Conditions of entry

1.Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.

2.Entry is open only to Australian residents who:

•are aged 18 or over;

•are available to answer their phone at all times between 2pm (AEDT/AEST, as applicable in Melbourne) and 4pm (AEDT/AEST, as applicable in Melbourne) on any Draw Date when contacted by the Promoter;

 •have a current and valid Australian passport (if the prize includes international travel); and

•are able to take the prize on the dates specified by the Promoter (including, if applicable, being able to make their own way to and from their departure airport in their nearest Australian capital city by the time and date specified by the Promoter).

Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this competition are ineligible to enter.
 3.The Competition Period is as follows:

•Starts at 2.00pm AEST/AEDT (as applicable, in Melbourne) on 23rd February

•Closes at 11.59pm AEST/AEDT (as applicable, in Melbourne) on 24th February

4.Entrants must, during the Competition Period, visit www.carltondry100.com.au (which can also be accessed via the Carlton Dry 100 Facebook page or the Carlton Dry 100 iPhone app) and fully complete the online entry form including by providing their contact details and answering the following question in 25 words or less: “In 25 words or less tell us what you’d do in the snow when you’re bored”.

 5.All entries must be received during the Competition Period. Entries are deemed to be received at the time of receipt into the Promoter’s database, not at the time of transmission by the entrant. Consumers may enter as many times as they wish provided that each entry is based on a different “25 words or less” statement.

6.The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple addresses or aliases may be disqualified.

 7.This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

8.Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion. This competition is a game of skill; chance plays no part in determining the winner. Each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, literary and creative merit. The judges’ decisions are final and no correspondence will be entered into.

9.All entries become the property of the Promoter and will not be returned to the entrant. Each “25 words or less” statement must be the entrant’s original work. By entering this competition entrants:

•consent to the Promoter making copies of or publishing the whole or any part of their entry (including the “25 words or less” statement) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purposes; and

•undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.

10.Entries will be judged immediately after the Close Date. The best valid entry, as determined by the judges, will win return flights for two to Tokyo, transfers to and from the airport to the hotel, 10 nights accommodation, All boarding passes and hire and $750 spending money.

 11.The winner will be notified by phone between 2pm and 4pm (AEST/AEDT, as applicable in Melbourne) on the Close Date. In order to be a valid entrant, the winner must answer their phone when contacted by the Promoter on the Close Date, accept the prize and otherwise comply with these conditions of entry. If a winner does not answer their phone when called between 2pm and 4pm (AEST/AEDT, as applicable in Melbourne) on the Close Date, their entry will be deemed not to comply with these conditions of entry and will be discarded. In this case, the Promoter will immediately thereafter award the prize to the next best valid entry and attempt to contact the new winner between 4pm and 6pm (AEST/AEDT, as applicable in Melbourne) on the Close Date.

12.Once the winner has claimed their prize, they will be required to take the prize within 72 hours of the Close Date (or within the time as specified by the Promoter). If a winning entry is deemed not to comply with these conditions of entry that entry will be discarded. The judges’ decision is final and no correspondence will be entered into.

13.If the prize includes tickets (e.g. to a movie, concert, sports game or event) or a voucher, the tickets/voucher are subject to any terms and conditions imposed by the prize supplier, including periods of validity.

14.If a prize includes subscription to a service, the subscription is subject to any terms and conditions imposed by the subscription supplier. Any costs incurred by the winner in using any additional services that are not covered by the subscription amount (as specified by the Promoter) will be the responsibility of the winner.

15.Where a prize includes travel, participating in an activity or attending an event:

1.the prize must be taken on the dates as specified by the Promoter and/or prize supplier to coincide with the event date/s;

 2.entrants acknowledge that there are inherent risks in some aspects of the prize and that using the prize may involve participating in dangerous activities. By entering this competition and accepting the prize, entrants accept that risk;

3.in order to participate in the activity/ies awarded as part of the prize, the winner and their companion/s (if applicable) must be aged 18 or over and comply with applicable height, weight, health, fitness and any other requirements normally associated with a particular activity. It is the winner’s responsibility to ensure that they and their companion/s (if applicable) are sufficiently healthy and fit so as to safely undertake the activities awarded as part of the prize. The Promoter reserves the right to deem that the winner and their companion/s (if applicable) are not sufficiently healthy or fit. The winner must comply with all requirements and directions of the people responsible for the conduct of the relevant activity and must ensure that their companion/s (if applicable) also comply;

4.where the prize involves participating in an activity to win further prizes by way of skill, the winner (and their companion/s, if applicable) must follow the rules and directions of the Promoter and/or Promoter’s representative at all times;

5.where a prize involves the winner (and companion/s, if applicable) meeting or attending a function/activity with a celebrity or other public figure, the Promoter will not be liable for the failure of the winner (and their companion/s, if applicable) to meet that person or failure of that person to attend the function/activity, for whatever reason;

6.as part of accepting the prize, the winner may be required to take audio-visual footage and photographs of themselves and their companion/s (if applicable), using a video camera provided by the Promoter, while taking the prize in accordance with the Promoter’s directions and rules. The winner is responsible for the video camera at all times and must reimburse the Promoter for any costs in the event the video camera is lost, stolen or damaged in any way. The winner may also be required to take still photographs of themselves and their companion/s (if applicable) using their own photo camera. The video footage and/or photos taken by the winner must be provided to the Promoter within the time specified by the Promoter. The video footage and photos provided by the winner to the Promoter becomes the property of the Promoter and will not be returned to the winner. The winner consents to the Promoter making copies of or publishing the whole or any part of the video footage and/or photos and otherwise exploiting the video footage and photos and any rights in relation to the video footage and photos, to publicise this competition or for any other purposes. The winner undertakes to the Promoter that the video footage and/or photos they submit are not, and its use by the Promoter will not be, in breach of any third party intellectual property rights. The video footage and photos must not contain any content that contravenes any law, infringes the rights of any person or is obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate. Without limitation, entrants must not include any content that involves nudity, malice, swearing, potentially defamatory material or is inconsistent with the applicable Australian advertising codes;

 7.if any part of the event/activity is abandoned, called off, varied or postponed for any reason, then at the Promoter’s discretion, the winner (and their companion/s, if applicable) forfeits all rights to attend the relevant event/activity and no cash or alternative tickets will be substituted for that part of the prize;

8.the winner (and their companion/s, if applicable) must, at the request of the Promoter and/or prize supplier, sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking any specified activity/ies forming part of the competition or prize. If the winner and/or their nominated companion/s (if applicable) do not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the relevant winner’s entry or claim will be deemed invalid. Where a winner’s entry is deemed invalid, the Promoter reserves the right to determine a new winner in accordance with paragraph 10;

9.the Promoter may in its absolute discretion prohibit an entrant’s participation in this competition, cancel a prize or otherwise cease to provide any benefit of a prize to a winner and their companion/s if the entrant or the winner (or their companion/s), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate (or of the business of the Promoter or any of its related bodies corporate), is contrary to law or is otherwise inappropriate; and

1.where the prize involves domestic or international travel, the travel prize cannot be taken during peak periods or Australian public holidays and must be booked and completed as specified by the Promoter and/or the supplier or organiser of the prize. Any accommodation or flights constituting part of the travel prize (if any) are subject to booking and availability. All costs associated with the travel prize which are not specified to be included in the prize, including but not limited to any transfer costs, additional taxes, meals, insurance and other ancillary costs, are the responsibility of the winner and their companion/s, as incurred. If the winner chooses to extend the dates of their travel prize, they do so at their own cost and the Promoter will not be responsible for any such associated costs. If the travel prize includes travel overseas, the winner and their companion/s (if applicable) are responsible for ensuring that they have all necessary documents to travel (including a current valid passport and any visas that may be required). It is a condition of accepting the travel prize that all persons taking the prize must depart and return at the same time.

 19.Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the prize/s.

20.The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.

 21.The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

22.The prize is not transferable or exchangeable and cannot be redeemed for cash (unless cash is specified). The Promoter accepts no responsibility for any variation in prize value. If for any reason the winner does not take an element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner (and their companion/s, if applicable) and cash will not be supplied in lieu of that element of the prize. If the prize or any element of the prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter.

 23.If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.

 24.The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
