HOW TO ENTERTo enter, individuals must become members of PawClub during the Promotional Period by visiting
www.pawclub.com.au, following the prompts to the membership application page, inputting all of the requested details and submitting the fully completed online application form between 01/02/2012 and 11.59pm AEST on 30/04/2012. Individuals must still be members of the PawClub at the relevant draw date and time (as specified below) to be eligible to win a prize.
Individuals who are existing members of PawClub before the start of the promotional period will not be eligible to enter.
Once an entrant registers to become a member of PawClub, he/she will be eligible to receive bonus entries by visiting
http://www.pawclub.com.au/TellAFriend.aspx and nominating friends or family members (Friend) to become members of PawClub. To receive a bonus entry in respect of a Friend the following conditions must be met:
a. PawClub must receive the Friend’s full and correctly completed PawClub membership application before 11.59pm AEST on 30/04/2012;
b. the Friend must nominate the entrant (via the membership application form) as the person who referred the Friend to PawClub; and
c. the Friend must not already be a PawClub member and must be an Australian resident.
A maximum of five Friends can be nominated by each entrant.
The bonus entry, for up to a maximum of 5 referred friends, will be awarded to the entrant for the draw(s) corresponding to the date that PawClub accepts the Friend's membership application. The Friend will also receive an entry for becoming a PawClub member (into the draws corresponding to the date that PawClub accepts the Friend's membership application).
If a referred Friend does not follow the prompts to register for PawClub during the promotional period, no entries will be awarded in respect of that Friend.
Entrants should only refer friends/family members with whom they have a direct relationship and who consent to receiving information about these types of promotions.
TERMS AND CONDITIONS Information on how to enter and the prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents.
Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Employees of the Promoter and its agencies associated with this promotion and their immediate families are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries, referrals, entrants and Friends (including their identity, age and place of residence) and to disqualify any entrant or Friend who, in the Promoter’s opinion, submits a referral and/or entry that is not in accordance with these Terms and Conditions or who tampers with the entry/referral process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries and Friend applications will be deemed invalid.
Only one (1) membership registration is permitted per person. An entrant can receive a maximum of five (5) bonus entries via the refer a friend mechanic.
If there is a dispute as to the identity of an entrant or a Friend (or otherwise as to the validity of an entry or referral), the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or Friend (and to otherwise verify an entry or referral). The Promoter may request proof satisfactory to the Promoter (such as an email or confirmation via phone, as determined by the Promoter) that the Friend was nominated by the entrant (or otherwise as to the validity of the entry or referral) and the Promoter may make enquiries of the entrant to confirm same. The entrant and/or Friend must provide the information required by the Promoter for the purpose of verifying and entry or referral. Failure to provide such proof to the satisfaction of the Promoter may result in the Promoter invalidating all of an entrant’s entries and forfeiture of a prize.
Promotion commences on 01/02/2012. Entries into each draw close at 11.59pm AEDST/AEST (as applicable in NSW) on the dates specified in the table below. Final entries close on 30/04/2012. Entries into each draw will open directly after the entries for the previous draw close. All draws will take place at Orchard Marketing, Studio 1, 285A Crown Street, Surry Hills, NSW, 2010 at 3pm (Sydney-time) on the dates specified in the table below. Entries in each draw will NOT be entered into any subsequent draws. Winners will be notified in writing and their names will be published in The Australian on 21/05/2012.

The Promoter’s decision is final and no correspondence will be entered into.
The first three (3) valid entries drawn in each draw will each receive a Nintendo Wii prize pack valued at a total of AU$268, including; a Wii console, Wii Remote plus, Wii Nunchuck, Wii Wheel and 2 animal related Wii games.
If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is AU$2,412.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
A draw for any unclaimed prizes may take place on 07/08/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing and their names will be published in The Australian on 14/08/2012.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry/referral software or any other mechanical or electronic means that allows an entrant to automatically enter/refer repeatedly is prohibited and will render all entries/referrals submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
