Terms & Conditions of Entry
1. Information on how to enter the Promotion and the description of the prize that may be won in the Promotion forms part of these Terms & Conditions of Entry. Entry into the Promotion is deemed acceptance of these Terms & Conditions of Entry.
2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 203 Coward Street, Mascot, NSW 2020, Australia (tel 02 9691 3636) (Promoter).
3. The Promotion commences at 00:01 (AEDT) on 20 February 2012 and
closes at 16:59 (AEDT) on 18 March 2012 (Promotion Period).
4. Entry is open only to Australian residents over the age of 18 at the time of entering who are registered as members of the Qantas Frequent Flyer program (Eligible Entrants), but excluding:
(a) directors, management, employees and their immediate families of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate;
(b) members whose Qantas Frequent Flyer account is suspended, cancelled or otherwise terminated at any time during the Promotion Period or at the time of the draws.
5. There are two draws, the First Prize Draw and the Second Prize Draw, and one Prize to be won in each draw of this Promotion.
6. To be eligible for entry in the First Prize Draw, Eligible Entrants must, during the Promotion Period:
(a) visit qantas.com
(b) complete the entry form by
registering their Qantas Frequent Flyer member number, first name, surname and valid email address.
7. To be eligible for entry in the Second Prize Draw, Eligible Entrants must, during the Promotion Period, in addition to completing the First Prize Draw entry details, provide a short 'Message of Support' for Mark Webber in the space provided.
8. Eligible Entrants are permitted a maximum of one entry for each the First Prize Draw and Second Prize Draw. Eligible Entrants who wish to enter the Second Prize Draw must do so at the same time as entering the First Prize Draw. Note: the quality of the 'Message of Support' will not be judged. A draw of all valid entries received, will determine the Winner of the Second Prize.
9. The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
10. Two draws will take place at midday (AEDT) on Tuesday 20 March 2012 (Draw Date) at the offices of Mike Da Silva and Associates (Aust) Pty Ltd (ABN 50 003 894 022) (MDSA) at 15 Grosvenor Street, Neutral Bay NSW 2089, and will be conducted by MDSA and independently scrutinised.
11. First Prize Draw - The first valid entry randomly drawn will win the First Prize. Second Prize Draw - The first valid entry randomly drawn will win the Second Prize. The result of both draws is final and no correspondence will be entered into. The winners will be notified in writing within two days of the Draw Date and their names will be published in The Australian newspaper on 6 April 2012.
12. The Promoter reserves the right to request that winner provides proof of identification, age and Australian residency prior to receiving the prize. Proof of identification, age, and residency considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding the prize.
13.
Whoever is drawn as the winner of the First Prize will receive the prize, which consists of:(i) Two return Business class Qantas airfares, for the winner and a companion, from Sydney Australia to Arturo Merino Benitez Airport, Santiago, Chile. Flights are scheduled to arrive in Santiago, Chile on Monday 19 November 2012 and depart from Arturo Merino Benitez Airport, Santiago, Chile on Monday 26 November 2012. On Friday 23 November oneworld carrier LAN will fly the winners in business class from Santiago, Chile to Congonhas-São Paulo Airport, Sao Paulo Brazil. On Monday 26 November winners will be flown back in Business class to Santiago, Chile. Where required (as determined in the sole discretion of the Promoter), the Promoter will provide connecting domestic flights from the winner's nearest Qantas serviced airport to Sydney, Australia. If Business class is not available on a connecting domestic flight (eg. only QantasLink flights available), the winner and their companion will be seated in the next best flight class available.
(ii) Four nights four star twin share room only accommodation in Santiago, Chile (In: 19 November - Out: 23 November 2012) and three nights four star twin share room only accommodation São Paulo, Brazil (In: 23 November - Out: 26 November 2012);
(iii) Two return ground transfers from Arturo Merino Benitez Airport, Santiago, Chile and Congonhas-São Paulo Airport, Sao Paulo Brazil to the respective hotels in each city;
(iv) Two tickets to the Formula 1TM Brazilian Grand Prix 2012 in a corporate hospitality suite from Saturday 24 November 2012 to Sunday 25 November 2012 inclusive, including food and beverages;
(v) Two return ground transfers from the hotel to the Autódromo José Carlos Pace, São Paulo on Saturday 24 November and Sunday 25 November 2012;
(vi) The winner of the promotion will receive an AUD$5000 deposit into their direct earn Qantas Frequent Flyer Credit Card or if the winner does not have the above an AUD$5000 Travelex Cash Passport as spending money for the trip. The deposit of money into the direct earn Qantas Frequent Flyer Credit Card or the Travelex Cash Passport will be given to the winner prior to their departure on 19 November 2012.
The prize is inclusive of all airfare and accommodation taxes.
In addition, if, as a result of flight schedules and/or availability:
(i) the winner and their travel companion's connecting domestic and international prize flights may occur on different days; and
(ii) the winner and their travel companion must as a consequence stay overnight in the Australian city at which those flights connect.
The Promoter will award to the winner twin share accommodation (room only) in a four star hotel of the Promoter's choice in that Australian city for two persons for the night of that overnight stay.
The maximum retail value of the First Prize is $39,200.14. The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize is not transferable to another person (unless agreed by the Promoter) or exchangeable for another destination, or other goods and services and cannot be redeemed for cash. There can be no changes made to travel arrangements once tickets are issued.
15. The prize does not include:
(a) meals and stopovers other than stated, hotel car parking, other hotel incidentals, visas, passports, travel or other insurance, gratuities, merchandise or any other costs of a related, ancillary, personal or incidental nature not stated; or
(b) without limiting the foregoing, entry into any country, satisfying any customs or related requirements, compliance with any health or other government requirements, any other travel documentation and any extras of a personal nature (including without limitation tips, telephone, and laundry charges) are the responsibility of the prize winner and their nominated travel companions. Prize travel is subject to Qantas' General Conditions of Carriage. Tickets will not be exchanged for another destination.
16. Prize travel on the dates of travel specified above is subject to availability at the time of booking. If availability is limited, alternative travel and accommodation arrangements will be made. The prize winner and their nominated travel
companions cannot upgrade any part of the prize using cash or Qantas Frequent Flyer points and will not earn Qantas Frequent Flyer points on any part of the prize. The prize winner must travel together with their nominated travel companions on the same flights on all sectors of prize travel.
17. Prize travel will not be extended under any circumstances. If a winner cannot travel within these periods, the prize will be forfeited. If for any reason a winner does not take an element of the prize during the stated periods, and on the conditions stipulated by the Promoter (and those of any prize supplier), then that element of the prize will be forfeited.
18. If the prize or any element of the prize is forfeited under these terms and conditions or otherwise, cash will not be awarded in lieu of the prize or prize element.
19. The prize winner and nominated companions must accept and agree to be bound and to abide by the Conditions of Sale and the Conditions of Entry to the Formula 1TM Brazilian Grand Prix 2012 which are displayed at entrances to the relevant event and available at
www.gpbrasil.com.
20. Bookings will be made by the Promoter at least five weeks prior to departure. Flight schedules and accommodation arrangements are subject to change without notice. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
21. The Promoter reserves the right to refuse to allow the prize winner and/or that winner's nominated travel companions to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that the person is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner (and their nominated travel companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
22. Whoever is drawn as the winner of the Second Prize will receive AUD$2,000 worth of Qantas Air Travel. The following terms and conditions apply to the use of the Second Prize.(i) All bookings must be made direct with Qantas (on the phone number supplied at the time of winning);
(ii) Refund and cancellation fees on tickets are subject to the airfare conditions.
(iii) Amendments to bookings are subject to availability and airfare conditions. Fees may apply.
(iv) A booking fee applies to all flight bookings made over the phone and can be charged to the $2000 prize. For domestic bookings and bookings to New Zealand the booking fee is AUD$35 per passenger per booking and for bookings to all other international destinations the booking fee is AUD$60 per passenger per booking.
(v) The prize must be redeemed by, and all travel booked with the prize must be completed by, 30 June 2013. There will be no extension under any circumstance. At the date of expiry of the prize any residual will be forfeited. If the total of the travel booked by the prize winner is in excess of the prize awarded, the additional amount must be paid by card, and card payment fees may apply - see qantas.com for up to date card payment fee schedule.
(vi) The prize may be used to purchase tickets:
(a) on Qantas and QantasLink operated services with a Qantas flight number; and
(b) on Qantas marketed flights (with a Qantas flight number) operated by British Airways between London and Australia via Hong Kong, Bangkok or Singapore.
(vii) The prize may not be used to purchase tickets on any other codeshare other than stated or Jetstar flights.
(viii) The prize can be redeemed only for the flights permitted by these terms and conditions, and not be redeemed for the Qantas Club, Qantas Frequent Flyer memberships, Qantas Holidays packages or any accommodation.
(ix) The prize does not need to be redeemed in the one transaction.
(x) The prize travel booked by the prize-winner is subject to the general conditions of carriage.
The maximum retail value of the Second Prize is $2,000.
23. The combined maximum retail value of two Prizes in this Promotion is AUD$41,200.24. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this Promotion.
25. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these Promotion Terms and Conditions or forfeiting or not claiming the prize. If the prize remains unclaimed on 4 July 2012, MDSA will conduct a second chance draw on that date, at the same time and place as the original draw (subject to any directions given under applicable law). Any second chance draw prize winner will be notified in writing within two days and their name will be published in The Australian newspaper on 13 July 2012.
26. If for any reason the promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate or suspend the promotion.
27. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
28. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
29. The exclusion of liability in clause 25 does not apply to limit or exclude liability:
(i) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter's Conditions of Carriage and general booking conditions (and any exclusions contained therein)
apply despite any statement to the contrary in these terms and conditions; or
(ii) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
30. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes (including to MDSA and any applicable statutory authorities) and to conduct marketing activities and to conduct market research in accordance with the Qantas Frequent Flyer program terms and conditions available at qantas.com. Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at qantas.com.au/privacy.
