize supplier, including any act of God, fire, explosion, flood, war, acts of terrorism, theft, malicious damage, strikes, lockouts or industrial action of any kind, or any other circumstance beyond the reasonable control of the Promoter, the Promoter reserves the right or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. 20. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter. 21. Entrants consent to the Promoter using the entrants name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and any suppliers of components of that winners prize. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents. 22. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant cannot participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials (including The Australians newsletters) via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future). The Promoter may share information with its Australian related companies who may contact entrants in this way with special offers. By entering the promotion, each entrant agrees that the Promoter may use entrants personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published each winners name and locality in any media. The Promoter is part of a global media and entertainment company. The Promoter encourages consumers to enjoy alcohol in moderation. Legal aged consumers are advised to consider the low risk drinking guideline recommended in the National Health & Medical Research Council Australian Alcohol Guidelines which states: Adult males: Up to 6 standard drinks on any one day, no more than three days a week.
