TERMS AND CONDITIONS

Information on how to enter and prizes form part of these Terms and Conditions. Participation in the Buy-Smart 2012 promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
2. The promoter is Colonial First State Property Management Pty Ltd (ABN 96 101 504 045) of 1341 Dandenong Road, Chadstone VIC 3148, telephone: (03) 9936 1222 (”Promoter”).
3. Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
4. Officers, management and employees (and their immediate families) of the Promoter, the Promoter’s associated companies and contractors, participating retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The Promotion commences at 9am (local time) on 13.02.2012 and ends at close of business on 26.02.2012 (“Promotional Period”).
6. This Promotion is being conducted at the following shopping centres (“Participating Centres”): VIC: Bayside Shopping Centre (2-6 Olsen Street Frankston VIC 3199); Broadmeadows Shopping Centre (1099-1169 Pascoe Vale Road, Broadmeadows VIC 3047); Northland Shopping Centre (2-50 Murray Road, Preston VIC 3072); Forest Hill Chase Shopping Centre (270 Canterbury Road, Forest Hill VIC 3131); TAS: Eastlands Shopping Centre (Bligh Street, Rosny Park TAS 7018); SA: Elizabeth Shopping Centre (Suite 1 Raleigh Chambers, 50 Elizabeth Way, Elizabeth SA 5112); The Myer Centre Adelaide (Level 6, The Myer Centre, Rundle Mall, Adelaide SA 5000); WA: Midland Gate Shopping Centre (Great Eastern Highway, Midland WA 6056); Rockingham Shopping Centre (1 Council Avenue, Rockingham WA 6168); QLD: The Myer Centre Brisbane (91 Queen Street, Brisbane QLD 4000); Grand Plaza Shopping Centre (27-49 Browns Plains Road, Browns Plains QLD 4118) (each a “Participating Centre”).
7. To be eligible to enter, an individual must, during the Promotional Period, spend $80 or more at participating retailer(s), during the course of one (1) day, at a Participating Centre (“Qualifying Spend”).
8. The Qualifying Spend may include purchases made at multiple participating retailers within the same Participating Centre, and may include purchases of gift card(s), however, the qualifying spend must be made during the course of one (1) day during the Promotional Period. Transactions undertaken at major retailers such as department stores, and supermarkets are ineligible. For a full list of participating retailers see the Participating Centre’s website, Customer Service Desk or Centre Management Office.
9. To receive an entry into the major prize draw, an individual must, during the Promotional Period: (a) present their original purchase receipt(s) at the Customer Service Desk, Centre Management Office or promotion information booth of the relevant Participating Centre; (b) sign up to become a VIP member of the Participating Centre by fully completing their requested details on the iPad provided by the promotional staff at the Customer Service Desk, Centre Management Office or promotion information booth of the relevant Participating Centre and opting in as a VIP member of the Participating Centre.
10. In addition to receiving an entry into the major prize draw, individuals will also be eligible to receive a $10 gift card by fully completing the promotional electronic game at the Customer Service Desk, Centre Management Office or promotion information booth by following the game instructions to collect five (5) coins within ten (10) seconds. Individuals who play the promotional game and successfully collect five (5) coins within ten (10) seconds will receive a $10 gift card, while stocks of gift cards last at each Participating Centre. Once stock of gift cards has been exhausted in each Participating Centre, individuals will not be eligible to receive a gift card, however, they will still be eligible to receive an entry into the major prize draw.
11. Purchase receipt(s) must clearly specify the store(s) of purchase and that the purchase(s) was/were made during the Promotional Period, and show that the minimum Qualifying Spend has been achieved.
12. Multiple entries permitted, subject to the following: (a) only one (1) entry into the major prize draw and one (1) game play (while stocks of $10 gift cards last) permitted per $80 or more

spent at participating retailer(s), during the course of one (1) day, at a Participating Centre; and (b) each entry must be submitted separately and in accordance with entry requirements.
13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits a prize claim or entry that is not in accordance with these Terms and Conditions or who tampers with the claims process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14. Incomplete or indecipherable prize claims or entries will be deemed invalid.
15. The Promoter’s decision is final and no correspondence will be entered into.
16. The following table outlines the breakdown of $10 gift card prizes available to be won and the total $10 gift card prize pool, in each Participating Centre. The $10 gift cards are strictly limited to the numbers outlined in the table below. The exact retailer(s)/centre(s) where the $10 gift cards are redeemable will be determined by the Promoter in its absolute discretion, subject to availability.

17. The major prize draw will be conducted by electronic drawing system and will be held on 05.03.2012 at 11am AEDST at the Promoter’s head office; 1341 Dandenong Road, Chadstone VIC 3148. There will be four (4) winners drawn in the major prize draw (from all entries received from Participating Centres).
18. The first valid entry drawn in the major prize draw will win ten (10) nights twin share accommodation at the Sheraton Mirage, Port Douglas in a lagoon view room including breakfast daily for two (2) people (to a total of up to $7,000) and a $2,000 gift card for flights at any participating travel agent of the winner’s choice within the Participating Centre where the winning entrant made their Qualifying Spend.
19. The second valid entry drawn in the major prize draw will win ten (10) nights twin share accommodation at the Peninsular Hotel, Port Douglas in an Oceanfront Suite for two (2) people, return airport transfers to the Peninsular Hotel for two (2) people (if required), breakfast daily for two (2) people (to a total of up to $4,200) and a $2,000 gift card for flights at any participating travel agent of the winner’s choice within the Participating Centre where the winning entrant made their Qualifying Spend. If the winner is from QLD, then the prize does not include return airport transfers and the return airport transfer component of the prize is not redeemable for cash.
20. The third valid entry drawn in the major prize draw will win ten (10) nights twin share accommodation at the Hibiscus Gardens, Port Douglas in a 1 bedroom suite including breakfast daily for two (2) people, two (2) x three (3) hour Dreaming spa treatments (to a total of up to $3,750) and a $2,000 gift card for flights at any participating travel agent of the winner’s choice within the Participating Centre where the winning entrant made their Qualifying Spend.
21. The fourth valid entry drawn in the major prize draw will win ten (10) nights twin share accommodation at the Rydges Sabaya Port Douglas Resort for two (2) people (valued at up to $3,000) and a $2,000 gift card for flights at any participating travel agent of the winner’s choice within the Participating Centre where the winning entrant made their Qualifying Spend.
22. In addition, each major prize draw winner will also receive a six (6) hour Outer Reef trips with Quicksilver for two (2) people, a Wildlife Habitat family pass (for two adults and two children

aged 12 years or younger) to either ‘Breakfast with the Birds’ or ‘Lunch with the Lorikeets’ and a VIP behind the scenes wildlife care tour, a Cape Tribulation Exotic Fruit Farm ‘Tropical Fruit Tasting Tour’ for two (2) people, a Solar Whisper Daintree River Wildlife Cruise for two (2) people and a double pass to the ‘Flames of the Forest’ which includes a six (2) course tasting menu (redeemable on Saturday evenings only), valued at a total of $1,050 for each major prize draw winner.
23. The major prize draw winners will be notified in writing within 2 days of the draw and their names will be published in The Australian newspaper on 09.03.2012.
24. The prize for the first major prize draw winner is valued at up to $10,050. The prize for the second major prize draw winner is valued at up to $7,250. The prize for the third major prize draw winner is valued at up to $6,800. The prize for the fourth major prize draw winner is valued at up to $6,050. Total maximum prize pool value in each participating State is: $59,740 (QLD); $64,200 (VIC); $37,150 (TAS); $59,720 (SA); and $39,700 (WA). This is a grand total of $139,910 in gift card prizes and major prize draw prizes nationally.
25. As a condition of accepting a major prize, each major prize draw winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
26. Spending money, additional meals (other than those specified), insurance, transport to and from departure point, additional transfers (other than those specified), items of a personal nature, in-room charges and all other ancillary costs are not included. All elements of a prize awarded in the major prize draw must be taken by 31.05.2013 and is subject to booking and flight availability. Prizes cannot be taken during Australian school holidays, public holidays or other peak periods such as Christmas and Easter periods in Australia.
27. During the entire duration of a prize awarded in the major prize draw, a nominated parent/guardian must accompany any person under 18 years of age. Each winner and his/her companion are responsible for ensuring that they have valid travel documentation. Each winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of a prize awarded in the major prize draw. Each winner may be required to present their credit card at time of accommodation check in. Prizes awarded in the major prize draw are subject to the standard terms and conditions of individual prize and service providers.
28. Once a major prize draw winner has redeemed their $2,000 gift card for flights, that major prize draw winner can use any remaining balance on the gift card to redeem for other products/services within the Participating Centre where the winning entrant made their Qualifying Spend. In the event that a major prize draw winner does not require flights to Port Douglas, the major prize draw winner can use the $2,000 gift card to redeem for other products/services within the Participating Centre where the winning entrant made their Qualifying Spend. In the event that the Participating Centre where the winning entrant made their Qualifying Spend does not have a travel agent service, then the Participating Centre will select a local travel agent company to arrange the relevant winners’ flight bookings and any remaining amount will be provided to the relevant winner in the form of a gift card, redeemable at the Participating Centre where the winning entrant made their Qualifying Spend.
29. Any unused balance of any gift card will not be awarded as cash. Redemption of any gift card is subject to any terms and conditions of the issuer including those specified on the gift card. Any ancillary costs associated with redeeming a gift card are not included.
30. If a winner of a prize awarded in the major prize draw is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
31. If for any reason a winner does not claim a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
32. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority.
33. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
34. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

35. Any un-won $10 gift cards remaining at a Participating Centre after the Promotion has ended will be distributed randomly to individuals at that Participating Centre who sign up to become a member of that Participating Centre.
36. A second chance prize draw will be held on 05.06.2012 at 11am AEST at the Promoter’s head office to distribute any major prize(s), if unclaimed. The second chance prize draw winner(s), if any, will be notified in writing within 2 days of the draw and their name(s) will be published in The Australian newspaper on 08.06.2012.
37. It is a condition of accepting a prize, each winner consent to the Promoter or Participating Centres using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period, without any remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products or services, distributed and/or supplied by the Promoter or the Participating Centres.
38. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
39. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
40. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/redemption/taking of a prize.
41. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry into this Promotion is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic or mail messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
