conditions, and entry into the promotion is deemed acceptance of these terms and conditions.
2. The promoter is Golden Casket Lottery Corporation Limited, ABN 27 078 785 449, 87 Ipswich
Road, Woolloongabba QLD 4102, Phone 131 868 (Promoter). The Promoter and its related
companies are referred to as the Promoter Group. This promotion is a promotional lottery
conducted pursuant to the Lotteries Rule 2010 (Qld).
3. The promotion will be conducted from 11:00:01pm AEST on 4th February 2012 until 11:00pm
AEST on 29th February 2012 (Promotion Period).
Eligibility
4. Entry to the promotion is free and is open to residents of Queensland, who are 18 years of age or
older, who are a Scratch eClub Member in the Promotion Period, and do not cease to be a
Scratch eClub Member at any time during the Promotion Period or up to the date of the Initial
Draw. The following persons are not eligible to enter the promotion: employees of the Promoter
Group who are directly involved with the Scratch eClub (including with any draw or event for this
promotion) and immediate family members of those employees, agents of the Promoter and
immediate family members of those agents, and employees of agents of the Promoter and
immediate family members of those employees.
Entry
5. To enter the Initial Draw, entrants must log on to the Scratch eClub website
(www.goldencasket.com/sec) during the Promotion Period, proceed to the entry page for the
promotion and enter the SYS CODE from a valid and non-winning Golden Casket $5 Deal or No
Deal (Q607) Instant Scratch-Its ticket. All entries become the property of the Promoter. Each
eligible Golden Casket $5 Deal or No Deal (Q607) Instant Scratch-Its ticket can only be used to
enter this promotion once.
Initial Draw Prize
6. For the Initial Draw there are five separate prizes to be won (individually referred to as an Initial
Draw Prize). Each Initial Draw Prize consists of the right to participate in an event called the
Treasure Chest Event (TCE) as detailed in these terms and conditions, in which each winner of
an Initial Draw Prize will:
(a) have the chance to win one of the Treasure Chest Prizes described in clause 33; and
(b) if the Initial Draw Prize winner resides more than 300km (as the crow flies) from the
Brisbane Queen Street Mall, have their transport costs for return travel between a point of
departure near the Initial Draw Prize winner’s residence and the Brisbane Queen Street
Mall, paid for by the Promoter to enable or assist the Initial Draw Prize winner to attend the
TCE. The method of transport will be at the Promoter’s discretion and may be by bus, train
or other means, but will not include taxi.
7. An Initial Draw Prize is not transferable or assignable to another person nor is it redeemable for
cash.
Initial Draw
8. The five winning entries will be drawn randomly by computer at 11:00am on Tuesday 13th March
2012 at 87 Ipswich Road, Woolloongabba, Queensland (Initial Draw).
9. The first five valid entries drawn in the Initial Draw will each win one of the Initial Draw Prizes,
subject to:
2
(a) the entrant’s right to an Initial Draw Prize not being forfeited under clause 16;
(b) the entrant producing to the Promoter when requested the original Golden Casket $5 Deal
or No Deal (Q607) Instant Scratch-Its ticket containing the SYS CODE relating to that
entry;
(c) the entrant producing to the Promoter when requested photo identification or other
identification acceptable to the Promoter which confirms that the entrant is over 18 years of
age; and
(d) the entrant completing a statutory declaration signed by a Justice of the Peace confirming
details about the entrant and their entry, including that the entrant is a resident of
Queensland.
10. The Promoter's decision as to the results of the Initial Draw is final and no correspondence will be
entered into.
11. Ten additional entries will be drawn at the Initial Draw to be reserves, in the order they are drawn,
in the event that a drawn entry is invalid or ineligible, an entrant’s right to an Initial Draw Prize is
forfeited, or an entrant does not wish to participate further in this promotion. To clarify, the sixth
drawn entry will be the first reserve, seventh drawn entry will be the second reserve, eight drawn
entry will be the third reserve, ninth drawn entry will be the fourth reserve, tenth drawn entry will
be the fifth reserve, eleventh drawn entry will be the sixth reserve, twelfth drawn entry will be the
seventh reserve, thirteenth drawn entry will be the eight reserve, fourteenth drawn entry will be
the ninth reserve and the fifteenth drawn entry will be the tenth reserve.
Contacting Initial Draw Prize Winners
12. The Promoter will attempt to contact each Initial Draw Prize winner within 24 hours after the Initial
Draw by any or all of the following means:
(a) telephone (landline and mobile);
(b) email; and
(c) post,
using the current contact details for each Initial Draw Prize winner as provided by them to the
Promoter for their respective Scratch eClub Memberships. A voicemail message will be left
wherever the landline or mobile telephone has a voicemail facility.
13. If the contact details necessary to facilitate any of the means of communication listed in clauses
12(a) – (c) are not contained in the Scratch eClub Membership details for the winner of an Initial
Draw Prize, the Promoter will not be obliged to attempt to contact that winner by that means of
communication.
14. If the Promoter is unable to directly contact the winner of an Initial Draw Prize by telephone, but
instead:
(a) leaves a voicemail message; and/or
(b) sends an email; and/or
(c) sends a letter by post,
that voicemail message, email and/or letter will include:
(d) the date and time by which the winner of the Initial Draw Prize must make direct contact
with the Promoter by telephone; and
(e) the Promoter’s contact phone number for doing so.
15. The Promoter may also announce or publish the initials and suburb or town of the winner of the
Initial Draw Prize in any media, including on television and the Promoter's website.
3
Forfeiture of the Right to an Initial Draw Prize
16. If a winner of an Initial Draw Prize has not made direct contact with the Promoter by telephone
within five business days after the date and time of the Initial Draw, then that person's right to the
Initial Draw Prize is forfeited and the first reserve will become the winner of that Initial Draw Prize.
If the first reserve has not made direct contact with the Promoter by telephone within five
business days after becoming the winner of that Initial Draw Prize, then that person’s right to the
Initial Draw Prize is forfeited and the second reserve will become the winner of that Initial Draw
Prize, and so forth. The reserve will take the place of the respective Initial Draw Prize winner
(i.e., if the second winner of an Initial Draw Prize drawn at the Initial Draw is replaced by a
reserve, that reserve will be considered the second winner of the Initial Draw Prize for the
purpose of these terms and conditions).
Date and time of the Treasure Chest Event
17. The TCE will be held on Saturday 21st April 2012 at 11.30am at the Queen Street Mall in
Brisbane City.
Attendees at the Treasure Chest Event
18. If a winner of the Initial Draw Prize is unable to attend the TCE, they can nominate a person to
act and attend on their behalf (Proxy) at the TCE, so long as this is:
(a) communicated by the winner of the Initial Draw Prize to the Promoter by telephone on 131
868; and
(b) confirmed in writing by the winner of the Initial Draw Prize to the Promoter by no later than
5.00pm on Thursday 12th April 2012.
19. A Proxy must be aged 18 years or over and will be permitted to utilise the transport aspect of the
Initial Draw Prize specified in clause 6(b).
20. Should a winner of the Initial Draw Prize or their Proxy:
(a) fail to attend the TCE; or
(b) be unfit to participate in the TCE due to intoxication or for any other reason (as determined
by the Promoter in its absolute discretion); or
(c) wish to claim anonymity under section 152 of the Lotteries Act 1997 (Qld);
a staff member of the Promoter Group will be appointed to act on that persons behalf at the TCE
(Representative).
21. The winner of the Initial Draw Prize or their Proxy or Representative in attendance at the TCE will
be known as and is referred to in these terms and conditions as a “Participant”.
22. The TCE will be hosted by a master of ceremonies selected by the Promoter.
23. The TCE will be supervised by a staff member of the Promoter Group who will amongst other
things oversee the conduct of the TCE and verify and confirm any entitlement to a Treasure
Chest Prize before it becomes final. The TCE will also be observed by a staff member of the
Queensland Office of Liquor and Gaming Regulation (Scrutineer) who will scrutinise the conduct
of the TCE and verify and confirm any entitlement to a Treasure Chest Prize before it becomes
final.
24. Each Participant must have valid photo identification with them at the TCE which each Participant
must produce to any staff member of the Promoter Group and the Scrutineer when requested.
The photo identification must include a photo of the Participant and the Participants date of birth,
current name and current address. The particular form of photo identification must be current
and not have an expiry date that has passed.
The Treasure Chest Event
25. The TCE will commence at 11:30am on Saturday 21st April 2012 during which there may be
4
speeches and other formalities.
26. A draw (Pre-Event Draw) will be conducted to determine which individual Key (as defined in
clause 27) each Participant will use in their attempt to unlock the Treasure Chest(s) (as defined in
clause 30) during the TCE.
27. Five keys, which will be identical in look and feel except for the cut of the key (individually
referred to as a Key), will be placed into a transparent container (Container). Each Key will be
capable of unlocking one (and only one) of the five locked Treasure Chests during the TCE.
28. For the Pre-Event Draw:
(a) Participants will be invited, in the order corresponding to the order that they were drawn as
an Initial Draw Prize winner in the Initial Draw (clarified below in clauses 28(a)(i) to (v)), to
draw one sealed non-transparent envelope (Envelope) out of the Container. The
Container will contain a total of five identical Envelopes and each Envelope will contain a
single number inside of it (“1”, “2”, “3”, “4” or “5”). Once each Participant has drawn one
Envelope from the Container, each Participant will be invited to open their respective
Envelope to see which number is stated inside their Envelope (“1”, “2”, “3”, “4” or “5”). For
the avoidance of doubt, Participants will draw one Envelope out of the Container in the
following order:
(i) the Participant that was confirmed as the first Initial Draw Prize winner in the Initial
Draw will draw one Envelope out of the Container first;
(ii) the Participant that was confirmed as the second Initial Draw Prize winner in the
Initial Draw will draw one Envelope out of the Container second;
(iii) the Participant that was confirmed as the third Initial Draw Prize winner in the Initial
Draw will draw one Envelope out of the Container third;
(iv) the Participant that was confirmed as the fourth Initial Draw Prize winner in the Initial
Draw will draw one Envelope out of the Container fourth; and
(v) the Participant that was confirmed as the fifth Initial Draw Prize winner in the Initial
Draw will draw one Envelope out of the Container last.
(b) Following the completion of the procedure set out in clause 28(a), Participants will then be
invited, in the numerical order corresponding to the number stated in each Participant’s
Envelope, to draw one Key out of the Container, so that:
(i) the Participant that was confirmed as the holder of the Envelope with number “1”
stated inside it will draw one Key out of the Container first;
(ii) the Participant that was confirmed as the holder of the Envelope with number “2”
stated inside it will draw one Key out of the Container second;
(iii) the Participant that was confirmed as the holder of the Envelope with number “3”
stated inside it will draw one Key out of the Container third;
(iv) the Participant that was confirmed as the holder of the Envelope with number “4”
stated inside it will draw one Key out of the Container fourth; and
(v) the Participant that was confirmed as the holder of the Envelope with number “5”
stated inside it will draw one Key out of the Container last.
29. A Participant will not be permitted to swap the Envelope they draw out of the Container with that
of any other Participant or for any Envelope not yet drawn out of the Container. Once a
Participant has drawn their Envelope from the Container, they must keep their hands and their
Envelope in plain and clear sight of the Scrutineer at all times. A Participant will not be permitted
to swap the Key they draw out of the Container with that of any other Participant or for any Key
not yet drawn out of the Container. Once a Participant has drawn their Key from the Container,
they must keep their hands and their Key in plain and clear sight of the Scrutineer at all times.
30. Once each Participant has one Key, the Treasure Chest opening part of the TCE will be
5
conducted. There will be five locked boxes resembling treasure chests (individually referred to as
a Treasure Chest). Each Participant will be invited, again in the order corresponding to the order
that they were drawn as an Initial Draw Prize winner in the Initial Draw, to attempt to open each of
the Treasure Chests that remain locked at the time of that Participant’s turn, using the Key that
that Participant drew in accordance with clause 28. Once a Participant is able to successfully
unlock a Treasure Chest, then that Participants turn is complete. For example: the Participant
that was drawn as the first Initial Draw Prize winner in the Initial Draw will use the Key that they
drew pursuant to clause 28 to attempt to unlock up to all five of the locked Treasure Chests, and
will stop once they have successfully unlocked one; the Participant that was drawn as the second
Initial Draw Prize winner in the Initial Draw will use the Key that they drew pursuant to clause 28
to attempt to unlock up to all four of the remaining locked Treasure Chests, and will stop once
they have successfully unlocked one; the Participant that was drawn as the third Initial Draw
Prize winner in the Initial Draw will use the Key that they drew pursuant to clause 28 to attempt to
unlock up to all three of the remaining locked Treasure Chests, and will stop once they have
successfully unlocked one; and so forth until all Participants have successfully unlocked one
Treasure Chest.
31. When a Participant is able to successfully unlock a Treasure Chest with their Key, that Participant
will win the one Treasure Chest Prize (see clauses 32 and 33) stated inside that Treasure Chest,
either:
(a) for themself (if the Participant is the same person as the winner of the Initial Draw Prize); or
(b) if the Participant is a Proxy or Representative, the Treasure Chest Prize will be won by the
winner of the Initial Draw Prize for whom the Participant is the Proxy for or Representative
for.
32. Each Treasure Chest will have one (and only one) Treasure Chest Prize stated inside the
Treasure Chest. Each Initial Draw Prize winner will win one Treasure Chest Prize and it will be
the particular Treasure Chest Prize that is stated inside the Treasure Chest that that Initial Draw
Prize winner (or their Proxy or Representative) is able to successfully unlock in accordance with
clauses 30 and 31. For example, if an Initial Draw Prize winner (or their Proxy or Representative)
is able to successfully open a Treasure Chest and the Treasure Chest Prize of AU$10,000 is
stated inside that Treasure Chest, then that Initial Draw Prize winner will win that Treasure Chest
Prize of AU$10,000.
33. There are a total of five separate Treasure Chest prizes to be won (individually referred to as a
Treasure Chest Prize). There is one Treasure Chest Prize of AU$200,000, one Treasure Chest
Prize of AU$50,000, one Treasure Chest Prize of AU$30,000, and two Treasure Chest Prizes of
AU$10,000 each. The combined value of all five Treasure Chest Prizes is AU$300,000.
34. At the request of each Initial Draw Prize winner, their respective Treasure Chest Prize will be paid
by electronic funds transfer or cheque. If cheque is requested, it will be delivered to the Initial
Draw Prize winner using the current contact details as provided by them to the Promoter for their
Scratch eClub Membership. Alternatively an Initial Draw Prize winner may elect to collect their
Treasure Chest Prize from the Promoter but that election must be made at the time the Initial
Draw Prize winner is notified of their win of the Treasure Chest Prize.
35. The right to a Treasure Chest Prize is not transferable or assignable to another person.
Privacy
36. The TCE will attract a public audience and may be reported or broadcast in whole or in part in
press, radio, television or the internet (including on news and news-related programs). Initial
Draw Prize winners (and/or their Proxies) will be identified at the TCE by their first name and
suburb or town. If an Initial Draw Prize winner (and/or their Proxy) does not consent to this, a
Representative will be appointed to act on his or her behalf in accordance with clause 20. Initial
Draw Prize winners may still be referred to by their initials and suburb or town.
37. Initial Draw Prize winners (and/or their Proxies) may be asked by the Promoter to participate in
publicity (e.g., press, radio, television coverage or photo shoots) associated with this promotion in
addition to that mentioned in clause 36.
38. By participating in the promotion, an entrant authorises the Promoter Group, and contractors and
agents of the Promoter Group, to access, collect and use personal information about the entrant,
6
and disclose personal information about the entrant, to the Promoter Group and its contractors
and agents, for the purposes of (i) conducting the promotion and (ii) providing the entrant with
information about products and services of the Promoter Group. Such information may be
provided electronically, or by contacting the entrant by telephone or other means, until such time
as the entrant asks the Promoter not to provide further information. An Initial Draw Prize winner
may be asked by the Promoter to participate in publicity associated with the promotion. The
Initial Draw Prize winner will have the right to elect whether or not to participate in that publicity in
accordance with these terms and conditions.
39. If an entrant does not provide personal information when requested, the entrant may not be able
to continue participating in the promotion. An entrant can request access to information held
about them by contacting the Promoter by email at privacyofficer@tattsgroup.com or by phone on
131 868.
Other
40. The Promoter reserves the right, at any time, to verify the validity of an entry or disqualify any
entrant who submits an entry that is not in accordance with these terms and conditions. The
decision to verify, validate or disqualify an entry is in the Promoter's absolute discretion.
41. The Promoter's decision concerning:
(a) the results of the Initial Draw; and
(b) any aspect of the TCE and its conduct,
is final and no correspondence will be entered into.
42. The Promoter will not be liable for any loss or damage or personal injury suffered or sustained:
(a) as a result of the promotion (including the TCE) or events that flow from or occur as a
result of participation in this promotion (including participation in the TCE or the taking of
an Initial Draw Prize); or
(b) for any problems or technical malfunction of its computer system, software or systems,
except for any liability which cannot be excluded by law.
43. No responsibility is accepted for late, lost or misdirected entries. The Promoter is not responsible
for any problems or technical malfunction of any computer system, software or Internet
difficulties, including any damage to an entrant's computer, resulting from participation in the
promotion. Any cost associated with accessing or submitting an entry are the entrant's
responsibility.
44. If the Promoter is prevented from or delayed in performing an obligation by Force Majeure then
the obligation is suspended during, but for no longer than, the period the Force Majeure
continues and any further period that is reasonable in the circumstances. "Force Majeure"
means an event beyond the reasonable control of the Promoter, which occurs without the fault or
negligence of the Promoter.
45. Subject to obtaining the approval from the relevant regulator (if applicable), the Promoter
reserves the right to delay or modify any aspect of this promotion if for any reason it is not
capable of running as planned (including without limitation, by reason of infection by computer
virus, bugs, tampering, fraud, technical failures, power failures or due to any other causes
unforeseen or beyond the reasonable control of the Promoter which corrupt or affect the
administration, security, fairness, integrity or proper conduct of the promotion) but only to the
extent necessary to overcome the issue that is affecting the running of the promotion as planned.
46. All references to time in these terms and conditions are a reference to Australian Eastern
Standard Time.
