Smile for Change

Kids find any opportunity to smile. And when they smile, so do we. There are 5 million children in Australia - and it's our dream to get every single one of them to smile.

Here you can upload a beautiful smiling photo of your kid(s) and have it added to the gallery. Not only will you be donating, but if we reach enough smiles, your photo may be published in our giant book of smiles!

Terms and Conditions - Colgate Smile for Change Campaign

1.By participating, Participants agree to be bound by these conditions.
2.Photographs may only be submitted by Australian residents who are the parent or legal guardian of a child aged no older than 18 years ("Eligible Child") and who have a valid Facebook account.
3.The campaign commences at 00.01 AEDT on 04/02/2012 and closes at 23.59 AEDT on 31/12/2012 ("Campaign Period"). Submissions must be received by the Promoter during the Campaign Period. Submissions received after 31/12/2012 will not be accepted.
4.To participate, Participants must, during the Campaign Period: a.log onto the Colgate Smile for Change page on Facebook at www.facebook.com/colgateaustralia
b.'like' the Colgate Smile for Change Facebook page. Participants who have previously 'liked' the Colgate Smile for Change Facebook page will not be required to complete this step; and
c.follow the prompts to upload up to 3 photographs of their smiling Eligible Child or Eligible Children to the Application.

5.Participants may only upload a photograph of their own Eligible Child and must be that child's parent or legal guardian. Participants warrant that they have the consent of all other parents/legal guardians to submit the photograph of the Eligible Child to this campaign before uploading the photograph. Participants must own the copyright of the photograph uploaded or be entitled and have permission to use the photograph in the manner contemplated by these terms, including use of the photograph for promotional purposes surrounding this campaign per clause 12 below. By entering a photograph, Participants agree to the photo being made available for public viewing. Any child depicted in a photograph uploaded to the Facebook site must be decently dressed and presented. The Promoter reserves the right to vet all photographs prior to them going live on the Facebook page and reserves the right to remove any submissions at any time in their absolute discretion. However, the Promoter is not responsible for any photographs uploaded to the site and visitors to the site view it at their own risk.

Limit applies of a maximum of three photographs to be uploaded to the Application per Participant.
6.The Promoter will donate $1 to The Smith Family [to support disadvantaged children] for each photograph of Eligible Children that is uploaded to the Colgate Smile for Change Facebook page in accordance with these terms. The Promoter’s total maximum donation to The Smith Family is $200,000. The Promoter’s maximum possible donation to The Smith Family per Participant is $3 (ie $1 per photo up to a maximum of three photographs per Participant). If a Participant deletes a photo from the Application, no money will be deducted from the total donation to The Smith Family. For the avoidance of doubt, the Promoter will donate $1 for every photograph uploaded as per clause 4 up to the total cap of $200,000, rather than $1 for each smile in the photograph.
7.The Promoter reserves the right, at any time, to verify the validity of photographs, age, identity, residential address and any other information of Participants and their Eligible Children relevant to entry into or participation in this campaign. Without limitation, Participants agree to provide a copy of the child's birth certificate to the Promoter upon request. Promoter's decision in relation to all aspects of the campaign is final and no correspondence will be entered into. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this campaign.
8.The thoughts and views expressed on the Facebook page are only the thoughts and views of the individual that posted them. They are not representative of the opinions of Colgate Palmolive, nor do we confirm, guarantee or warrant the accuracy, completeness, or usefulness of any post.
9.This campaign is in no way sponsored, endorsed or administered by, or associated with, Facebook. It is a condition of entry that each Participant grants a complete release to Facebook from any claims that they now have or may have in the future which relate to or are incidental to this campaign.
10.The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the campaign.
11.Participants confirm and promise that their posts and photographs are original and do not infringe the intellectual property rights of any third party. Further, Participants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and licence to use and modify any posts (and ideas contained in posts) and photographs submitted by the Participant for the purposes of the Promoter's business and for promoting, publicizing or marketing this campaign, including on the Facebook page, in any book or collation of smiles which the Promoter may in its sole discretion create, publish or otherwise make available for the purposes of this campaign or for The Smith Family purposes and in other marketing materials, without the payment of any further fee or compensation. If requested by the Promoter, the Participant agrees to sign any further documentation required by the Promoter to give effect to this arrangement. To the extent permitted by law, Participants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.
12.All submissions remain the property of the Promoter. Details from submissions will be collected and used for the purposes of conducting this campaign (which may include disclosure to third parties for the purpose of processing and conducting the campaign) and for promotional purposes surrounding this campaign, which may include (if the Promoter determines, in its sole discretion) publishing or otherwise making available a collation or book of photographs submitted by Participants for the purposes of this campaign or for The Smith Family purposes. By participating in this campaign, Participants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the Participant. Participants may access, change and/or update their personal information and obtain a copy of the Promoter's privacy policy by contacting the Promoter on (02) 9229 5600 during office hours. Details from entries are being collected by Colgate Palmolive Pty Ltd and not by Facebook.
13.The Promoter is Colgate-Palmolive Pty Ltd (ABN 79 002 792 163) of 345 George Street, Sydney NSW 2000.
